She was daughter of Nathon Horton and Lizzie Stewart. State of North Carolina Yancey County Prices Creek Township June 22, 1929 I, Trissie Holcombe of the aforesaid county and state being of sound mind but considering the uncertainty of my earthly existence do make and declare this my Last Will and Testament. First: My executor, hereinafter named shall give my body a decent burial suitable to the wishes of my friends and relatives and pay all funeral expenses together with all of my debts, out of the first moneys which shall come into his hands belonging to my estate, also place tombstones at my grave. Second: I give and devise to my beloved sister and her husband; Mr. & Mrs. William N. Horton, to be theirs during their lives, then to go to Mrs. Essie Maney’s children equally, the tract of land on which I now reside, containing about thirty Seven and one half acres. I also give to the said Mr. & Mrs. William N. Horton, during their natural lives all of my household goods, after their death it goes to Mrs. Essie Maney’s children. Third: I give and bequeath to my beloved relatives the following sums of money, should I have it at the time of my death after all other of the aforesaid indebtedness shall have been paid. To Mrs. Lillie Holcombe $50.00 To Miss Mollie Penland $50.00 To Mrs. Rebecca Jones $50.00 To Mr. James Holcombe $50.00 To Mr. Walton Penland $10.00 To Mr. Willard Penland $10.00 To Mr. John M____ Jones $10.00 To Miss Nina Penland $10.00 To Johnie Penland $25.00 To Lewis Penland $25.00 Fourth: I will and desire that all other property that I might have, such as life stock and money after taking out the devices and legacies above mentioned, shall go to William N. Horton and his wife their lifetime and then go to Essie Maney’s children, equally divided. Fifth: I hereby constitute and appoint my friend, W. C. Edwards my lawful executor to all intents and purposes to execute this my last will and testament according to the true intent of the same and every part and clause thereof. I hereby revoke and declare utterly void all other wills and testaments by me heretofore made. Elliott, who after being duly sworn, each for himself says, that he is a subscribing witness to the paper writing now shown here purporting to be the last will and testament of Trissie E. Holcombe, Deceased; that he saw the said testator execute the same as his last will and testament; that he attested the same at the request of and in the presence of said testator; and at the time of the execution the said testator was in his opinion of sound mind and disposing memory and that she was not, to his knowledge under any restraint. Holcombe, Deceased Order for Probate of Will A paper writing purporting to be the Last Will and Testament of Trissie E. Holcombe, deceased is exhibited in open court for probate by W. C. Edwards the executor therein named; and the said execution thereof by the said Trissie E. Holcombe, deceased was duly proven by the oath and examination of J. W. Maney and L. C. Elliott, subscribing witnesses thereto, and it is further shown to the satisfaction of the court of said witnesses that the said Trissie E. Holcombe was, at the time of making said will of sound mind and memory, of full age to execute a will and under no restraint, to their knowledge, information and belief. It is thereupon considered, adjudged and decreed that the said proof is sufficient and _____ ____, and that the said paper writing is and contains the last will and testament of Trissie E. Holcombe, deceased. And upon motion it is ordered that the said will be admitted to probate and recorded in the Book of Wills of Yancey county in the office of the Clerk of the Superior Court of said County. It is further ordered that said W. C. Edwards be allowed to qualify as executor as provided by law and enter up the discharge of the duties required by the trust.
