Court of Pleas and Quarter Sessions
Fall Session 1837

(note:  Some pages of this microfilm are almost unreadable.  I have
copied all the names and details that I could read.  I have omitted
much of the flowery language.  Some of the handwriting is very hard
to read, especially initials.  I had a very hard time distinguishing
between m/w  t/l, etc.  If you are in doubt about an entry, please

State of North Carolina Yancey County October 9, 1837 At the
Courthouse in Burnsville on the second Monday after the 4th Monday in
September 1837 Present and Presiding:  Zephaniah Horton,  Charles
Byrd and J. W. Write.

Ordered that Rillah Pitman, widow of the late deceased Stephen Pitman
be appointed Administrix of the estate of her interstate.  She
entered into bond in the sum of 200.00 with Rubin Young security.
Ordered that Isaac C. Wilson, William Bailey, sen  and David Baker jr
be appointed a committee to lay off for the said Widow Pitman one
years provisions out of said estate.

Ordered that James Howell be allowed 5.00 for five days service in
taking in and returning a list of Taxable property for the year 1837.

Ordered that David D. Baker, George Buchanan and Reubin McKiney be
allowed 2.00 each for 2 days service in taking in and returning a
list of taxable property for the year 1837.

Ordered that William Collis and Joseph Pitman be allowed 5.00 each
for 5 days service in taking in and returning a list of taxable
property for the year 1837.

Ordered that J. W. Write, Charles Hill and Moses Peterson be allowed
6.00 for 6 days service in taking in and returning a list of taxable
property for the year 1837.

Ordered that Joseph G. Wise, Alexander Wiseman and Lodawick Okes be
allowed 6.00 for 6 days service in taking in and returning a list of
taxable property for the year 1837.

Ordered that Turner C. Proffit be appointed Chairman of Yancey County
Court.

Tuesday October 10, 1837 Present & Presiding:  John Hensley,  John
Roberts,  Lorrance Holcombe,  William Deyton,  Joseph L. Ray and J.
G. Phillips

Ordered that Elias D. Lewis be issued a license to retail Spirituous
Liquors by the small measure for one year at Isaac C. Wilsons.

Court moved to bind William Tipton infant son of Kisiah Tipton to
Jonathan Tipton until he attains the age of 21 years, who is now  3
years old in November last.  Who is to give said apprentice at his
freedom, one horse, bridle and saddle worth 75.00,  three suits of
good clothing and eighteen months schooling.

Ordered that John Hopper Esquire be exempt from the payment of all
land tax for the year 1837 except when he hold lawful deed or entry.

Samuel Fleming vs Meredith Phillips Security, Dobson Deyton

Ordered that Larrance Holcombe, John Ramsey and John Keith be allowed
5.00 each for 5 days services taking in and returning a list of
taxable property for the year 1837.

Ordered that William Dickson, Jesse Wilson and Tilman Blalock be
allowed 3.00 each for 3 days services taking in and returning a list
of taxable property for the year 1837.

Ordered that Joseph L. Ray, Leonard West and William A. Peak be
allowed 6.00 each for 6 days services taking in and returning a list
of taxable property for the year 1837.

Ordered that William Buchanan oversee the road from the foard of Cain
Creek leading across the Cain Creek Mountain to the ford of Toe River
and that James Wilson, Noah Ledford, George Buchanan, Samuel McKiney,
James Harrington, William McKiney and Reubin McKiney work under said
overseer.

Ordered that Joel Gouge oversee the road from the gap of the Cain
Mountain to the mouth of Cain Creek and that all hands included in
the following bounds work on said road, to wit:  running with said
mountain to Toe River and down the river to the mouth of Cain Creek
and then with the Pumpkin Patch so as to include Joel Gouge to the
beginning.

Order that Samuel Austin oversee and cut out a road from William
Wilsons Mill in Pensacola by way of Bolens Creek to Burnsville.

Ordered that Henry Grindstaff oversee the road from the top of the
ridge west of Benjamin Willises to the foard of Toe River and that
John McEntire, Isaac Grindstaff, Thomas Willis and David Willis work
under said overseer.

Order that Josiah Woody oversee the road from the ford of South Toe
River to Burnsville

Order that John Robertson oversee the road from the top of the Brushy
Creek Mountain to the foard of South Toe River.

Ordered that William Buchanan oversee the road from Simion Burlesons
to Harriss Pitmans.

Ordered that Charles Hill oversee the Iron Mountain Road and that the
Rock Creek Company be equally divided between him and Jesse Reed who
oversees the Unacoy Road.

Ordered that David Baker jr. oversee the road from the Mine Creek
Road to Toe River and all hands in the following bounds work said
road.  Commencing at Joseph Bakers running to David Bakers to Aaron
Thomases and to include John Dunkin, William Thomas, Moses Pitman,
Stephen Pitman to Joseph Buchanans on to the beginning.

Ordered that Arther Buchanan oversee the road from the upper end of
old David Bakers Plantation to the Mine creek and that Reubin
Birchfield, Thomas McKineys hands, William Young, John Buchanan, Amos
Ledford, Joseph Buchanan, William Ellis and Tobias Ledford work under
said overseer.

Ordered that Joel B. Jervis oversee and cut out the road from John
Keiths to John Woodards and that all hands in Capt. Woodards company
work on said road.

Ordered that Alfred Hampton oversee the road from the mouth of the
Mine Fork to the gap of the Green Mountain.

Ordered that Thomas Wilson oversee the road from  the ford of Cainy
River at Henry Rolands to where Blake Piercy usually lived.

Ordered that Wright Hutchins oversee the road from near James Howells
to the foard of the Branch at Joseph Thomases and that William
Howell,  Blackstock Stewart, Jacob Hutchins, James Willis and Francis
Tolly work said road.

Samuel Hunter  vs  John Stanton     Levy

Gutradge Garland  vs  S. D. Poor and Moses Peterson    Land Levy

Ordered that a license be issued to William Randolph to retail
Spirituous Liquors by the small measure in the Town of Burnsville for
one year.

Court adjourned Court Met Present and Presiding:  William Dickson,
Spencer Rice and ---- -----.

Ordered that David Shelton and Abner Holcombe be exempt from the
paying of all land tax except where they hold the land by deed or
entry.

Ordered that the sheriff bring into court the minor heirs of Clarissa
Boon and Susannah Boon that the court may proceed to bind or
otherwise provide for them that they may not become chargeable to the
warden of the poor.

Thomas Gouge and others  vs  A Road Petition granted and the Cain
Creek hands be exempt from working the Iron Mountain road.

The Administrix of Joseph Williams deceased moved for a committee to
settle with her as such.  B. J. Smith and John G. Phillips were
appointed.  They find that there was not property enough of said
estate for the years provisions heretofore allowed her.

It appears to the court that Thomas Wilson is duly elected sheriff of
said County.  He appeared in court and entered into bond  in the sum
of ten thousand dollars with William Edwards,  James Greenlee and
Tilmon Blalock securities.
