All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nj/njfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Nancie inTexas raggdollynmb@yahoo.com August 26, 2005, 12:20 am Source: Nj Archives File#1444j, Hunterdon Co Written: May 20, 1779 Will of David Stout (Son of Jonathan Stout) 1779 File#1444J, Liber/Volume B31, Pages 130-31 Hunterdon Co, New Jersey In the Name of God Amen This twentieth Day of May Anno Domeny one thousand seven hundred & seventy nine I David Stout of Hopewell in the County of Hunterdon and province of West New Jersey being weak in body although perfect sound and disposing mind and memory thanks be to God for the same and knowing that it is appointed for all men on[c]e to die and after that the judgment and calling to mind my own mortality do in the first place commit my soul into the hands of God who gave it hoping for mercy through the merit of Jesus Christ and my body I commit unto the earth from whence it was taken expecting to receive the same again at the general resurrection by the mighty power of God And as touching such worldly estate wherewith it pleased God to bless me in this life I do by this my Last Will and Testament give and bequeath in form & manner following that is to say Imprimus my Will is that all my just debts and funeral charges be paid by my Executors hereinafter named out of my moveable estate. Item I give and bequeath unto my well beloved wife Sarah all the household furniture that she brought with her at the time of my marriage with her and one mare one cow and calf six sheep and three bank notes for two hundred dollars each amounting in the whole to the sum of two hundred &twenty five pounds and twenty bushels of wheat out of the crop that’s now in the ground to my said wife in right and due(?) of dower Item I give and bequeath unto my oldest son Jonathan Stout the sum of five pounds in consideration of his birth right to be paid unto him by my hereafter named executors. Item I give and bequeath unto my son Andrew Stout one hundred & Sixty nine acres of land it being part of the Plaintation I now live on Beginning at the Northerly corner of said plaintation in the lines of my brother Benjamin Stouts land thence along the said line to (illegible) four rod rodes thence along said rodes to the corner of land in possession of John Stout thence along said Stout line Northwesterly to his corner thence Southwesterly on a parralal line to this line along the four rod roads as many chains as will make the compliment of acres herein demised by running a parrelal line with the first mentioned lines between my land and my brother Benjamin Stout to the lines between me and Joseph Stout thence along said lines to the places of beginning to him his heirs assigns forever – one acre excepted whereon my daughter Anne Merrill now lives with the building thereon during her natural life to be freely possessed by her during that time Item I give and bequeath unto my son David Stout and to his heirs and assigns forever all the remainder part of the Plaintation I now live on and also one eight day clock one wagon and geers one plough and harrow with the necessary geers hereunto belonging and all the grain on the ground except twenty bushels of wheat herein before given to my said wife and is to be delivered to her when she may call for the same and all the sider casks and sider mill and press I give unto my said son David for his own proper use Item I give and bequeath unto my son James Stout and to his heirs and assigns one certain lot of land adjoining to land that I have given him by Deed and containing one hundred and four acres as by the deed to me may more fully appear he my said son James or his heirs paying the sum of fifty pounds unto my daughter Hannah Wuof or to her heirs Item I give and bequeath unto my five daughters by name Elizabeth Anne Mary Sarah and Hannah all the remainder of my personal estate and it is my Will that the same be equally devided amongst my said five daughters or their heirs by my hereafter named executors by selling the same at Publick Sale or other ways as they may think proper Lastly I do hereby nominate and appoint my two sons Andrew Stout and David Stout Sole Executors of this my Last Will and Testament hereby revoking disallowing and disanuling all and every other former Wills & Testament legacies and executors (illegible word) heretofore made Willed or named confirming this and no other as my Last Will & Testament In witness whereof I have hereunto set my hand and seal the day and year first written David Stout (Signature) Signed Sealed published Pronounced and Declared By the Said David Stout In Presence of Nehemiah Stout Samuel Stout Jun’r Mary Saxton NMB Additional Comments: The wife Sarah mentioned in this will is his second wife.
