He immigrated to America in 1861, and about 3 years later enlisted in Co. L, 2nd Illinois Artillery. By at least 1873, Nicholas was living in Otoe county, Nebraska. He died 31 May, 1901, in Burr, South Branch Precinct, Otoe county. Nicholas RUSH's Civil War Pension record was obtained from the National Archives: #520317. DECLARATION FOR ORIGINAL PENSION OF AN INVALID. State of Nebraska, County of Johnson, ss: On this 18th day of March, A. D. one thousand eight hundred and seventy 4 personally appeared before me J. S. Dew Clerk of the Disct Court the same being a court of record within and for the county and state aforesaid, Nicholas Rush aged 34 years, a resident of Hendricks P.C., county of Otoe, State of Nebraska, who, being duly sworn according to law, declares that he is married; that his wife's name was Miss Annie Wood, to whom he was married in Hendrick Precinct on the seventh day of Sept, 1873; that he is the identical Nicholas Rush who enlisted in Captain Thadeus (can't make out surname) company L, 2nd regiment, Ill Light Artillery, at Springfield, on the Tenth day of March, 1864, and was honorably discharged at Chicago, Ill, on the ninth day of Aug, 1865; that his personal description is as follows: Age 34 years; height, five feet six inches; complexion, dark; hair, dark; eyes, hazel; that while in the service aforesaid, and in the line of his duty, he received the following disability, to wit: Deafness from exposure at various times and places, from which he has never recovered. That he never received any treatment in hospital or elsewere while in the service, but was left (can't make out word) on duty. that since leaving the said service, this applicant has resided in the County of Otoe, in the State of Nebraska, and his occupation has been farming, that prior to his entry into the above-named, he was a man of good, sound physical health, being when enrolled, a farmer. that now he is partially disabled from obtaining hisd subsistence from manual labor in consequence of his above-named injuries received in the service of the United States; that he makes this declaration for the purpose of being placed on the invalid pension roll of the United States by reason of the disabilities above stated; that he hereby appoints [blank] his attorney to prosecute his claim; that he has never received or applied for a pension; that his post office is at Sterling, county of Johnson, State of Nebraska; that his domicile or place of abode is Hendricks Precinct, County of Otoe, State of Nebraska. Pindar, residing in Hendricks Pct. persons whom I certify to be respectable and entitled to credit, and who, being by me duly sworn, say they were present and saw Nicholas Rush, the claimant, sign his name (or make his mark) to the foregoing declaration; that they have every reason to believe, from the appearance of said claimant and their acquaintance with him, that he is the identical person he represents himself to be; and that they have no interest in the prosecution of this claim. D. 1874, and I hereby certify that the contents of the above declaration &c., were fully made known to the applicant and witnesses before swearing, including the words [blank], erased, and the words [blank], added; and that I have no interest, direct or indirect, in the prosecution of this claim. NOTE - This affidavit must be executed by a COMMISSIONED OFFICER, if possible, but if not possible to secure such evidence, then two of the soldier's COMRADES should testify. State of Michigan, County of Hills dale, ss. ON THIS 29 day of March, A. D. 1890, personally appeared before me, a Notary Public in and for the aforesaid County, duly authorized to administer oaths Luther Lane, aged 43 years, a resident of Hills dale in the County of Hills dale, and State of Michigan, who, being duly sworn according to law, states that he is acquainted with Nicholas Rush applicant for pension; and knows the said Nicholas Rush to be the identical person of that name who enlisted or volunteered as a private in Company L, 2nd Regiment of Ill. Light Art. Vols., and who was discharged at Chicago, Ill. on or about the 9 day of August, 1865 by reason of expiration of service or close of war. That the said Nicholas Rush while in the line of duty, at or near Vicksburg in the State of Miss. did on or about the [blank] day of Feb., 1865, become disabled in the following manner, viz: By being thrown from a horse while [can't make out word], striking his head apon the ground which resulted in the loss of his hearing and from which he was suffering at the time of his discharge. That the facts stated are personally known to the affiant by reason of being a member of the Company and on duty with the Company at the time. ************************************************************ DECLARATION FOR CHILDREN UNDER SIXTEEN YEARS OF AGE. State of Nebraska County of Johnson, ss: On this 24 day of June, A. D. one thousand nine hundred and one personally appeared before me, a notary public within and for the county and State aforesaid, John Powell aged 44 years, a resident of [blank], County of Johnson, State of Nebraska, who, being duly sworn according to law, makes the following declaration in order to obtain pension under the provisions of the act of Congress approved June 27, 1890: That he is the guardian of Willie Rush legitimate child of Nicholas Rush, who was enrolled under the name of Nicholas Rush at Springfield, Illinois, on the Nineth day of March, 1864, as a private in Company L, 2nd Regiment of Light Artillery Illinois and honorably discharged August 9th, 1865, having served ninety days or more during the late war of the rebellion. That the soldier was not in the military or naval service of the United States except as stated above. That the mother of said child was married under the name of Jane Powell to the soldier in Johnson County, Nebraska, on the 17th day of March, 1878, by [blank]; that there was no legal barrier to the marriage; that she had not been previously married; that he had been previously married to Anna Wood on September 7th, 1873 who died on April 9th, 1875. That the said soldier died May 31st, 1901, at Burr, Otoe County, Nebraska, that he left no widow surviving. That the following named are the only children of the soldier who are now living and under sixteen years of age, to wit: Willie Rush, born October 8th, 1886, in Otoe county, Nebraska.
