I had a very hard time distinguishing between m/w t/l, etc. If you are in doubt about an entry, please try to check the original) Sandra Allen Fender fender@hci.net State of North Carolina Yancey County Be it remembered that at a Court of Pleas & Quarter Sessions opened & held for the County of Yancey at the Court House in the Town of Burnsville commenced on the first Monday after the fourth in September 1836. Present and Presiding the worshipful William Deyton, Jacob Slagle and Joseph L. Ray, Esquires. Joseph Pitman, who was appointed a Justice of the Peace appeared and took the necessary oaths. A deed from Lewis Bryan to David Norton was proven in open court by -eter Norton. A deed from R. Love by his agent J. R. Love to Aron Thomas for two tracts of land was proven in open court by Wm. Deyton. A deed from Sperlin Bowman to James Allen and from Valentine Sevier said James Allens trustee to Ebenezer L. Matthews guardian, for a tract of land was duly admitted to record upon the testimony of Samuel Powells certificate of the acknowledgment before him of Valentine Sevier and others testimony. Ordered by the court that the dividing line between David Willis, James Wilson, Elijah Green and Thomas Wilson, overseers of the roads begins at the Mine Creek Road at the gap of the Mountain between Stephen Pitmans and Joseph Tates old plantation and runs down the dividing Ridge to James Howells and all hands on the north side of said ridge that belonged to Greens and Wilsons ordered to work out their said road and those south of said ridge that returns as to their orders to be exempt from said road and also Joseph Buchanan who lives at the head of Snow Creek be exempt from Greens orders. Ordered that Margaret Elizabeth Gillespie, infant daughter of Telitha Gillespie be bound to Silas Gillespie until she is eighteen, who is now about three years of age. Said Gillespie is to give her two years schooling. At age 18 she is to be given one cow & calf, one good wheel and a pair of cards, one good feather bed to weigh 30lb. with good furniture, four good suits of store clothes together with other good wearing clothes and kitchen furniture. Ordered that Azar Bradshaw oversee the road from the ford of Bear Creek to the gap of the mountain above Stephen Pitmans. For reasons shown, James Buchanan be exempt from working the public road and paying poll tax. For reasons shown, Joseph Thomas be exempt from working the public roads and paying poll tax. Samuel H. Stephenson vs Joseph Tucker Defendant called and failed, judgment is entered against him and his security for debt of 27.25 and all cost. For reasons shown, Matthew Sparks be exempt from working public roads and paying poll tax for two years. Tuesday October 4, 1836 Present and Presiding: John Hensley, J. W. Wright, Malcom McCurry State vs Isaac Brigman Bastardy Issue to the Jury as to fraud John Holcomb vs James Powell Attachment Judgment made final and order of sale to issue. It appears to the court that Thomas Wilson is duly elected Sheriff for the next two years. He entered into bond in the sum of 10,000.00 with J. W. McElroy, Daniel Angel, and Simeon Burleson as security. John Carrel vs William Deyton Appeal Ordered by the court that Phillip Wilson oversee the road from the foard of Cain Creek to the foard of Toe River. Ordered that Henry Woody oversee the road from Simion Burlesons to Harriss Pitmans. Ordered that Thomas Ramsey oversee the road from May Jervises to the foard of laurel. Present: John Hensley, Moses Peterson and Joseph Pitman For reasons shown, Jesse R. Beaver be exempt from payment of a poll tax for the year 1835. It appearing that it was improperly charged. George Miller vs Raburn Garland Appeal Ordered that William A. Peak oversee the road from the ---- of the road over the gap of the mountain west of Levi Baileys to the Chestnut flats belonging to Capt. Gillespies Company living on the west of Gabriels Creek to the top of H----- Mountain. For reason shown, John Thomas be exempt from working public roads. Solomon Wardroupe (Brigman written above) to use of E. Jervis vs James Mainey Defendant be discharged for irregularity of proceedings. Wednesday October 5, 1836 Present and Presiding: John Hensley, Joseph B. Ray, Malcom McCurry, John Roberts John Hensley made oath in due form of law that at last Superior Court of law & Equity for said county, John Wilson, Who has since deceased made application to him to file an affidavit that he has lost a bond on John G. Blount for fifty acres of land which bond he had sold to Henry Hensley. Ordered that the election precinct on Laurel move back to Isaac Rices. State vs John Street AB Bond 25.00 Thos. Street security State vs Joseph Cooper AB Bond 50.00, Nathan Honeycutt security Present and Presiding: Moses Peterson, Joseph B. Ray, J. W. Wright, Berry Hensley Ordered that J. W. Garland, clerk of court, be allowed the sum of 40.00 for extra services. James Carter, William Edwards, William A. Hensley were sworn as deputy Sheriffs. John Hensley, Entry Taker for said county entered into bond of 4000.00 with William A. Hensley and James Carter security. John W. Garland, clerk of said court, entered into bond of 10000.00 with Moses Peterson, J. W. Wright, William Edwards and William A. Hensley security. Present and Presiding: William Deyton, Malcom McCurry and Joseph L. Ray. Ordered that Joel B. Jervis be allowed the sum of 4.60 for arresting and summonsing witnesses in the suit where the state is plaintiff and William Furgeson defendant. Thursday October 6, 1836 Present and Presiding: J. B. Ray, John Edwards and Joseph L. Ray Samuel H. Stephenson vs Joseph Tucker Ordered that Joseph B. Ray, Turner C. Proffitt and John Edwards be appointed a committee to settle with John P. Young the administrator of the Estate of Strawbridge Young and to report to next court. Ordered that John Radford oversee the road from the Ivy Gap to Daniel Carters and that the hands on the middle fork of Ivy also all living on Medcalf fork below James Medcalf and also the hands of David Carter work under said overseer. Present and Presiding: J. W. Wright, Joseph L. Ray, William D. Arrowood. Ordered that J. W. Peak be allowed 2.12 for arresting and summoning witnesses and guarding C. D. Hagan to jail and also the sum of 1.00 for arresting and Summonsing witnesses in the suit where the state was plaintiff and David ----, defendant.
