Wills John Phillips #1476J In the name of God Amen the thirty first Day of October in the Year of our Lord one thousand seven hundred and eighty I John Philips of Hopewell in the County of Hunterdon & State of N. Jersey, being sick and weak of body but of sound mind and memory thanks be given to God therefor; Calling to mind the mortality of my body & knowing that it is Appointed for all men Once to die do make and ordain this my last Will & Testament that is to say principally & first of all I give and recommend my Soul into the hands of God that gave it & my body I commit to the Earth to be buried in a christianly and decent manner at the discretion of my Executor, And as to such worldly goods wherewith it hath pleased God to bless me in this life I Give, Devise & dispose of the same in the following manner and form in the first place I Order and direct that all my just debts and funeral charges be paid by my Executors hereafter named as soon as may be after my decease ITEM I Give and bequeath unto my Eldest son Peter the sum of twenty shillings. Item I give unto my son John the Plantation on which he now lives together with all my right, title, interest thereunto in anywise appertaining or belonging tohim his heirs & assigns forever Item I give and bequeath unto my Youngest son Henry the Plantation on which I now dwell together with all my right title interest thereunto anywise appertaining or belonging to him his heirs & assigns forever only reserving the two square rod of ground where my late Wife is buried Willing and Requiring him the sd Henry to pay such sum or sums of money Yearly & every year as may enable my Exeuctor to pay the legacies hereafter name to my Daughters to Each of whom I give fifty Pounds Viz Lititia, Katy, Fanny, Polly, Rhoda & Sally to be paid in the Order in which they are here named that is the Eldest first --- until they are all paid also tis my Will that my Daughter Polly be made equal with her sisters as to the outset they respectively had at their marriages, besides the fifty pounds above mentioned; Also it is my Will that my Daughter Polly have the use of the two back rooms in my dwelling House as long as she remain in a single state I likewise give unto the sd Polly the remainder of my movable estate but if she dies without issue it is my Will that it be legally divided among her sisters - Firthermore I do hereby constitute make and Ordain my Eldest son Peter above named together with my son in law Theophilus Moore Executors of this my last Will and Testament who shall hereby be directed to take notice that the money to be paid in the legacies above mentioned to --- in it --- here in the year One thousand seven Hundred & Seventy four. Lastly I do hereby revoke and --- all Other former Wills, legacies and bequests by me anywise heretofore Willed & bequeathed, And do hereby ratify & confirm this and no other to be my last Will & Testament In Witness whereof I have hereunto set my hand and Seal this Day & Year Above John Phillips Sealed, Published Pronounced & Declared by the sd John Phillips as his last Will and Testament in Presence of John Smith Zebulon Burrows Jn Guild John Smith and Zebulon Burroes two of the witnesses to the within Will being duly sworn on the Holy Evangelists of Almighty God did severally depose and say that they and each of them saw John Phillips the Testator therein named sign and seal the same and hear him Publish, pronounce and Declare the within writingto be his Last Will and Testament and that at the doing thereof the said Testator was of sound and Disposing mind and Memory as far as these Deponents know and as they verily believe; and that John Guild the other subscribing Evidence was present at the same time and singed his name as a witness to the said will, together with these Deponents, in the presence of the said Testator. John Smith Zebulon Burrows Peter Phillips and Theophilus Moore --- being duly sworn on the Holy Evangelists of the Almighty God did severally Depose and say the within Instrument contains the true last will and testament of John Phillips the Testator therein named so far far as they or either of them know; and as they and each of them verily believe that they well and truly perofrm the same by paying first the Debts of the said Deceased and then the Legacies in the said Testament specified, so far as the Goods Chattels and Credits of the said deceased can thereunto ---; and that they will make and exhibit unto the Peroragative Office a true and perfect inventor of the all and singular the Goods Chattles and Credits of the said deceased that have or shall come to their or either of their knowledge or possession or the possession of any other person or person for their or either of their use and --- Just and true Account when thereunto Lawfully required Peter Phillips Theophilus Moore Sworn at Trenton 29th January 1789 Before me Rd.
