May the 2nd. 1743 delvered a copy of the within Declaration to the wife of the within named Richard Furman fild May 13th1743 James Johnston Maketh Oath that he on the Second Day of May 1743 delivered unto the wife of Richard Furman within mentioned a copy of this Declaration and that the notice subscribed and at the same time read the same unto her James Johnston Before me Commissioned for taking of Affidavits for the County of Hunterdon Thos. Cadwalader New Jersey Sup. Curt. March Term in the year of our Lord one thousand Seven hundred and forty-two Hunterdon --- William Searle complains against John Turnout in Custody vs. for that Whereas John Coxe Executor of the last Will and Testament of Daniel Coxe Esq. deceased the First day of February in the year of our Lord one thousand seven hundred and forty two - at Trenton in the County of Hunterdon aforesd. had domised --- and to --- to the afd. William Searle - one Messuage one Barn, one orchard one Garden one Stable three hundred acres of arable Land there hundred acres of Pasture Land, three hundred acres of Meadow Land three hundred acres of Wood lands with the Appurtenances Scituate and being in Trenton in the County of Hunterdon afsd. and now late in the tenure or Occupation of Richard Furman or his assigns To have and to hold the Tenements afsd. with the Appurtenances unto the said William Searle and his assigns from the last day of January then last past for and during untill the full End term & Seven years from thence most ensuing and fully to be compleat and ended By Virtue of which domise the said William Searle into the Tenements afsd with the Appurtenances did enter and was there possessed untill the said John Turnout afterwards to witt the Second day of February in the year afsd with force and Arms &c. unto the Tenements of afsd. with the Appurtenances in and upon the possession of him the said William Searle there afrsd. enter and him the said William Searle from his farm aforesaid his torn thereof afsd. not being as yet ended did eject expell and move and Whereas Daniel Coxe son of the said Daniel Cox Esq.. deceased the First day of February in the said year of our Lord one thousand seven hundred and forty two at Trenton in the County of Hunterdon afsd. had domised Lett and --- Lett unto the said William Searle One Messuage, one Barn, one orchard one Garden one Stable three hundred Acres of Arable Land three hundred acres of Pasture land and three hundred Acres of Meadow land and three hundred Acres of Woodland with the Appurtenances Scituate and being in Trenton in the County of Hunterdon afsd and now or late in the tenure or occupation of the said Richard Furman or his assigns To have and to hold the Tenements last mentioned with the appurtenances unto the said William Searle and his assigns from the last day of January then last past for during and untill the full end and Term of Seven Years from thence next Ensuing and fully to be compleat and ended By Virtue of --- last mentioned Domise the said William Searle into the Tenements last mentioned with the Appurtenances did enter and was therefore possessed untill the said John Turnout --- afterwards with the Second day of February in the year afsd. with force and arms &c. into the tenements last mentioned with the appurtenances in and upon the possession of him the said William Searle did enter and him the said William Searle from his farm last mentioned his term thereof afsd. not being as yet ended did eject expell and move and the said William Searle so being ejected expelled and moved from his possession of his several farms afsd. he the said John Turnout hath withheld and still doth withhold and other harms to him the said William Searle he the said John Turnout then and there did bring against the peace of our Lord the King and to the Damage of him the Said William Fifty pounds proclamation money and thereof he brings this suit &c JMurray --- --- --- Hunterdon afsd. William Searle puts in his place Joseph Murray his attorney against John Turnout in a Plea of Trespass & Ejectment I am informed that you are in Possession & or Claim title to the Premises in the aforesd. Declaration in Ejectment mentioned or some part thereof &c And I being sued in this Action as a Casual Ejector and having no claim or ritle to the same do advise you to appear at the next Supream Court of Indictment to be hld for the Province of New Jersey at Burlington on the Second Tuesday in May next and then and there by rule of the same Court to Cause yourself to be made Defendt. in my stead and defend your title if any you have to the Premises otherwise I shall suffer judgmt. to be entered against me y default and you will be turned out of possession John Turnout To Mr. Richard Furman tent. in possession of the Premises or Some part thereof
