All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nj/njfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Melva Sloan m-sloan@att.net January 27, 2006, 12:27 pm Source: Official New Jersey Record; Photocopy Obtained Many Years Ago; Exact Office Not Noted) Written: September 18, 1837 Recorded: October 12, 1837 In the Name of God Amen I James Girton of the township of Ewing and county of Hunterdon and State of New Jersey having duly considered the uncertainty of life and being sick, do think it proper to order my worldly concerns in manner and form as follows, being of perfect sound mind and memory First of All I commit my Spirit to God, who gave it, my Body I resign to the dust, to Buried in a Christian like manner And I order all my just debts and funeral charges to be paid, the Residue of my property I devise and bequeath as follows I give to William Smith and Elias Welling to be, equally divided between them, and I do herein constitute and appoint Elias Welling to be Executor to this my last will and testament utterly renouncing all wills that may have heretofore have been made by me declaring this to be my (a second “my” crossed out) last will, (“and testament” interlined). In witness I have hereunto set my hand and seal this Eighteenth Day of September In the year of Lord Eighteen Hundred and thirty seven. Welling as one of the witnesses to the within will being duly sworn according to law does depose and say that he saw James Girton, the testator therein named, sign and seal the same and heard him publish pronounce and declare the within writing to be his last will and testament, that at the doing thereof the said testator was of sound and disposing mind and memory as far as this deponent knows and that as he verily believes, and that John Welling & and(sic) Ebenezer H. Smith, the other witnessing witness, were present at the same time and signed their names as witnesses to the said will together with deponent in the witness of said testator. Sworn and subscribed before me October 12, 1837 /s/ William B. Welling /s/ W. N. Sloan Surrogate __________________________ Hunterdon SS Elias Welling executor in the within testament named being duly sworn according to Law does depose and say that that (sic) the within instrument contains the true first will and testament of James Girton the testator therein named as far as he knows and as he verily believes, that he will well and timely perform the same by paying first the debts of the decedent and then the legacies in the said testament specified as far as the goods chattels and credits of the said decd can thereunto (enter?)/and that he will make and exhibit unto the surrogate officer thereafter a true and perfect inventory of all and singular the goods chattels and credits of the decedent that have or shall come to his knowledge or possession or to the possession of any other heirs or persons for his use and render a just and true account thereof when thereunto lawfully acquired.
