It appearing to the Court by the and examination of T. R. EAGLES and the signature of Jonathan ELLIS having been duly proved by the oath and examination of the subscribing witness thereto, that the paper writing propounded by the Executor therein names, in the last will and testament of Delitha OWENS in the presence of said witnessed and that at the time of signing the same the said Delitha OWENS was of sound mind. It is therefore adjudged that the said paper writing be admitted to probate as the last will and testament of the said Delitha OWENS nd the Executor the same named qualify as such. This the 6th day of April 1888. A.B. DEANS Clerk Superior Court State of North Carolina Wilson County SS In the Probate Court A paper purporting to be the last will and testament of Delitha OWENS deceased, is exhibited before me the undersigned Judge of Probate for said County T.B. EAGLES the Executor therein mentioned and the due execution thereof by the said Delitha OWENS, by the oath and examination of T. R. EAGLES the subscribing witness thereto, who being duly sworn, doth depose and say and each for himself deposit and saith, that he is a subscribing witness to the paper writing now shown him, purporting to be the last will and testament of Delitha OWENS; that the said Delitha OWENS in the presence of this deponent subscribed his name at the end of said paper writing which now shown as aforesaid, and which bears date of the 27th day of July 1881. And the deponent further saith that the said Delitha OWENS the testator aforesaid, did at the time of subscribing his name as aforesaid, declare the said paper writing so subscribed by him and exhibited, to be his Last Will and Testament and this deponent did thereupon subscribe his name at the end of said will as an attesting witness thereunto, and at the request and in the presence of the said testator. And this deponent further saith, that at the said time where the said testator subscribed his name to the said last Will as aforesaid, and at its time of deponents subscribing his name as an attesting witness thereunto, as aforesaid, the said Delitha OWENS was of sound mind and memory of full age to execute a will and was not under any restraint to the knowledge, information or belief of this deponent. And further these deponents say not. T. R. EAGLES (seal) Several sworn and subscribed this 6th day of April 1888 before me. A. B. DEANS, CSC I, Delitha OWENS of the county of Wilson and State of North Carolina being of sound mind and memory but considering the uncertainly of my earthly existence do make and declare this my last will and testament in manner and form following, that is to say: Item First-That my executor hereinafter named shall provide for my body a decent Burial suitable to the wishes of my relation and friends and pay all funeral expenses with my just debts however and to whomsoever owing out of the moneys that may first come in to his hands as a part of parcel of my estate. Item Second- I give and bequeath to my beloved nephew B. A. HOWARD one cow and calf and their increase and one hundred dollars in money to be paid by my executor within two years from the time of my death and of any moneys belonging to my estate not otherwise disposed of to be his and at his disposal forever. Item Third_ I give and devise to my beloved Brothers Wilis DILDYS four children one hundred dollars to be paid by my executor within two years from my death out of my money belonging to my estate not otherwise disposed of to be theirs and at their disposal forever. Item Fourth- I give and devise to my beloved friend Joseph HAMILTON twenty twenty dollars to be paid by my executor within two years from the date or time of my death our of any moneys belonging to my estate not otherwise disposed of to be his and at his disposal forever. Item Fifth- I give and devise to my beloved niece Delitha DUPREE daughter of Furney DUPREE and sister Theresa one bed and bedstead four bed quilts four sheets two pillows and pillow cases one bolster all he choices one chest all of my wearing apparel with the exception hereinafter name ten dollars in money to be hers and at her disposal forever. Item Sixth- I give and devise to my beloved niece Elizabeth DUPREE sister to the above, one large skillet one oven and all the wearing apparel that I got by my sister Elizabeth, and which she desired me to keep for said Elizabeth DUPREE and which I now have in possession to beers and at her disposal forever. Item Seventh- I give and bequeath to my nephew B. A. HOWARD and Furney DUPREE and my niece Delitha DUPREE all the balance of my property not otherwise disposed of to be equally divided between them to be theirs and at their disposal forever. And lastly I do hereby constitute and appoint my trusty friends T.R. EAGLES and Jonathan ELLIS my lawful executors to all intent and meaning of the same, and every part and clause thereof, hereby revoking and declaring intently void all other wills and testaments by me heretofore made. In witness where of I the said Delitha OWENS do hereunto set my hand and seal this the 27th day of July 1881.
