Yeoman being in perfect health and Sound deposing mind and memory praise be the Lord therefor do make and Ordain this my last Will and Testament in manner and form following. That is to say First I recommend my sout to almighty God that gave it and my body to be commited to the earth and buried in a Christian and decent like manner according to the discretion of my Executors herein after named, my Will is that my just debts and Funeral charges be forthwith fully paid and satisfied as soon as possible after my decease. Item I give and bequeath unto my Well beloved Wife Mary One third part of the projits and produce of the plantation I now live on including both sides of the Creek during the time she remains my Widow, and the best Room in the dwelling houses I now live in with liberty of the cellar and kitchen. I also further give unto my said Wife the best feather bed and Furniture belongin, the largest looking glass, Black Walnut Oval Table, Six best Chairs, three pewter Platters and Six Plates, two Table Cloths, six Napkins, one brass kettle, One Iron Pott, a good riding Horse and Mare which she shall cuse with a good saddle and Bridle, tow Mich Cows and one equal third part of the Provisions and cyder that shall be in my House or Cellar at the time of my Decease, and twenty bushells of Wheat all which I give and bequeath unto my beloved said Wife mary for her full right of Dowry Item I give and bequeath unto my eldest son John the sum of five Pounds, Proc Money to be paid by my son Thelophilus Six Months after my Decease. Item I give and bequeath unto my Second Son Theophilus all my Land and Plantation whereon I now live on both sides of the Creek and any other ways possessed of at the time of my Decease except one hundred and ten acres as shall be hereafter described his paying my son John as above an what other Legacies shall be hereafter allotted him to pay all which I give unto my said Son Theophilus his heirs and assigns for ever Item I give and bequeath unto my Third Son Edmund the above aforesaid One hundred and ten Acres of land Lying on the West side of the Creek commonly known by the name of Jacobs Creek together with allt he Buildings on the said side of the Creek (now i the Possession of my eldest son John) and as the said Quantity of land is supposed not to be containd on the West side of the Creek, the remainder shall be laid out on the East side where it may most conveniently suit so as to make in the whole One hundred and ten Acres of Land all which I give unto my said son Edmund his heirs and Assigns for ever provided he pay such legacies as shall hereafter be allotted him to pay Item I give and bequeath unto my fourth son William the sum of Forty Pound Proc Money to be paid unto him within three years after my decease by my sons Theophilus and Edmund each the sum of twenty Pounds Item I give and bequeath unto my three Eldest Daughters now living namely Hannah. Mary. and Rebeckah all the rest of my moveable estate share and share alike Item I give and bequeath unto my Fourth Daughter Sarah the sum of Thirty Pounds to be paid unto her by my Theophilus when she shall arrive to the full age of eighteen years. Item I give and bequeath unto my Fifth Daughter Abigail the sum of Fifty Pounds to be paid unto her when she shall arrive to the full age of Eighteen years by my above named Son Edmund Lastly I do hereby appoint my well beloved Wife Mary Executrix and my sons Theophilus and Edmund joint Executors of this my last Will and Testament revoking and making void all former Will or Wills by me heretofore made, ratifying and confirming this and no other to be my Last Will and Testament In Witness whereof I have hereunto set my hand and Seal this Sixteenth day of July in the Year of our Lord One thousand Seven hundred and Sixty John Bainbridge The words (Sum of Fifty Pounds being first interlined between the 33 & 34 Line Seald & Deliverd in the presence of Rebeckah Burrowes (Mark) Martha Ellis Josiah Ellis Codicil, I John Bainbridge of Hopewell int he County of Hunterdon and Western Division of the Province of New Jersey do this Ninth Day of May in the year of our Lord One thousand Seven hundred and Sixty one make and Publish this my Codocil to my Last Will and Testament in manner following. That is to say and whereas I did give and bequeath by my said Last Will unto my Edmund One hundred and ten Acres of Land part thereof being on the West side of Jacobs creek and my said son Edmund being since Dead and I also did give my said Will unto my Son William the Sum of Forty Pounds. But now my Will is that my son William shall have all the Land on the West side of Jacobs Creek with all the Buildings and Improvements thereon in Lieu and instead of the Forty Pounds to him his Heirs and assigns forever, and all the rest and Residue of the said One hundred and ten Acres I give and bequeath unto my son Theophilus his Heirs & Assigns forever provided to pay unto my Daughter Abigail the sum of Fifty Pounds (which was to be paid to her by the aid Edmund Decd when she shall arrive to the Age of Eighteen Years, And lastly itis my Desire that this Present Codocil be annexed to and mad epart of my last Will and Testament to all intents and purposes In witness whereof I have hereunto set my hand and Seal the Day and Year First above written John Bainbridge the words and my said Son Edmund being since Dead being First interlined between the 5 and 6 lines Seald and Deliverd in the presence of Rebeca Burrowes (mark) Josiah Ellis Martha Ellis Josiah Ellis & Martha Ellis two of the witnesses --- --- Will and Codicil being duly sworn on the Holy Evangelist of Almighty God did depose that they saw John Bainbridge the Testator in the within annexed Will & Codicil named sign & seal the same to be his last Will & testament & the Codicil --- & that at the --- times of the doing thereof the Testator was of sound & Disposing mid & memory & understanding so far as they know & they verily believe & that at the several times of the --- Will & Codicil Rebecca Burroughs the other subscribing witness was present & signed her name as an Evidence to the sd Will & Codicil together with these Deponants at the request & in the presence of the Testator. Josiah Ellis Martha Ellis Sworn at Pennington in Hunterdon county March 5th 1765 before me Jaspr Smith Surrogate Mary Bainbridge & Theophilus Bainbridge the Executors within named being duly sworn on the Holy Evangelist of almighty God did depose that the within written Instrumetn contains the true last will and testament of John Bainbridge the Testator therein named so far as they know & as they verily believe & that the annexed Instrument contains the true last wil thereto & that they will well & duly perform the same by paying first the Debts of the deeased & then the legacies in the will & Codicil so far as the Goods Chattles and Credits of the said deceased can thereunto extend & that they will make & Exhibit into the Perogative at Burlington a true & perfect inventory of & singular the goods, chattles & credits of the sd deceased that have or shall come to their knowledge or possession or the possession of any person or persons for their use --- --- --- account --- thereunto law Mary Bainbridge (mark) Theophilus Bainbridge Sworn --- before me Jaspr Smith Surrgt.
