YANCEY COUNTY, NC - WILLS - John Gilbert Wilson, 16 Aug 1929 --------------¤¤¤¤¤¤-------------- Last Will and Testament of John Gilbert Wilson Yancey County, North Carolina Book of Wills Page 508-511 Transcribed by Sandra Allen Fender North Carolina Yancey County I John Gilbert Wilson of Yancey County, State of North Carolina, being of sound mind and disposing memory but considering the uncertainty of my earthly existence, do make and declare this my last will and Testament, hereby revoking and declaring void all other wills heretofore made. I. My executor, hereinafter named, shall give to my body a decent burial suitable to the wishes of my family and pay all funeral expenses together with all my just debts, out of the first money that may come into his hands belonging to my estate. II. I hereby desire my executor to collect all debts due and owing to me and after paying all of my just debts, I direct him to pay the residue of all money remaining to my children giving to each one an Equal share and my personal property of every nature is to be distributed among my children in equal parts and if any child is indebted to my estate, such amount is to be deducted from the share of such child so indebted. I have made a proper division of all my lands among my children heretofore by deeds to them. If any of my children do not survive me and leave descendants, then such descendants are to take the share the parent would have taken. I hereby constitute and appoint my trusted friend, Joshua Gibbs my lawful executor to all intents and purposes to execute this my last will and Testament according to the true intent and meaning of the same and every part and clause thereof. In witness whereof I the said John Gilbert Wilson do hereby set my hand and seal this the 16th day of August 1929. Love, Asheville, NC State of North Carolina County of Yancey A paper writing purporting to be the last will and Testament of John Gilbert Wilson is exhibited before me the undersigned Clerk of the Superior Court of Yancey County, by J. P. Gibbs, the executor therein named, and the said execution thereof by the said John Gilbert Wilson is proved by the oath and examination of S. R. Hensley and T. R. Robinson the subscribing witnesses thereto: who being duly sworn says and each for himself says that he is a subscribing witness to the paper writing now shown here propourting to be the Last Will and Testament of John Gilbert Wilson, Deceased. That the said John Gilbert Wilson, in the presence of these deponents, subscribed his name at the end of said paper writing now shown as aforesaid and which bears date August 16, 1929. And the deponents further say that the said John Gilbert Wilson, the testator forenamed did at the time of subscribing his name as aforesaid, declared the said paper writing to be his last will and testament and these deponents did thereupon subscribe their names at the end of the paper writing as attesting witnesses thereto and at the request of and in the presence of each other. And the deponents further say that at the time when the said testator signed his name on the foresaid the said John Gilbert Wilson was of sound mind and disposing memory, of full age to execute a will and was not under any restraint to the knowledge, information or belief of the deponents and further the deponents say not. P. Gibbs executor therein named and the due execution thereof by the said John Gilbert Wilson proven by oath and examination of S. A Hensley and T. R. Robertson, subscribing witnesses thereto and it is further shown to the satisfaction of the court by said witnesses that the said John Gilbert Wilson was at the time of making said will, of sound mind and memory, of full age to execute a will and under no restraint to their knowledge, information and belief. It is therefore considered, Adjudged and decreed that the said proof is sufficient and according to law, and that said paper writing is and contains the Last Will and Testament of John Gilbert Wilson, Deceased. And on motion it is ordered that said will be admitted to probate and recorded in the Book of Wills of Yancey County and as such filed as provided by law in the office of the Clerk of the Superior Court of said County. It is further ordered that the said Joshua P. Gibbs be allowed to qualify as provided by law and enter into the discharge of the duties empowered by said trust. Dated the 2 day of October 1933.
