*********************************************************************** " WILL OF NICHOLAS FRAMBES " In the name of God Amen, I NICHOLAS FRAMBES, of the Township of Eggharbour in the County of Gloucester and the State of New Jersey, Being Well in health, and Sound mind and memory , and knowing that it Appointed for all men to dye Do make and publish this my Last will and Testament in the manner following that is to Say,- Item the First.- After my Just Debts and funeral Expenses is paid, I give and devise unto my Daughter MARY EDWARDS Late MARY FRAMBES the following described Tract of Land and Meadow, Situate on Padconk Creek, in the Township of Eggharbour, in the County of Gloucester and State of New Jersey, Beginning at a Stake Standing in a Run known by the name of Furmans Brook, in the public Road Leading from Bargain Town to Jeffrys Landing and from thence first (1) North thirty Seven Degrees and a half East Six Chains and twenty links Binding Said Road to a Stake, thence (2) South forty five Degrees east twenty Chains and thirty link to a Ditch and fence, thence (3) South forty nine Degrees West four Chains to a Stake, thence (4) South forty five Degrees East five Chains & twenty links to Patconk Creek, thence (5) Down the Several Courses of Said Patconk Creek and binding thereby to the mouth of Furmans Brook so Called, thence (6) up and binding thereby, the Several Courses of Said Furmans Brook to the place of Beginning, onely Execpting therefrom a Small lot of the Meadow hereafter divised to my Son JOB FRAMBES Which lot is to begin at a Stake, Standing by the Side of the said Furmans Brook, at the mouth of a ditch out of the Same an Runs from thence down the middle of the Said Furmans Brook (1) first South thirteen degrees East one chain and Seventy Links to a Persimmon Bush Standing by the Side of Said Brook, Thence Leaving Said Brook (2) South forty eight degrees East five Chains and Seventy five Links to the aforesaid Patconk Creek, thence (3) Binding down by the Several Cources of the Said Padconk Creek to the mouth of the aforesaid Furmans Brook, thence (4) Binding by the Several Courses of the aforesaid Furmans Brook to the Persimmon first Named, and likewise the fence that now gos by the Road, that leads from Bargain Town to Jeffreys Landing down to the Said Padconk Creek Near the Said Lane aforesaid, Which I order to be Remo ved and Sot tn the line of the Said DAVID FRAMBERS and the land hereafter Devised to my daughter SARAH SMITH to make a line fence between my Son DAVID FRAMBES, land and my Daughter SARAH SMITHs Land Which land and Marsh I devise unto my Daughter MARY EDWARDS, late Frambes, to and to her heirs and Assigns forever onely excepting therefrom onely as before Excepted, And further I give and devise unto my Daughter MARY EDWARDS, late Frambes the Sum of two hundred Dollars to be paid to her by my Executors in Six Month after my decease and in Case She Should be Loveing at that time to her heirs on the Legal Representatives of them for their own use forever, which two hundred Dollars is to be paid out of my personal Estate.-- Item the Second,-- I give and devise unto my Daughter SARAH SMITH, late Frambes, all the following Tract of Land and meddows, in the Township of Eggharbour County of Gloucester and State aforesaid, Beginning at a Stake Standing in the public Road Leading from Bargain Town to Jeffys Landing Which Stake Stands Seven Chains and thirty links from MARY EDWARDS Second Corner , on Said Road, Thence (1) South forty five Degrees East twenty three Chains, and fifty Links to Padconk Creek, thence (2) Binding by the Several Courses of the Said Padconk Creek Down to the fifth Corner, of the Said MARY EDWARDS Land or Marsh, thence (3) Bending the Line of the Said MARY EDWARDS North forty five Degrees West , five Chains and twenty links to a ditch and fence being another Corner of the Said MARY EDWARDS , thence (4) Still bending the Said MARY EDWARDS Line North forty nine Degrees East four Chains to another Corner of Said MARY EDWARDS, thence (5) Binding Said MARY EDWARDS Line North forty five Degrees West twenty Chains and thirty Links to the Said Road that Leads from Bargain Town to Jeffrys Landing, thence (6) Binding Said Road , North thirty Seven Degrees and a half, Seven Chains and thirty Links to the place of beginning Which lot of Land and Meadow I Devise unto my Daughter SARAH SMITH, Late SARAH FRAMBES, to her and to heirs and Assigns for ever, and further I give and Devise unto my Daughter SARAH SMITH Late SARAH FRAMBES two hundred Dollars to be paid out of my personal Estate by my Executors in Six Months after my Decease, And if She Should not be Living to her heirs or her Legal Representatives for ever.- Item, The third I give & devise unto my Son DAVID FRAMBES All the following discribed Land and meadow being in the Township of Eggharbour County and State aforesaid, Beginning at the Beginning corner of SARAH SMITHs Land at a Stake Standing in the public Road that leads from Bargain Town to Jeffries Landing , and Runs from Said Stake (1) Binding Said SARAH SMITHs line, South Forty five Degrees East, twenty three Chains and fifty Links to Patconk Creek, thence (2) up and Binding thereby the Several Courses of Said Patconk Creek, North forty four Degrees East Eigh Chains and Seventy Links, thence (3) North ten Degrees West, Seven Chains,-thence (4) North twenty four Degrees East five Chains and fifty Links to the mouth of a Small Spring putting out of Said Creek,- thence (5) Binding Said Creek, and Running North, Twenty Degrees West Eight Chains to a Small Cedar in the field-(6) thence North Sixty two Degrees and a half West, Eleven Chains and fifty Links to a Small White oak, on the Westerly Side of Said Public Road, thence (7) North thirty Seven Degrees and a half, East thirteen Chains and twenty five links to a White Oak Standing by Said Road and near the North East Corner, of the DORE yard, Where ANDREW FRAMBES formely Lived-Thence (8) North Seven Degrees West twelve Chains to a White Oak Stump, Corner in the Back Line, thence (9) Binding the Back Line South Easterly to DANIEL EDWARDS Corner near the Corner of his field, thence (10) Binding his Line to the public Road aforesaid that Leads from Bargain Town to Jeffries Landing, thence (11) Down Said Road South thirty Seven Degrees and a half West to the place of Beginning, after excepting out a Certain Lot now Occupied by DANIEL EDWARDS, for a Waggon house, and Black Smith Shop Sufficient for that purpose During the Said DANIEL EDWARDS natural life, Which then is to decend to my Son DAVID FRAMBES, I likewise Give unto my Son DAVID FRAMBES, All my part of that eight Acre lot of Fresh Meadow that I own near Oppeset of the Said DAVID FRAMBES House Also I give and devise unto my Son DAVID FRAMBES a Lot of four Acres of Meadow more or Less that I Own below the Bank acrost Patconk Creek All of Which Lots of Lands and Meadows, I give devise unto my Son DAVID FRAMBES, and to his heirs and assigns forever, onely as before Excepted. Item the Fourth, I give and devise unto my Son ANDREW FRAMBERS, the Following Tract of Land and Meadow, Beginning at a Stake Standing at the Mouth of a Small Branch or Spring that puts out of Patconk Creek, fifteen perches above What is Called the Wattering place formerly Badcocks Landing near the foot of the Lane, and Runs from thence first (1) North Sixty Seven Degrees West, four Chains and Sixty Links to an Apple tree, thence (2) North two Degrees East two Chains and Sixty three Links to a Cedar Bush for a Corner, (3) North Sixty two Degrees, West twelve Chains and Sixty three Links to a Pine Bush, Standing by the Side of the Road that leades from Bargain Town to Jeffryes Landing, thence (4) South Eighty five Degrees West fifteen Chains and Seventy five Links, to the forks of Road, thence (5) Binding up the Said Road till it Strikes the Back Line, thence (6) Binding the Back Line and the head of the Land till it Comes to a White oak Stump in the Back Line Being a Corner to the Land heretofore Devised unto my Son DAVID FRAMBES, -thence (7) Binding the Said DAVID FRAMBES Line to Patconk Creek , thence (8) Binding by Several Courses of the Said Patconk Creek up to place of Beginning, Which Lot of Land I Give and devise unto my Son ANDREW FRAMBERS his heirs and assigns forever,- Item the fourth-I give and devise unto my Son JOB FRAMBERS all the Remainder or part of the Homestead Plantation that Lais ajoining to the Land Devised hereto fore to my Son ANDREW FRAMBES, Which Tract of Land and Meadow is beginning at a Stake Standing on Patconk Creek, It being the upper Corner of Said ANDREW FAMBERS Land or Maeadow, thence (1) Binding on the Said ANDREW FRAMBERS, Line North Sixty five Degrees West four Chains and Sixty Links to an Apple Tree, thence, (2) North two Degrees East, two Chains and Sixty three Links, Binding Said line to a Ceder Bush, thence (3) North Sixty two Degrees West twelve Chains and Sixty three Links Binding Said Line to a Pine Bush Standing by the Side of the Road that leads from Bargain Town to Jeffries Landing, thence (4) South Eighty five Degrees West fifteen Chains and Seventy five Links to the forkes of the Road, thence (5) Binding Said Road and Andrews Line up til it Strikes the Head Line of the Land it being a Corner to the Land divised heretofore to my Son ANDREW FRAMBERS and from thence (6) Binding Said Line North Easterly the Several Courses of the Homestead Plantation to the Bargain Town Lots Which lais on the North East, thence (7) Binding by Said Bargain Town Lots South Easterly to Said Patonck Creek thence (8) Binding down by the Several Courses of the Said Patconk Creek to the place of Beginning, and Likewise I Give and Devise to my Son JOB FRAMBERS All that Lot of Fresh Meadow that I Bought of JOHN DOUGHTY Laying between the public Road and the Bank over Patconk Creek I Likewise Give and Divise unto my Son JOB FRAMBERS All that Lot of Fresh Meadow that is Excepted out of my Daughter MARY EDWARDS Lot, Which Lot of Meadow is Beginning at a Stake Standing in a ditch that puts out of Furmans Brook, and Runs thence first (1) down the middle of Said Brook, South thirteen Degrees East one Chain and Sev- Links to a Persimon bush by the Side of Said Brook, thence (2) South Forty Eight Degrees and thirty minutes East, five Chains and Seventy Links to Patconk Creek, thence (3) Binding the Several Courses of the Said Patconk Creek to the mouth of the Said Furmans Brook to the Said Persimmon. It being the Whole of the Lot that is Excepted out of my Daughter MARY EDWARDS Lot. All of Which Lot of Land and Meadow, I Give and Divise unto my Son JOB FRAMBERS, to him his heirs and Assigns for ever. Item the Fifth, I give and divise unto my three Sons and two Daughters Namely JOB FRAMBERS, DAVID FRAMBERS, ANDREW FRAMBRES and SARAH SMITH late SARAH FRAMBRES, MARY EDWARDS Late MARY FRAMBRES, All the Rest of my Lands not heretofore Divised that I Shall By Seized or intitled tue to be equally Divided between them Share and Share a like to them, their Heirs and assigns for ever. Item the Sixth, It is my Will that DANIEL EDWARDS or his heirs Shall make a Deed, Release or Quit Clams unto my Son DAVID FRAMBERS his heirs and assigns a Deed or Quit Clame for that four Acres of Meadow that the Said DAVID EDWARDS Claims under Deed from the Said DAVID FRAMBERS.- Item the Seventh.- It is my Will and I further order that by the Neglect or Refusal of the Said DANIEL EDWARDS or his Heirs Neglect or Refuse to Execute the Said Deed or Quit clame for the four acres as aforesaid unto my Son DAVID FRAMBERS, his heirs and assigns in Six Months after my decease, then I order and it is my Will that Said DANIEL EDWARDS or r his heirs shall pay out of What is heretofore Devised unto my Daughter MARY EDWARDS Late MARY FRAMBERS , unto my Son DAVID FRAMBERS, the sum of Five hundred Dollars on the following Conditions, That is to Say, If the Said DANIEL EDWARDS , or his heirs Administrators or Executors Shall execute a good and Sufficiant Deed or Quit Clame for the four acres as aforesaid unto my Son DAVID FRAMBERS to him his heirs assigns, then I order that my Daughter MARY EDWARDS Late MARY FRAMBERS, and DANIEL EDWARDS shall be for ever Discharged from any payment to my Son DAVID FRAMBERS , of the Said five Hundred Dollars, as above.- Item the Eighth- I give and Divise All my personal Estate to be equal Divided between my three Sons and two Daughters after all, other Legacies is paid out aforesaid And Lastly I Constitute, Authorise and appoint my two Sons JOB FRAMBERS and ANDREW FRAMBERS my onely and Sole Executors of this my Last Will and Testament Revoking and Disannulling all former Wills and Testaments by me made and published Rattifying and allowing this to be my Last Will and Testament.- Given under my hand and Seal this first Day of December in the year of our Lord one thousand Eight Hundred and thirty four. I JESSE SMITH Surregate of the County of Gloucester do hereby Certify, the Annexed to be a true Copy of the Last Will and Testament of NICHOLAS FRAMBRES Late of the County of Gloucester, deceased and that JOB FRAMBERS and ANDREW FRAMBERS of the County of Gloucester the Sole Executors therin named proved the Same before, and is duly Authorized to take upon themselves the administration of the Estate of the Testator, Agreeable to the Said Will.
