Heirs of Edward Essam N. H. Van Doran, Register of Deeds WILLS KNOW ALL MEN BY THESE PRESENTS: That I, Edward Essam, a widower, resident of Gage County, Nebraska, being of sound mind and disposing memory, do hereby make, publish and declare this my last will Will and Testament in manner and form as follows to-wit: 1. I direct that all of my just debts, expenses of last sickness, funeral expenses and cost of administering my estate be first paid. 2. Subject to paragraph 1 hereof, I give and bequeath the residue, if any, of my personal property, in equal proportion, share and share alike to my two children, Bernice Essam and Gladys Bledsaw. 3. I give, devise and bequeath in equal proportion, share and share alike to my daughters, Bernice Essam and Gladys Bledsaw, the possession, use, rents and income from all of my real estate, for and during the term of their natural life, and on the death of one of my said daughters, the survivor thereof shall thereafter, for the remainder of her life, have the p;ossession, use, income and rents therefrom. Provided, however, before any rents or income shall be paid to my said daughters, or either of them under this provision of my will, the taxes, interest on incumbrance on said real estate and the upkeep thereof shall first be paid out of said income, and in case the mortgage incumbrance in the principal sum of $2000.00 now on my home place described as the West Half of the Southwest quarter of Section 29, Township 4 North, Range 7 East of the 6th P.M, Gage County, Nebraska, is unpaid at my death, the interest accruing thereon and the principal thereof, shall like be paid out of said rents and income from said real estate before any rents and income is paid to my said daughters, or either of them. The life estate to my said daughters and to the survivor of them in said real estate, as herein provided, is given and devised upon the express condition however, that my said daughter and each of them shall not have the right to sell or incomber their life estate in said real estate or any part thereof, and the same shall not be liable for the payment of their debts, or the debts of either of them now owing or at any time in the future incurred by them, or either of them. 4. Subject to the life estate in my real estate, as herein given and devised to my daughters, Bernice Essam and Gladys Bledsaw, and the survivor of them, as herinabove provided, I give, devise and bequeath all of my real estate to my grandchildren in equal proportions, share and share alike, and if any of my grandchildren should die leaving child or children them/then? surviving, prior to the death of the survivor of my daughters, Bernice Essam and Gladys Bledsaw, the child or children of such deceased grandchildren shall take the share in my estate of such deceased grandchild by right of representation. 5. Lastly, I nominate and appoint my said two daughters, Bernice Essam and Gladys Bledsaw as executrices of this my last will and testament, hereby revoking all former wills by me made. IN THE COUNTY COURT, GAGE COUNTY, NEBRASKA IN THE MATTER OF THE ESTATE OF EDWARD ESSAM, DECEASED This 12th day of November, 1943, at 9 o'clock A.M., the petition of Bernice Essam and Gladys Bledsaw praying, amongs other things, for the Probate of the instrument heretofore filed in this court, purporting to be the last Will and Testament of said deceased, and that administration of the estate of said Edward Essam, deceased, be granted to petitioners of Betrice, Gage County, Nebraska, coming on to be heard, and it appearing to the Court by the proof on file, that notice of the time and place of such hearing has been duly given as required by law, and the order of this court, and the said petitioner having appeared, and no person appearing to object, and after waiting one hour thereafter, still no person appearing to object, hearing proceeds: Bernice Essam, Gladys Bledsaw and Charles L. Brewster, one of the subscribing witnesses to said instrument, are duly sworn and testifyon behalf of proponent. Said instrument, purporting to be the last Will and Testament of Edward Essam, deceased, is offered in evidence and for probate and cause is submitted to the Court. Upon consideration thereof the Court finds: That said Edward Essam died at Beatrice, Nebraska, on the 13th day of October, 1943, and at the time of his death he was a resident of the said Gage County, Nebraska. That he left personal property to be administered in said County and State no exceeding in value $5500.00, and real estate in said County and State of about the value of $6800.00, the annual rents and profits of which do not exceed in value of $500.00; That said applicants for letters are the daughters of the deceased; That said Edward Essam, deceased, signed the instrument aforesaid, and published and declared said instrument to be his last Will and Testament, in the presence of Chas. L. Brewster and Katherine Weidenhammer, who, at the time, attested the same and subscribed their names as witnesses thereto in the presence of each other and of said testator, and at his request; that said witnesses were competent, and that said Edward Essam, deceased, was then of full age and sound mind. The Court further finds that said instrument is the last Will and Testament of said Edward Essam, deceased. IT IS THEREFORE ORDERED, ADJUDGED AND DECREED, that said instrument be allowed and aditted to probate as the last Will and Testament of said deceased, that certificate of probate be attached thereto and that the same be then recorded. That the excecution of said last Will and Testament be committed, and the administration of said estate be granted to Bernice Essam and Gladys Bledsaw as executrices and that Letters Testamentary issue in the premises upon their executing and filing with the Court a bond in the penal sum of $2,000.00 with approved securities. IN THE COUNTY COURT OF GAGE COUNTY, NEBRASKA IN RE: ESTATE OF } DECREE ON FINAL SETTLEMENT OF ACCOUNTS EDWARD ESSAN, DECEASED} AND ASSIGNMENT OF ESTATE Now on this 3rd day of April 1944, at nine o'clock A.M., the petition of Bernice Essam and Gladys Bledsaw, executrices of said estate, praying a final settlement and allowance of their accounts, a decree of heirship and a decree distributing and assigning the residue of the estate of said deceased and a discharge from their trust as such executrices, coming on to be heard: and it appearing to the Court from the proof on file that due and legal notice of the time and place of such hearing has been duly given by publication for three consecutive weeks in the Beatrice Times, a legal newspaper, printed and published in said County as required by law and as provided by the order of the Court made herein; and the said petitioners having appeared and no person appearing to object and after waiting one hour thereafter and still no person appearing to object hearing is had and the cause is submitted to the Court and the Court having considered the evidence, the same together with all the files and proceedings in said matter having been submitted and being duly advised in the premises finds: 1. The accounts of the executrices are correct in all respects and should be approved and allowed. 2. On completion of the record of this cause there will be due the following costs adn allowances to-wit: County Judge's fees $20.25 Beatrice Times for legal notices 14.97 Register of Deeds of Gage County, Nebraska for recording fees 3.50 Sackett, Brewster & Sackett for attorney's fees 150.00 which are hereby allowed. and that all of said items should be paid by the executrices and the executrices waive fees and allowances to them. 3. Notice to creditors was duly given as required by law and the order of the Court; the time for filing claims against said estate expired March 8, 1944 and an order was duly entered by the Court herein on the 9th day of March 1944, barring the filing and presentation of claims against said estate and all claims filed or allowed against said estate have been fully paid, satisfied and discharged. 4. The residue of personal property belonging to said estate in the hands of the executrices, after the payment of the sum herinabove set forth in paragrah 2, consists of Five Hundred Ninety five dollars and Ninety three cents ($594.93) cash, the 1943 rent corn on the real estate of the decedent in Lincoln county, Nebraska, Certificate No. 92 for forty (40) shares of the capital stock of the Farmers Co-operative Elevator Company of Beatrice, Nebraska; the farm lease for the year 1944 on the decedent's real estate in Lincoln County, Nebraska, and the Five Thousand Dollars ($5000.00) note and mortgage made by Herbert R. Ruyle and Ina A. Ruyle July 15, 1943 to the deceased on the: West Half (W1/2) of the Southwest Quarter (SW1/4) of Section Twenty-nine (29), in township Four (4) North, Range seven (7) East of the Sixth Principal Meridian in Gage County, Nebraska, recorded in Book 96 of Mortgages at page 381. 5. The real estate of which the deceased died siezed is described as follows: Lot Seven (7) in Block Five (5) in the Original Town, now City of Beatrice, Gage County, Nebraska and An undivided two-thirds (2/3) interest in the East Half (E1/2) of Section Fifteen (15) in Township Thirteen (13) North, Range thirty-four (34) West of the Sixth Principal Meridian in Lincoln County, Nebraska. 6. The deceased left surviving him as his sole and only heirs at law and his sole and only devisees, and legatees under the terms and provisions of his last Will and Testament his two daughters, Bernice Essam and Gladys Bledsaw, of Beatrice, Nebraska, both of full age and his three grandchildren who are the children of the said Gladys Bledsaw, to-wit: Harold Lloyd Bledsaw, 16 years of age; Lenora M. Bledsaw, 15 years of age; and Ralph E. Bledsaw, 8 years of age. 7. That in and by the terms of the last Will and Testament of the said Edward Essam, deceased, and which will has been duly probated and allowed herein and is now in full force and effect, all of the personal property remaining in the hands of the executrices and all and any other personal property of the testator, after the payment of the Court costs and allowances as herein set forth, is given and bequeathed in equal proportion, share and share alike to the said Bernice Essam and Gladys Bledsaw, daughters of the testator. 8. That in and by the terms of the said last Will and Testament of the said Edward Essam, deceased, the possession, use, rents and income from all of said real estate of which the testator died seized is given, devised and bequeathed in equal proportion share and share alike to his said daughters Bernice Essam and Gladys Bledsaw, for and during the term of their natural life and on the death of one of said daughters the survivor thereof is given for the remainder of her life, the possession, use, income and rents therefrom with the provision however that the said daughters shall first pay taxes on said real estate and the expense of the upkeep thereof and provided further that the life estate in said real estate is given, devised and bequeathed to said daughters shall not be subject to alienation by them nor liable for the payment of any of their debts. 9. The Court further finds that subject to said lie estate in said real estate of the decedent as hereinabove set forth and as provided in the will of the testator the said real estate of the testator is given, devised and bequeathed to the grandchildren of the testator in equal proportions, share and share alike and in case any of the testator's grandchildren should die leaving child or children them surviving, prior to the death of the survivor of the testator's two daughters the child or children of such deceased grandchild shall take the share of the deceased grandchild in said real estate by right of representation, and the Court finds that at the death of the testator the sole and only grandchildren were and are the said Harold Lloyd Bledsaw, Lenora M. Bledsaw and Ralph E. Bledsaw and that no grandchild or grandchildren of the testator has died leaving child or children him or her surviving, and the Court finds that said real estate should be assigned, subject to the said life estate therein in favor of Bernice Essam and Gladys Bledsaw, to the grandchildren of the testator in fee simple, as tenants in common, in equal proportion, pursuant to the will of the testator. 10. The Court further finds that no part of the estate of the testator was or is subject to inheritance tax under the laws of the State of Nebraska. IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court: First: That the accounts of the executrices pay the follolwing costs and allowances to-wit: County Judge's Fees $20.00 Beatrice Times for legal notices 14.97 Register of Deeds of Gage County, Nebraska for recording fees 3.50 Sackett, Brewster & Sackett for attorney's fees 150.00 and that the remaining cash on hand be and the same hereby is ordered paid as follows: To Bernice Essam the sum of 297.46 To Gladys Bledsaw the sum of 297.47 Third: The court further orders that the remaining personal property of said estate, as in the findings hereof described, should be by the executrices assigned in equal proportions, share and share alike to Bernice Essam and Gladys Bledsaw. Fourth: That the real estate hereinbefore described be and the sums hereby is assigned in fee simple in equal proportion, share and share alike to the grandchildren of the testator as in the will provided, subject however to a life estate therein in favor ofthe said Bernice Essam and Gladys Bledsaw during the term of the natural life of them and the survivor of them as set forth in the findings hereof. Fifth: Fifth: It is further adjudged and decreed by the Court that the said Edward Essam died testate, a resident of Gage County, Nebraska, on the 13th day of October 1943 and that his last Will and Testament was duly admitted to probate, probated and allowed herein on November 12, 1943 and that the testator was a widower at the time of his death and that his sole and only children, heirs at law, legatees and devisees, under his last Will and Testament, were and are his said daughters, Bernice Essam and Gladys Bledsaw, and his said grandchildren Harold Lloyd Bledsaw, Lenora M. Bledsaw and Ralph E. Bledsaw. It is further ordered that upon the payment of the costs of administration, as herein provided, and upon payment of the remaining cash on hand to the said two daughters and upon delivery of an assignment to them of their share and interest in the remaining personal estate of said, as herein found and directed, and upon return of proper vouchers therefore to be approved by the Court the said executrices shall be discharged.
