     THURSTON COUNTY

It Will Remain On the Map of Nebraska

   An interesting opinion was handed down by the
supreme court in the case of Wayne county against
the commissioners of Thurston county. The action
grew out of a dispute between the two counties as
to the right to certain territory, consisting of
about two townships, formerly a part of the Omaha
and Winnebago Indian reservation, but not allotted
to the Indians in severalty until 1887. This tract
was claimed to be a part of Wayne county by reason
of an act of the legislature passed in 1881, the
act including the territory within the boundaries 
of that county. In 1889 the county of Thurston was
created by the legislature and the same territory
was included in Thurston county. The contention of
Messrs. Lese and Stewart of this city, the attorneys
for Thurston county, was that the question of adding
such territory to Wayne county having never been
submitted to the voters of that county, the act of
1881 was unconstitutional and void. This position 
was sustained by the supreme court in a carefully
prepared opinion by Judge Norval. The disputed 
territory is declared to be a part of Thurston 
county and it's county officers are authorized to
levy and collect taxes upon the real and personal
property therein. Thurston is a small county. Had
it lost the territory in question, it would have
been reduced to less than four hundred square miles,
the minimum size fixed by the constitution. Had
the decision been against Thurston county the
interesting question would have arisen as to whether
it was a county and had any existence as such.
