Ray State of North Carolina, Yancey County In the Name of God Amen I Joseph B. Ray of Yancey County and state aforesaid being sick & weak of Body but of Sound & disposing Mind Memory & understanding considering the certainty of Death and the uncertainty of the time thereof to the end that I may be the better prepared to leave this world when it shall please my God to call me hence have now determined to direct what disposition shall be made of my property both Real & Personal after my decease & after naturally considering the circumstances & conditions of all these among whom as my heirs at law and the objects of my gratitude or affection in my Judgment my Estate should --------. I do make publish & declare this to be my last will & Testament hereby Revoking & making null and void all former last will & testaments & writings in the Nature of Last Will & Testaments by me heretofore made. And my will is first after my decease my body shall be decently buried without ostentation or unnecessary expense & that my funeral charges and Just debts shall be paid by my executor hereinafter named and as to the residue of my Estate & Property with which God has blessed me and shall not be required for the payment of my debts funeral charges in and about the Execution of this my will & the Administration of my Estate I give devise and dispose thereof as follows, Towit, I give & devise to my beloved wife SARAH RAY all my -------- my household furniture and all my stock to hold the same to her & her heirs Executors & Administrators to her & their use and behalf forever. Item 2 I give and bequeath to my son LEROY RAY all the tract of land where I now live including all the land below the crop fence which crop fence runs pretty much East & West through the old field between here where I now live and where B. J. MOSS now lives ------- directly from the East end of said fence to the branch and East down to DAVID MCCANLES live on the old GEORGE WILSON line and from the West end of the afore said crop fence a west corse to YOUNG ALLEN'S line so to run on the North side of the Improved & ----- ground where AMOS BOON & MEXICO BOON his the said Boons wife now lives all the land below the above mentioned ------ and crop fence of mine I will to said LEROY RAY as his own ------- property to have and to hold to his own proper use and behalf to his heirs Executors & Administrators forever. Item I give and bequeath to my son AMOS L. RAY all the ballance of my land lying on said branch above the aforesaid crop fence heretofore described running an East and West cource which line I will to be a conditional line from D. MCCANLES line to YOUNG ALLEN'S line between LEROY RAY and AMOS L. RAY all of my land above per aforesaid line Including the place where B. J. MOSS now lives and where LOCKEY RAY now lives, where ELIZABETH RAY now lives, where AMOS BOON now lives and where WILLIAM FRANKLIN now lives, I give and bequeath to the above said A. L. RAY. Also another tract on Crabtree joining lands of JOHN GRIFFITH to have & to hold as his own Right and Property forever to the only proper use & behalf of him and his heirs forever all Except a part of the place LOCKEY RAY now lives, Including the field & cleared ground and any ground East of the said field. ELIZABETH RAY & her heirs to live on & enjoy free from paying any rent their lifetime if they choose to live on the same, also JANE FRANKLIN is to Live if she chooses on the land where she now lives during her life free of paying rent and also MEXICO BOON is to live where she now lives if she chooses so to do and pay no rent her lifetime and Lockey is to live as long as she may choose to live where ELIZABETH RAY now lives & the aforesaid A. L. RAY is not to require them or any of them to pay any rent. Item 4 I give and bequeath to A. L. RAY & LEROY RAY a tract of land where ENOS BOON now lives & my Town Lot in the Town of Burnsville to have and to hold as their own property Right & Property to them to their own proper use & behalf of them the aforesaid A. L. RAY & LEROY RAY to the only proper use & benefit of them & their heirs forever. And I do nominate & appoint my son AMOS L. RAY to be the sole Executor of this my last will and testament and I will that A. L. RAY & LEROY RAY take care of and provide for their mother during her life & I also will that A. L. RAY & LEROY RAY pay my Son WILLIAM RAY Seventy Five dollars Each and that they pay within Two years after my decease and I also will that they pay THOMAS HOLLOWAY son of ------ Holloway Fifty dollars to be paid in two years after my decease which Said THOMAS HOLLOWAY is Equally to divide among his Brothers & Sisters and also that they pay in like manner LEANDER THOMAS five dollars when called for by them in Yancey County after two years after my decease.
