State of New Jersey Cape May County, On this 31st day of May, A. D. one thousand eight hundred and ninety personally appeared before me Clerk of the Court of Common Pleas a court of record within and for the county and State aforesaid George H. Shaw aged 46 years, a resident of the Town of Tuckahoe county of Cape May State of New Jersey who, being duly sworn according to law, declares that he is the identical George Shaw who was ENROLLED on the 1 day of Sept 1862 in Company “H” of the 28 Regiment and was honorably DISCHARGED at Camp Vredingburg, N. J. on the 6 day of July 1863. Height 5 feet 4 ½ inches dark complexion, color of hair dark. That while a member of the organization aforesaid, in the service and in the line of his duty at Fredericksburg in the State of Virginia on or about the 13 day of December, 1862, he received a wound in his right eye, by a piece of gun-cap on other missile striking him while in action there; the eye became inflamed, and periously affected him, and he has suffered from the same and the effects thereof, more or less ever since. That he was treated in hospitals as follows: That has not been employed in the military or naval service otherwise than as stated above That since leaving the service this applicant has resided in the County of Cape May in the State of N. J. and his occupation has been that of a ___. That prior to his entry into the service above named he was a man of good, sound, physical health, being when enrolled a _______. That he is greatly disabled from obtaining his subsistence by manual labor by reason of his injuries above described, received in the service of the United States; and he therefore makes this declaration for the purpose of being placed o the invalid pension roll of the United States. He hereby appoints, with full power of substitution and revocation, HENRY D. PHILLIPS, lawyer, Forst Building, Trenton, N. J., his true and lawful attorney to prosecute his claim. J. for Pension. =>Disability alleged as ground for Pension is: injury right eye Personally appeared before me, a Justice of the Peace in and for aforesaid County and State Joseph C. Marshall who, being duly sworn, declares, in relation to aforesaid case, as follows: That his residence and P. O. Address are as follows: Tuckahoe Cape May Co. New Jersey that he has been a practicing Physician for 20 years, and has been acquainted with said soldier for about 10 years; that he has had knowledge of him and his disability as follows: did not know soldier until about ten years since. I was first called upon to treat claimant for a right Conjunctivitis in June of 1882. He affirmed the trouble proceeded from an injury sustained during service in the late Civil War. I recommended the bathing of the organ with hot water slightly salted, gave a prescription and lost sight of the case. I do not know to what extent he was or has been imancipated for manual labor. I should suspect the trouble might be the nature of the injury claimed. His habits are good and being sober and industrious. And he further declares that he has no interest, either directly or indirectly, in the prosecution of this claim. Joseph C. Shaw aged 49 years, a resident of Tuckahoe in the County of Cape May and State of New Jersey well known to me to be reputable and entitled to credit, and who, being duly sworn, declares in relation to his claim for pension as follows: My post-office address is Tuckahoe Cape May County New Jersey. For five years immediately preceding my enlistment into the service of the United States on the 1st day of September 1862, I resided in the following named placed: Millville New Jersey and my occupation was that of a labourer. Since my discharge from said service, I have resided in Millville, Malaga & Tuckahoe New Jersey and my occupation has been that of a labourer. From my said discharge to the present time, I have received the following medical treatment for the disability in my Declaration: Dr. Lofer, treated me Oct. 1863 – Also Dr Marshall treated me in 1882. Dr. Loper address was Millville N. J. now deceased. Dr. Marshall address is Tuckahoe N.J. Since the origin of the disability for which pension, is claimed, I have suffered with the following acute diseases: none for which I was treated by Dr. ---- And during all the said time, my physical condition and ability to perform manual labor have been as follows: In 1863 lost several weeks time. also at different times since. Shaw, priv. Co. “H” 28th, N.J. for Pension. Personally appeared before me, a Justice of the Peace in and for aforesaid County and State William Burley and Elva D. Loyd well known to me to be reputable and entitled to credit, and who, being duly sworn, declare, each in relation to aforesaid case, as follows: The affiants well know said soldier, and have known him for the past 17 years and 20 years respectively; that soon after his discharge and return home, on or abouth the month of July 1863 they saw and conversed with him familiarly, and he was then suffering from injury right eye and effects thereof, which, he then said, he had incurred in the army, in the line of duty; that his general appearance and symptoms then were as follows: appeared like one suffering great pain in one of his eyes, otherwis seemed to be in fair condition as to general health. that he has continued to suffer from same, and the resulting effects thereof, with like symptoms, more or less, ever since, and by reason thereof, in each year, since discharged, has been incapacitated for manual labor to the extent of (1) 1/8 on an average, and is so now, to the extent of (1) 1/8, and that their means of knowledge as to foregoing facts are as follows: (2) have lived close to him for the last fifteen years & seem him every few days that, in the opinion of the affiants, the same was caused by his said service in the army, and has not been aggravated nor prolonged by intemperance or other bad habits. They further declare each that they have no interest in said case, and are not concerned in its prosecution, and are not related to said applicant. William Burly age 62 years P. O. Sir: To further aid this Bureau in determining the merits of the above-entitled claim for pension, be kind enough to answer in your own handwriting the following questions, giving more complete details than your affidavit affords. Very respectfully, Wm. Lockness Commissioner. Mr. Wm. Burly Tuckahoe, N.J. When did you first see claimant after he returned form the Army, and how do you fix the date? Answer: I have been personally acquainted with him since 1873 as a neighbor Of what disability did he complain, and how was he affected? Answer: his right eye was affected, and since then he has become ruptured on his right side. How frequently have you seen him since your first acquaintance? Answer: I have saw him frequently as a neighbor If he has continued to suffer with such disability, please describe the symptoms which were apparent to you, and state to what extent he has been disabled therefrom for manual labor during each year. Answer: I have noticed that his eye has caused him some trouble. also his rupture has at times caused him to stay in the house from labor for days, hindering him fro active labor. My means of knowing the facts of the case are these: I have known him personally and have been told by those who have worked with him that he is not capable of a full days work and has a large family depending on him for support. Certificate No. 694,5923 : Docket No. 55,966. George H. Shaw, : Appeal. Co. H, 28th N. J. Inf. : Affirmed. CLAIM FOR PENSION UNDER GENERAL LAW. Injury to the eye is not established as of service origin. The Commissioner of Pensions, Sir: George H. Shaw, enlisted in Company H, 28th New Jersey Infantry, August 26, 1862, and was discharged July 6, 1863. He is now pensioned under certificate No. 694,952, act of June 27, 1890, at #8. per month. June 9, 1890, he filed his declaration under the general law alleging that at Fredericksburg, Virginia, December 13, 1862, he received a wound in his right eye by a piece of gun cap or other missile striking him while in action. He states his eye became impaired and seriously affected him, and has ever since. This claim was rejected Jun 2, 1899, on the ground of no record of would to the eye by gun cap and because of claimant’s inability to furnish evidence of incurrence. From this action, claimant’s attorney appeals, July 6, 1899, contending the evidence is more than sufficient to satisfy a reasonable person. Claimant’s statements are not very consistent for in April, 1899, he states some missile from the enemy struck his gun and knocked him senseless. There are no comrades living he states, who were present at this time. There is no record of incurrence of treatment in the service. Soldier is shown to have been present for duty all the time. The first treatment shown was in June, 1882. One neighbor testifies soldier’s eye was sore in 1863, when he returned from service. Another testifies his eye was sore in 1873. There is no evidence whatever as to incurrence. This is all the evidence. No comment is necessary. Your action in rejecting the claim was proper and is sustained. The papers are herewith returned. Shaw “H” 28th N J Vols for Pension Personally came before me, a Justice of the Peace in and for aforesaid County and State, George H. Shaw, the above named pensioner, who, being duly sworn, declares in relation to aforesaid case as follows: I received injury to my right eye December 13th 1862, at the battle of Fredericksburg by some misel from the enemy striking my gun and knocking me senseless. I treated myself for the injury to my eye with Thompsons eye wash, there are not any of my comrades living who were present at the time of the injury. I was treated for the injury to eye by Doctor Lofer, now deceased of Millville N.J. after my discharge. George H. Shaw age 54 years P. O. Address Tuckahoe N.J. C., June 28, 1899 Sir: You are informed that the above-entitled claim for original pension under the general law is rejected on the ground that the reports from the records of the War Department fail to show the incurrence of, or treatment for, the alleged wound of eyes and claimant is unable to furnish evidence showing that the same originated in the military service. Shaw Tuckahoe New Jersey Dear Sir: Relative to your claim for pension under act of May 11, 1912, in which you allege that you are 70 years of age, and that your were born Mch 11, 1843, you are advised that the best obtainable evidence of the date of your birth is required by this Bureau. If there is a public, church, or family record of your birth, you should forward a verified copy of such record. If there is no public of church record, and a verified copy of the family record is furnished, the officer certifying to the same should state in what year the Bible, or other book in which the record appears, was printed; whether the record bears any marks of erasure or alteration; and whether, fro the appearance of the writing, he believes the entries to have been made about the dates given. If you are unable to furnish any of the evidence indicated, you should state that fact, and the reasons why you are unable to furnish it, under oath. Pleas return this letter with your reply. Respectfully, returned to the Chief of the Civil War Division The pensioner persistently maintains that he was born Mch 11, 1843, but the War Department records do not support his contentions. When he enlisted Aug 26, 1862 his age was given as 18, but if this meant that he would be 18 on his next birthday, this would agree with his age on his second enlistment, 19, and he was born in 1845. He also claims that when he first enlisted he was told that he was 19 years of age, but in this he may be mistaken and was told that he was 17. ------------------------------------------------------------------------ Page 11 Civil War Div. Sir: Your above cited claim for pension under the act of May 11, 1912, requires your statement, showing the name of the city, town or township, county and state, in which you were born, and from which you enlisted, and in which your resided in June 1850 and 1860, and the names in full of your parents, brothers and sisters, living at that time, or if you did not live with them, during those years, the names of the persons with whom you did live. If you resided in a city, you should state the number of the ward, and the street and number of your residence, and between what streets you lived. The above requirement is necessary in order that information may be obtained from the Census Bureau, as to your age, and is made with a view, only, to assist you in establishing the year of your birth. The soldier was originally pensioned under the act of June 27, 1890 at $8 per month and on Mch 1 1907 he filed a claim under the act of Feby 6, 1907 in which he alleged that he was born Mch 11, 1843. That date was accepted and he was pensioned at $12 per month. Under the act of May 11, 1912 he filed a claim on May 28, 1912 in which he alleged he was born Mch 11, 1843, but Mch. 11, 1844 was accepted and he was pensioned at $16 per month. He now claims increase, still alleging Mch 11, 1843 as the date of his birth, but the Census report shows that in 1850, he was but 3 years of age and therefore must have been born Mch 11, 1847. W. G. Sir: It appears from the records of this Bureau that on March 29, 1907, you being then a pensioner under the act of June 27, 1890, at the rate of $8 per month, your claim was allowed under the act of February 6, 1907, at the rate of $12 per month from March 1, 1907, predicated on your statement that you were born March 11, 1843, and had therefore attained the age of 62 years, as required to give title under the said act. On January 27, 1913, at the rate of $16 per month from May 28, 1912, predicated on your statement that your were born March 11, 1843, and has attained the age of 66 years as required to give title to the said rate based on a service of one year during the Civil War. It now appears by a recent report from the U. S. Census Bureau, obtained in connection with your pending claim for automatic increase, that in the returns for Millville, Cumberland Co., N. J., enumerated July 14, 1850, your father and mother, William and Elizabeth Shaw, gave the ages of their children as follows: Ann 7 years, Phillip 5 years, George 3 years, Sarah 2 years, and William 10 months. As the said record was made by an authorized and accredited agent, appointed for the purpose, from statements made by your parents, who are supposed to have known your age, it is regarded as reliable and entitled to greater weight than verbal or written statements made from memory or based on hearsay, hence it is accepted therefrom that you were born not earlier than 1847, and as you have consistently alleged March 11 as the correct month and day of your birth, it is held that you were born March 11, 1847. It is thus shown that on March 1, 1907, the date of filing your declaration under the act of February 6, 1907, you had not attained the age of 62 years and the allowance to you of pension under the said act prior to March 11, 1909, the date you attained the requisite age, was contrary to law. It follows as a necessary conclusion that on May 28, 1912, the date of filing your declaration under the act of May 11, 1912, you had not attained the age of 66 years and the allowance to you of a rate in excess of $14 per month prior to March 11, 1913, the date you attained the age of 66 years, was also contrary to law. Your certificate will reissue under the act of May 11, 1912, as amended by the act of March 4, 1913, at the rates of $14 per month from May 28, 1912, $16 per month from March 11, 1913, $20 per month from March 11, 1917, and $24 per month from March 11, 1922, the rates provided for a service of one year during the Civil War where the age attained is 62, 66, 70, and 75 years, respectively; a deduction will be made of subsequent payments and payments will be withheld until a sum accrues sufficient to reimburse the Government for the amount erroneously paid you under the act of February 6, 1907, namely, all in excess of the rate of $8 per month which you are entitled to received by former issue under the act of June 27, 1890, i.e., $4 per month from March 1, 1907, to March 10, 1909, inclusive, and for the amount erroneously paid you under the act of May 11, 1912, namely, $2 per month from May 28, 1912, to March 10, 1913, inclusive. Under the provisions of the act of Congress of December 21, 1893, you will be allowed a period of 30 days from receipt hereof in which to make such answer as you deem proper to show cause why the action above indicated should not be taken.
