All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nj/njfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Linda Tinney linda@branches-n-twigs.com August 27, 2008, 3:52 am Source: State Of New Jersey, Will Number 1457j Written: March 13, 1779 In the Name of God Amen I Peter Case of the Township of Amwell in the County of Hunterdon and State of New Jersey, Yeoman, being weak in body but of Perfect mind and Memory, Thanks be to Al- mighty God therefore first do recommend my Soul to God that gave it and my body to the Earth to be Buried in a Christain Like and Decent Manner by my Executors herein after nam'd, do make and Ordain this my Last Will and Testament, and hereby do dis- pose of such Wordly Estate as it hath Pleased God to bless me with in Manner following, first I will that my Just debts & Funeral Charges be fully paid & Satisfied. Imprimis it is my Will and I do Order That my Beloved Wife Anna be in full Possession of whole Estate Real and Personal during her Natural Life or Widowhood, but in case she should mary again, then my Whole Estate Real & Personal to be Sold & Equally Divided among all my Children, Viz Henry, Catherine, Tunis John, Anna, Peter, Jacob, & Christain Share & Share alike, but if my Beloved wife Anna should not mary She Shall Remain in full Possession of my Real Estate & all my Personal Estate Except such part thereof as may be Necessary for an Outset for my five Children (to wit) John, Anna, Peter, Jacob, and Christian, as they mary, because my Son Henry, Tunis & Daughter Catherine had theirs when they Married, which they shall have Over and Above their dividend to make them all Equal and I do hereby Order that they receive as much as the others did for their Out Set that is Severally the Same Each of the Others had. Imprimis I do Order my Executors to pay my Son Henry Ten pounds after my Decease for his birth right, and also they will give my three Chil- dren Peter, Jacob & Christian Some more Learning out of my Personal Estate before a Division, and if it Should so happen that my wife should marry again Or Depart this life before the Youngest of my Children Shall be of age, then in that Case it is my will & I do Order that their Dividends or Shares be put to Use, & that they receive their Several & Particular Shares as they Shall Arrive to the Age of Twenty One years, & if any of my Children Dies Without Issue their Shares to be Equally Divided [page two] Amongst the Survivors of them and them who may have Issue and Dye their Shares to be Divided Equally among them, but in Case any Dye without Issue and under the age of Twenty One years, to be Equally divided among the Survivors of them, hav- ing thus Dispos'd of my Estate to be Equally Divided Among all my Children, Leaving them their heirs and assigns forever. And Lastly I do herby Nominate and Appoint My Be- loved Wife Anna & also my Trusty and well beloved Friends Francis Besson & Christ Cool my Sole Executors to this my Last Will and Testament hereby Impowering them to Give Good & Sufficient Writings in hereafter Conveying my Real Estate Such as are Needful & Necessary In Witness Whereof I have hereunto set my hand & Seal this 13th day of March Seventeen hundred & Seventy Nine Signed Sealed & Pronounced & Deliver'd This my Last Will Testament in the Presence of us (signed) Peter Case Anna (her X mark) Cool (signed) Peter Hofman (signed) John Kline Peter Hufman one of the witnesses to the within Will being duly sworn on the Holy Evangelist of Almighty God, did depose and say that he saw Peter Case the Testator therein named sign and Seal the same, and hear him publish, pro- nounce and delcare the within writing to be his Last Will and Testament and that at the doing thereof the said Testator was of sound and disposing Mind and Memory, as far as this Deponent knows and as he verily believes; and that Anna Cool and John Kline the other subscribing evidences were present at the same time and signed their Names as Witnesses to the said Will together with this Deponent in the presence of the said Testator ---- (signed) Peter Hufman Sworn at Flemington---- the 29th June 1789 Before me R? Throckmorton, Surrogate Anna Case and Francis Bosson Executors in the within Testament named, being duly Sworn on the Holy Evangelists of Almighty God, did depose and say, That the within Instrument contains the true Last Will and Testament of Peter Case the Testator therein named, so far ? as they or either of them know, and as they and each of them verily believe; that they will well and truly perform the same by paying first the Debts of the said Deceased, and then the Legacies in the said Testa- ment specified, so far as the Goods, Chattels and Credits of the said Deceased can thereunto extend, and that they will make Inventory of all and singular the Goods, Chattels and Credits of the said Deceased that have or shall come to their knowledge or possession or to the possession of any other person or per- sons for their use, and render a Just and true accot. when there- unto Lawfully required --- Sworn as above Before me R?
