Submitted by: Rick Giirtman rickman@worldpath.net Date: September 20, 2000 **************************************************************************** In the name of God Amen, I Simeon Avery of Orford, in the county of Grafton & State of New Hampshire, acknowledging the divine mercy in protracting my life hitherto, but considering that death is the lot of humanity, and being in a weak and infirm State of bodily health, but of sound and disposing mind and memory, do make this my last will & testament in manner and form following, vis: Imprimus- I give and bequeath to my beloved wife Hannah, two good milch cows to be taken by her at her own choice and election out of the cows I am now possessed of-seven store sheep, five pairs of geese, two swine, six hens, two good feather beds & such as she shall choose out of what I own with furniture complete (including only one set of curtains, two coverlids, one bed quilt, two blankets, five pair linnen sheets, four pair pillow cases, pillows & bolster(?), two bed steads, two bed cords & two under beds) the whole of her wearing apparel, side saddle, one bridle, six pewter plates, two pewter platters, such as she shall choose as aforesaid,- one fire shovel, one pair tongs, one trammel-one tea kettle, a small dish kettle, a large skillet, one large hard ware pot-two quart basons, two pint basons, one pint pewter cup-one case of knives & forks-six spoons, one earthen tea pot, six cups & saucers & other tea table furniture in proportion -one & an half dozen earthen plates-half dozen chairs-a chest with two draws to be made by Nathaniel Marsh, who has been spoken to therefor, one large & one small punch bowl-one large & one small baker & one wine glass also the looking glass which she owned before our marriage-my large Bible during her continuance in my family-my green baise(?) gown-one pair sad irons-one small round table-two small table cloths-six towels-one pair candle sticks-one pair of snuffers, also the use and improvement of my horse, known by the name of Cotton, when so often as she shall have occasion therefor, for & during the term of three years- Item I give and bequeath to my son Nathan Avery a new full suit of light colored plain cloth clothes, my beaver hat & Silver headed cane-also a milch cow, feather bed & bedding to be delivered to him at the expiration of three years from this date. Item To my daughter Lucy, who has heretofore received, what I suppose to be about her proportion of my estate, I give and bequeath one silver table spoon. Item- To my daughter Katharine, who in her youth resided with an aunt of hers, and by her liberality received what I apprehend was equal to the items I have been able to give to her sisters, I give and bequeath my large looking glass.-- Item- To my daughter Mary, who has heretofore received what I suppose to be her equitable proportion of my estate, I give and bequeath one warming pan.- Item- To my daughter Hannah who has also received her proportion as aforesaid, I give and bequeath one silver table spoon. Item- To my sons Jesse, Silas and Joshua, I give and bequeath all the remainder of my estate, both real & personal, to be equally divided among them. And lastly, I do hereby ordain constitute & appoint my said beloved wife Hannah & said son Nathan to be joint Executors of this my last will and Testament hereby revoking & nullifying all former wills & Testaments whatsoever by me heretofore made-- I testimony whereof I have hereunto set my hand & seal this eighth day of June in the year of Our LORD one thousand seven hundred & ninety-- Simeon Avery Signed, Sealed, Published and declared by the above Testator to be his last will & Testament in presence of us who have hereunto subscribed our names as witnesses in his presence & in the presence of each other. Susanna Fisk Jonathan Sawyer Davenport Phelps --------------------------------------------------------- Grafton--Haverhill November 3d, 1790 This instrument purporting the last will & testament of the said Simeon Avery was presented by Nathan Avery one of the executors herein named, the said Hannah Avery declining to accept said trust-- for probate and Jonathan Sawyer, Esq'r & Susanna Fisk two of the witnesses whose names are thereto subscribed being present made solemn oath that they saw the said Simeon Avery sign seal & heard him declare this instrument to be his last will & testament. that he was then & to the best of their judgement of sound & disposing mind & memory & that they with Davenport Phelps subscribed their names together as witnesses to the execution thereof in the presence of the said Simeon Avery.
