Anno Domini one Thousand Seven Hundred and forty nine Between John Coxe Executor of the Last Will and Testament of Coll Daniel Coxe of trenton Deceased on the one parte and John Akers of Amwell in the County of Hunterdon in the western division of the province of New Jersey yeoman --- --- --- witnesseth that the said Daniel Coxe by his last will & testament in writing Duely made & by him signed in his presents bearing the date the Twenty first Day of March one thousand Seven Hundred & Thirty Seven Did amongst other things appoint Impower & authorise his Executors the survivors or Survivors of them to Sell and Dispose of his tracts of Land Called his Thirty Thousand acre Tract in Hopewell & his fifteen thousand Acre Tract in Maidenhead and to make good & equal & sofficant assurances & conveyance for the same to any purchaser or purchasers thereof or any part or parcil therof Except th efarm in the possession of George fox & Except the farm in possession of the John Deen and the said Daniel Coxe appointed the sd. John coxe together with Samuel Bustill Joseph Murray & James Alexander to be Executors of his sd. Testament and last will as by the same Last will duely proved and entered upon Record in the Secretary’s office of the province of New jersey in Burlington may fully & at Large appears and Wheras the sd. John Coxe & Samuel Bustill have proved the same will and Excepted and taken upon them the burthen of the Execution thereof since which the sd Samuel Bustill is Deseaced by Reason whereof the said John Coxe becometh whol & sol acting Executor of the Last will & testament of Daniel coxe aforesaid and whereas the Lands hereafter spesificed to be Sold are part of the thirty thousand & no part of the Exepted plantations By Reason whereof John Coxe the acting Executor is by the last will aforesaid Impowered to convey And Assure the same Now This Indenture Witnesseth That the said John Coxe for and in Consideration of the Sum of fifty one pound Twelve shillings Lawful money of the place aforesaid In hand paid by the said John Akers the Recept whereof the said John Coxe doetheth hereby acknowledge and himself therewith fully satisified Contented and and paid Doth hereby Discharge hiim the said John Akers his heirs Executors & administrators & Every of them forever by these presents. Have granted Bargained Sold Inseosed Released Conveyed & Confirmed, and by these presents Do grant Bargain Sell Release Inseaos Convey & Confirm unto him the said John Akers in persuance of the Act of Asssembly for transfering uses into possession and the his & assigns forever forty three acres of land situate Lying and being in the Township of Hopewell afresd. and is butted and bounded as followeth. Viz. Beginning at a Hickry Sapling being a Corner of Jonathan Smiths Land & Standing in the thirty Thousand Line and Turns from thence along the sd. Smiths Line South Eastwardly Sixty Eight Degrees Ten chains & Thirty Six Links to a white oak tree being also one of the sd. Smith’s Corners Then Southeastwardly Eighty three Degrees along another of the sd. Smith’s lines three Chains & Twenty three links to a sapling being also one of the said Smiths corners then along another of the sd. Smiths Lines northwestwardly four Degrees twenty four Chains to a stone for a Corner being also Smiths Corner then along another of Smiths Lines Southwestwardly Seventy two Degrees Seven Chains & Twenty five Links to another of Smiths Corner Stones Then Northwestwardly twelve Degrees Sixteen Chains & fifty Linds to another of sd. Smiths Corners Then west Eight Chain & Twenty five Linds to a stake in the Thirty Thousand Line. Then Southeastwardley twelve Degrees along the thirty toushand line Thirty five Chains to the first mentioned Hickory Sapling Containing Forty three Acres of Land as aforesaid To have and To Hold the said Forty three Acres of land bounded as aofresaid Together with all the Houses buildings ourchards gardens fences & all other improvements Together with all the mines minerals Hawkings Huntings Fowlings fishings and all other Rights profits priviliges Hereditaments and appurtances whatsoever unto the same belonging or in anyway appertaining, to him the said John Akers & to his Heirs & assigns to the sole & -- proper use benefit and behoof of him the said John Akers and his Heirs and assigns forever and the said John Coxe Doth for himself his heirs Executors & administrators Covenant grant bargain promise and agree to & with the said John Akers his Heirs and assigns that he hat not don nor wittingly nor willingly have suffered to be don any act matter or thing whatsoever whereby or be reason whereof the Estate by these presents granted or intended to be granted may be in any way De—ed Charged or Incombered and that the sd. John Coxe will at any time hereafter within the Term of Seven years at the reasonably request Cost & Charg in the Law of him the said John Akers his heirs or assigns make Do Execute or suffer or cahse to be made done and Executred all and Every sutch for then & other --- act Things & things apperances & Conveyances in the Law whatsover for the better and more perfect ssuring & convey the above granted & Bargained premises by them the said John Akers his heirs or assigns or his or their Council Learnt shall be advised Devised or Reasonably Required provided the same contain no forther Covenants Then what are contained in these presents and that for the doing thereof he be not compelable to Travis forther than Three miles from the place of his aboad, In witness whereof the said John Coxe hath hereunto set hishand and Seal the Day and year above written. Kennedy - Endorsed Memorandum That on the Twenty fourth day of February in the year of our Lord one Thousand Seven hundred and fifty two personally appeared before me Richard Saltar one of his Majesty’s Council for the provinceo f New Jersey Thomas Kennedy one of the witnesses to the within Deed & being Examined upon his Solumen oath Did Declare that he saw John Coxe the grantor to the within Deed sea & Execute the same to the use therein intended.
