S. HENSLEY of the State of North Carolina and County of Yancey being of sound and disposing mind and memory but knowing the uncertainty of human life and the certainty of death , and being desirous of disposing of my property while I have mind and memory to do so do make, publish and declare this to be my last will and testament in manner and form following, that Is to say. First I have tried to make advancements to my children in lands and money in as nearly an equal proportion as I could. The deeds for which said lands are deposited with one of my Executors, my son JAMES B. HENSLEY for safe keeping and to be by him delivered at my death if not directed to do beforehand. Second I will and bequeath to my beloved wife, NETTIE, during her widowhood or until our youngest child shall arrive at the age of eighteen years, one half an acre of land in the town of Burnsville to be so laid as to include the dwelling on said land and to be one half an acre exclusive of the yard and the land on which the house stands and to be run by beginning on the South East corner of my residence lot in said town of Burnsville, NC and running with the line of E. ? Watson a northerly course and then an eastwardly course to the ( ) of the public square in said town or the property of J. E. Evans and so as to include one half an acre outside of and in addition to the amount of land covered by the yard and dwelling. I also will and bequeath to my beloved wife NETTIE enough of the rents and profits from my Cane River Farm to make her and her family a reasonable support. I have already advanced to my children, LILLY PHILLIPS and MOLT HENSLEY the sum of twelve hundred dollars and six hundred dollars respectively and it is my will and desire that neither of them shall receive any further sum from my estate or any other property until MILTON HENSLEY, HARRIETT TOMBERLIN, JAMES B. HENSLEY, WILLIE M. ENGLISH, and all my other children shall have been made equal with them. Fourth It is my will and desire that my Executors hereinafter named take charge of all the property, personal and real of all my minor children and to deposit at interest all the money which may come into their hands from all sources, save and except enough to pay for their education, taxes on their property and all other legitimate expenses. Such funds to be kept by my Executors until the said minor children shall reach their majority when the same shall be paid over to them. Fifth It is my will and desire that at my death all the property which I may then possess and which has not been conveyed by me, by deed, be and the same shall be equally divided among WILLIE M. ENGLISH, JAMES B. HENSLEY, HARRIETT TOMBERLIN and all my other children equally to share and share alike or if the same cannot be equally divided or if my Executor shall deem best the same shall be sold and the proceeds divided equally among said children. Sixth It is my will and desire that my Executors hereinafter named shall pay out of the first funds which shall come into their hands all of my just debts. Seventh I hereby constitute and appoint my trusted sons, JAMES B. HENSLEY, MOLT HENSLEY and H. CLAY HENSLEY my lawful Executors of this my last will and testament to all intent and purposes to execute this my last will and testament according to the true intent and meaning of the same and every part and clause thereof hereby revoking and declaring utterly void all other wills and testaments by me made heretofore.
