All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nj/njfiles.htm ************************************************ West Jersey Deeds Vol. E p. 284 Joseph Phillips to John Phillips This Indenture made the Twenty ninth Day of March in the tenth year of the Reign of our Sovereign Lord the Second King of Great Britain --- and in the Year of our Lord One thousand Seven hundred & thirty Seven Between Joseph Phillips of Maidenhead in the county of Hunterdon and province of New Jersey carpenter and John Phillips of Hopewell in the county and province aforesaid blacksmith of the other part witnesseth that the said Joseph Phillips for and in consideration of the Sum of one hundred & twenty five pounds currency for proclamation money to the said Joseph Phillips in hand paid by the said John Phillips at or before the sealing & Delivery of these presents the Receipt whereof the said Joseph Phillips doth acknowledge whereof & of every part parcel thereof doth clearly acquit & discharge the said John Phillips his hrs and adms & every of them by these presents do give grant --- release --- and confirm unto the said John Phillips & to his Heirs and assigns a certain tract of Land situate lying and being in the Township of Hopewell in the County of Hunterdon aforesaid which Tract of Land was purchased by the said Joseph Phillips from John McCloughlin and Joyce his wife of Hopewell in the County aforesaid as Executor & Executrix of the last Will and Testament of William Bryant late of Hopewell in the County aforesaid deceased by a certain Deed of Conveyance of Lease & Release bearing the Date the Twenty second day of February Anno Dmi one thousand Senven Hundred Thirty Three Reference thereunto being --- --- more fully & as --- appears & containing One hundred and Twenty five acres of Land & is butted and bounded as follows (Viz) Beginning at a Stone in the Outside Line & for a Corner between the Land of the said Joseph Phillips and the Land of the said John McGloughlin & Joyce his wife then north thirteen chains and a half to a post then North West ten chains and a half to a hickory tree then North Seven Degrees West twenty nine chains to a post then West four chains & eighty links to a post then South Sixty Degrees West four chains & a half to a black oak then South forty Degrees East fourteen chains & a half to a Water Beach then South Seventy Degrees West Nineteen chains to a Black oak then south forty five Degrees East thirty three chains & a half to a post then West fourteen chains twenty five Links to a black oak then south thirteen chains & a half to a white oak then East thirteen chains to the first --- containing One hundred & twenty five acres of land together with all the Mines Minerals woods Fishings fowlings hawkings & all singular other the Royaltys profits commoditys & hereditaments thereunto belonging or in any wise appertaining both in Lw & Equity of him the said Joseph Phillips & unto the said One hundred twenty five acres of Land & premises or any part of parcel thereof with the appurtenances Reversion & Reversions Remainder & Remainders ---of with every part and parcel thereof To have and to hold the said One Hundred & twenty five acres of Land with all the Buildings & Improvements thereon made & done and all other the premises herein bargained and sold or mentioned or intended to be herein granted bargained and sold and every part & parcel thereof with the appurtenances unto the said John Phillips his Heirs and assigns to the only proper use and behoof of the said John Phillips his Heirs and assigns forever. And the said Joseph Phillips for himself & for his Heirs & assigns by these presents that at the time of the Ensealing and Delivery of these presents had full power good right and lawful authority in himself to grant bargain & sell the said one hundred and twenty five acres of Land and premises and every part and parcel thereof with the appurtenance unto the said John Phillips his Heirs and assigns forever as is before in these presents mentioned And that it shall and may be lawful to and for the said John Phillips his Heirs and assigns forever by force and virtue of these presents and from time to time and at all times hereafter quietly and peaceably to have hold occupy possess and enjoy the same without any lawful --- --- Denyal Trouble Hindrance Molestation or Disturbance of the said Joseph Phillips his Heirs --- or administrators and of and from Col Daniel Coxe his Heirs --- and administrators and of and from the Honble Society of West Jersey or comps. In England them or any of them their Heirs and Successors of them or any of them shall and will from time to time and all times forever hereafter warrant and defend the bargained Land and premises with all their appurtenance to the sole use and Behoof of the said John Phillips and his Heirs and assigns forever the Quit Rents due to our Sovereign Lord the King his Heirs and Successors oly excepted An further that the said Joseph Phillips his Heirs --- and Adms. Shall and will from time to time and at all times hereafter during the space of Seven Years --- ensuing the Date of these presents at the request Cost and Charges in the Law of the said John Phillips his Heirs & assigns make and suffer to be done and acknowledged all and every further lawful act or Acts in the Law whatsoever as he the said John Phillips his Heirs or assigns or his or their or any of their Council learned in the Law shall lawfully devise advise for the further better & sure making and conveying the said Land & all other the Grants Bargained premises & every part and parcel thereof so as the person to whom such a request shall be made be not compelled nor hereby compellable to have all further than the town of Burlington for the doing the same --- thereof In Witness where of the party first above named hath hereunto set his hand and Seal the Day and Year first above written - Joseph Phillips with a Seal Sealed and Delivered in the presence of us the Words Lease and Release between the tenth and eleventh Line interlind before executing Cornelius Ringo Benjamin Byce Theophilus Severns Be it Remembered that on the --- Day of April One thousnad Seven hundred thirty seven personally came and appeared before Daniel Coxe Esq. one of his Majesty’s --- of the --- for the province of New Jersey Theophilus Severns oneof the Evidene to the above written Deed who being duly sowrn on the Holy Evangelists of almight God did depose that he did --- Joseph Phillips --- above written Grantor sign seal and execute the above written deed the --- --- therein mentioned --- --- --- --- --- --- ---
