Banks, 1829 1862 Submitted by Marshall Styles, marshallstyles@yahoo.com Yancey County Original Estate Records, North Carolina State Archives: Yancey County Court, Fall Term 1862: "It appears to the court that David Banks is dead with no will and testament. Court appoints Rachel Banks administrix and orders a committee to lay off her years provisions." [This is his wife Rachel Arrowood Towe, not his mother Rachel Turner Banks.] Spring Term 1866: "The Court appoints a committee to lay off to Rachel Banks one third of land and building, etc, from her deceased husband's estate." November 25 1866: "State of North Carolina. To the Sheriff of Yancey County, Greeting. We command you that of the goods and chattels, lands and tenements of Rachel Banks, Administrator of David Banks, deceased, if to be found in your county, you cause to be made the sum of Six Dollars & Sixty Two cents, which the officers of court for costs and charges in our Court of Pleas and Quarter Sessions held for the County of Yancey at the Court House in Burnsville on the 5th Monday after the 3rd Monday in September 1866, recovered against her for costs and charges in suit expended which the defendant is liable as appears to us of record and have you the said monies besides your fees for the service before our court at Burnsville on the 5th Monday after the 4th Monday in December 1866, then and there to render the costs and charges aforesaid, herein fail not and have you then and there. This witness D. McCanless Clerk of said court at office in Burnsville in the 91st Year of our Independence. Issued 25th November 1866." Another order, identical wording, was issued on December 22 1866, except the amount is for "Seven Dollars and 35 cents." Endorsed, "1867. Not collected my fee of 75 cents {Signed} M. Horton" Additional endorsement, "I the within named Rachel Banks have this day consented to deliver to M. Horton of said county in Burnsville on Monday the 2nd or some man to sell __?__ may to satisfy a fifa issued by this county court of Yancey. Given by me this 18th day of January 1867. {Signed} Rachel (her mark 'x') Banks. Test, Clemuel Arrowood." "Rachel Banks, widow of David Banks, deceased, fifa to Winter Term 1867."
