Being in feeble health and of Sound and disposing mind calling to mind the frailty and uncertainty of human life and being in my 70th year of age and being desirous of settling my worldly affairs and directing how the Estate with which it has pleased God to bless me with Shall be disposed of after my decease, while I have strength and capacity to do so. I do make and publish this my last will and testament hereby revoking and making null and void all other last wills and testaments by me heretofore made. Item 1... I commend my mortal being to him who gave it me and my body to the earth to be buried with such expenses or orientations as my children and friends may see fit and to my worldly estate and all the property real and personal or ----- of which I shall die seized and possessed or to which I shall be entitled at the time of my decease I desire bequeath and dispose in the following manner to wit. Item 2.... My will is that all my just debts and funeral charges shall by my Executor hereinafter named be paid out of my estate as soon after my decease as shall be by her convenient. Item 3.... I give desire and bequeath to my beloved son MOSES PETERSON Sixty dollars to be paid to him by my Executor hereinafter named within twelve months after my decease. Item 4.... I give devise and bequeath to ELVIRA PETERSON my nurse who is my niece in consideration of her services to me for many years a tract of land situated in said county on Jacks Creek adjoining the lands of Uriah Bennett & others. Bounded as follows. Beginning on a stake and black walnut and runs west 58 poles to a black oak ----- in a fence corner at a rock then a south ---- direction to a black oak ---- distance 32 poles South 40 West 17 poles to a white oak in a hollow then south to the head of Mill Race on Jacks Creek thence down said creek to the beginning containing thirty eight acres more or less to have and to hold the said to her and her heirs and assigns forever Save and except the Mill and the race with full rightaway to the water and the mill yard south of the race. Item 5.... I give and devise and bequeath to my beloved niece ELVIRA PETERSON as above named in Item 4 all and every of my household & kitchen furniture without itemizing the same consisting of all such property belonging to the household and kitchen furniture on hand and belonging to me at my decease. Item 6.... I give and bequeath to my beloved niece ELVIRA PETERSON as above named in Item 4 & 5 all and every of my horses, mules, cattle that I may have or posses or own at my decease. Item 7..... The last three devises are made to the said ELVIRA PETERSON for love and affection and for the valuable services heretofore rendered and for such as she may render in the future. Item 8.... I hereby nominate and appoint my beloved niece ELVIRA PETERSON to be the Executrix to this my last will and testament and it is my request that the said ELVIRA PETERSON Executrix be allowed to qualify and discharge the duties as such, executing without filing a bond.
