Horn Executor Probated August 26, 1889 Recorded in Vol. 15 of Wills, Page 593 Charles Alpaugh Surrogate Aug. 26 In the name of God Amen I Elizabeth Akers of the City of Lambertville County of Hunterdon and State of New Jersey being of sound mind memory and understanding (for which blessing I thank God) do make and publish this my last will and testament in manner following that is to Say First it is my will and I do Order that All my Just debts and funeral expenses by duly paid and Satisfied As Soon as conveniently can be after my decease Item. I give and bequeath unto my Grand Daughter Lydia L. Joiner all of my household goods including my Silver Spoons The remainder whatever it may be I give and bequeath unto my children Viz. Mary Elizabeth Leonard, Camillia Moore: Abner Akers: Sarah Catherine Coffey: Levina Akers: Charolotte Kitchen: And Emma Green Share and Share alike I hereby appoint my Friend John H Horn Executor of this my last will and testament August 8 1889 Elizabeth Akers (her mark) Signed Published and Declared by the said Elizabeth Akers to be her last will in the presence of us who were present at the same time. And subscribed Our Names as Witnesses in the Presence of the Testator William A. Gilliam William A Parker State of New Jersey, Hunterdon County William A. Parker one of the witnesses to the annexed writing, purporting to the last Will and Testament of Elizabeth Akers deceased, the Testator therein named, being duly sworn doth depose and say, that he saw the said Testat sign and seal the same and herar him publish and declare it to be his last Will and Testament; that at the time of the doing thereof, the said Testatrix was of sound and disposing mind, memory and understanding, as far as this deponent knows, and as he verily believes; and that William A. Parker the other subscribing witness thereto, was present at the time with this deponent, and that they together subscribed their names thereto as witnesses, in the presence of the Testatrix and of each other. Sworn and subscribed this 26th day of August 1889, before me. Charles Alpaugh, Surrogate William A Parker State of New Jersey Hunterdon County John H. Horn the Executor in the annexed writing named, being duly sworn doth depose and say, that the said annexed writing contains the last true Will and Testament of Elizabeth Akers deceased, the Testatrix therein name, as far as he knows, and as he verily believes; that he will, as the Eecutor thereof, well and truly perform the same, by paying first the debts of said deceased, and then the legacies therein specified, as far as the Goods, Chattels and Credits of said deceased can thereunto extend; that he will make and exhibit into the Surrogate’s Office of the County of Hunterdon a true and perfect inventory of all and singular the Goods, Chattels and Credits of the said deceased that have or shall come to his possession or the possession of any other person for his use; and that he will well and truly account when thereunto lawfully required; and that said Testatrix died more than ten days ago, to wit, on the 9th day of August A.D. 1889 Sworn and subscribed this 26th day of August 1889, before me. Charles Alpaugh, Surrogate John H. Horn In the matter of the last Will and Testament of Order for Probate Elizabeth Akers Deceased Application having been made to me by John H. Horn for probate of the last Will of Elizabeth Akers deceased, and letters testamentary thereon, and the deposition of one of the subscribing witnesses to the same having been duly taken, and it appearing to me on such proofs that the Will produced was duly executed according to law, and that more than ten days have elapsed since the death of the Tesat . It is therefore on this 26th day of August A.D. 1889 ordered and adjudged that the said Will be and the same is hereby established as the last Will and Testament of the said deceased, and that the same shall be and is admitted to probate, and that letters testamentary be granted thereon.
