Hensley --------------¤¤¤¤¤¤-------------- Wilhoit Yancy County N C April 5/1895 Mr McDaniel Hensley & wife Dear Brother & Sister I recd yours of March 19 '95 was glad to hear from you and learn that you was all well I have had serious sickness in my family lately I lost my baby child March 20 She died from Peneumonia fever She was 3 years & 10 months old She was Sick 38 days She has gone to the Care of God We miss her company She was So Sweet & So Smart we are So thankful to God for the tender care he has for little children and they are taken from us they go to God for our benefit directing our minds to things above bless her little soul I have wondered and thought of the blessed little Kindred Ones who may have Escorted her as the angels through the portal gates of heaven up to the throne of God where all is well forever which comforts my Sould God bless the little children. She often talked GrandMa & Grand Pa being angels and gone to See little Brother We miss them too I Saw them both die and I feel like & believe they are at rest life is lonely with me You wrote me concerning fathers estate. I am the administrator on both estates but I fear that the children is not all disposed to do right in the matter I want to say to you that there is $268.00 due by book account to Brother E K Byrd furnished by him to father and mother in money coffee and other goods Since he has been in the Merchantile business and to Supply their needs in them days that father told him that he Should have paid out of what he had but died without settling the debts The law bars a Book account in three years in NC but that does not show justice in this case we Know it is Just and that father recv'd the pay and Zeak has sworn to his Account I want you to say what you are willing to do about the payment of the just debts that was made by our dear old father I say it is right to pay them Miry Some one no doubt has misrepresented things to you concerning fathers business 22 years ago I Bought 65 acres of land from father on his own proposition to Sell to me and paid the price he asked for it the Boys all Bought lands and Litha Bought land on his proposition and paid the prices he asked for the lands and took deed from father & mother But Since father died and not until then the rest of the Children tries to Claim that father gave us land and sold som land which is not true Now they want it all and Says we Boys has had our Share and we answer the alegation and deny any advancements by Gift We have got yours & McDaniels names in the matter Claiming off of us I wish to say to you that I have no desire to take one cent that is due to any of you bit only want what is right in the estate and that I have never received one cents value of land by gift from father or on any proposition to give and if I had ever done so I know that I would say so for what would it proffit me to gain the whole world & lose my own Soul I want you all to have your rights and as far as it is my duty to act in matter I will do all that I can to see that you and all the rest of the heirs gets your just rights, and at the same time I want mine and nothing more God being my helper in the matter though the thing so shaped by the lawyers that they will get it if the thing goes on in law but Col John Bird says that he in the law the last cent away I am not in favor of lawing away what poor old father and mother has left to their children I had much rather give toe advantage to my Brothers & sisters that wants to do wright with me than to see one cent go feed the lawyers I only ask for my Equal Share with the rest of father's Children after father just debts is paid There will be Something due to you out of Mothers estate when it is collected her debts will all be due by Sept & I will collect them and when collected I will see that you get your rightfil and legal share after her little debts are all paid. Now Miry I see no other way to get my rights except to apply to the law for them the lawyers say that there is nothing to hinder to So you see why this thing is in law but it is not my will that it is so but my only chance to get my rights if you all want to hold a contention in this matter agains us it is not known when it will end or what will be left for any one I am a man that is always willing to settle troubles on any terms that is just and right to all parties and not foolishly waste what we ought to take care of So write & let me hear from you There is nothing to keep you out of your fill Share with the 10 heirs and there is no contention against that and that is all that we ask of you Give me your mind on this matter and write me what you want us to do as the Court is right will begin on the 22d day of May Write Soon M. T.
