This file was contributed for use in the USGenWeb Archives by: Doris Langner, dorisdal@concentric.net ==================================================================== From an undated (1929), unknown newspaper: KUTSCHINSKI ESTATE BEFORE TWO COURTS A spirited denial of charges on mismanagement against FREDERICK LUHR, 22 Oakridge Avenue, Summit, was made by his counsel, JOSEPH RANKER, in Orphans' Court today before JUDGE EGAN. Luhr is one of the executors of the will of GUSTAVE M. KUTCHINSKI (sic), a wealthy Union City real estate dealer, who died June 22, 1927, leaving an estate valued at $300,000. Kutchinski's (sic) widow, MARGAREHA (sic) H., and Luhr, who is a son-in-law, were named executors. Mrs. Kutchinski (sic) in asking for Luhr's removal today charged that he mismanaged and wasted the estate and that he has failed to make an accounting. The matter came before Judge Egan on a rule to show cause why Luhr should not be removed as executor. Mr. Ranker said Mrs. Kutchinski (sic) had collected $1,000 a month from the property of the estate as rents, that she had neglected to pay the taxes for 1928 and 1929, and that her son, FREDERICK, had been given a position as manager of the estate at $75 a week without consulting Mr. Luhr. Former Assemblyman CHARLES E. S. SIMPSON is the widow's counsel. The estate, in which she was left a life-interest, includes apartment houses and a restaurant and garage in Union City. After Mrs. Kutchinski's (sic) death the property will be divided among their seven children. Judge Egan, after the hearing, referred the matter to Lawyer J. STANLEY GRIFFIN, who is to inquire in the affair and take testimony. No date has been set for his report. VICE CHANCELLOR FALLON Thursday heard the application of MRS. HENRIETTA SCHEFFER, MRS. ALVIAN (sic) NEWMAN (sic), MRS. MARGARETHA GREWE and WALTER KUTCHINSKI (sic), for a receiver of rents for the various properties in Hoboken, Union City and West New York, which are said to have an annual rental of $15,000, and upwards, which were owned by the late GUSTAVE M. KUTCHINSKI (sic), well known Union City realtor, who died June 22, 1927. This application for a receiver has been pending in the Court of Chancery since last December, and the application is directed against the widow, MARGARETHA H. KUTCHINSKI (sic) and her son-in-law, FRED LUHR, executors of the estate. Efforts to settle the controversy have been made in the interim, but without avail. Since that time another son, FRED KUTCHINSKI (sic) has been collecting rents and managing the properties. VICE CHANCELLOR FALLON directed FRED KUTSCHINSKI Thursday to account for $7,200 collected since last September, and directed the mother to have all of her books, vouchers and everything connected with the properties since the death of her husband at the office of her counsel, CAREY & LANE, that they may be inspected by the attorneys for the applicants, KELSEY & LUDWIG. The applicants contend that the mother has not managed the properties properly. They claim she has permitted taxes and water rents to go unpaid, and they want to know what has been done with the rents. There is also pending in the Court of Chancery, a suit of MRS. KUTCHINSKI (sic) and her son, FRED, for a construction of Mr. Kutchinski's (sic) will. They claim it is ambiguous, and they want it construed properly. It appears the will gave the mother a life interest in the estate, and that the properties eventually go to (the rest of article missing)
