February Term 1840 An instrument of writing purporting to be the last Will and testament of Jabez Jervis Deceased was produced in open court and admitted to probate upon the Testimony of John Holcombe and Robert Ponder two of the Subscribing Witnesses Thereto. The will is in the words and figures following To Wit: In The name of God Amen- I Jabez Jervis of the County in the State of North Carolina, being of sound and perfect mind and memory. but, in feeble health. have this day constituted and appointed and by these presents do ordain constitute and appoint This my last Will and Testament in manner and form as follows. I first give or resign my body to the dust from whence it came and recommend my soul to almighty God, who gave it to me hoping it will be received by the same almighty power. first. I give and bequeath to my beloved wife Peggy Jervis at my death all and Singular, the goods and chattels that I possess during her natural live to have and to enjoy as her own after all my Just debts are paid. I also give unto my said wife all enjoyments of any of the notes or accounts which is due or owing to me, for her support during her natural life & I also give unto my said wife Peggy, my tract of Land which I now live on lying on Laurel, and the tract adjoining the same, which I bought from Jesse Rice. I also give and bequeath unto my said wife all three pieces or parcels of Land, lying on west fork of Little Ivy, the place on which Wm. Smith now lives and a twenty five Acre tract adjoining thereto. I give and bequeath unto my said wife all of my personal Estate, as well as my real Estate for her use and Enjoyment during her natural life, then after her death my will and desire is, that There be an equal division of all the property then left, both real and personal among all my children or their legal representatives. Except my land on Laurel as above mentioned, and after the death of my said wife, my will and desire is that my son Levi Jervis Should have said Lands on Laurel as before mentioned and my will and desire further is, that all The before mentioned Lands is to be under the Entire control of my said wife Peggy, during her life as aforesaid and after her death my will is for Mary Hooker to have one Bed and furniture, then to be disposed of as before mentioned. I do also by these presents Constitute and appoint. my wife Peggy Jervis as executrix of this my last will and Testament, revoking and disannuling all former wills heretofore made.
