All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nj/njfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Nancie inTexas raggdollynmb@yahoo.com August 23, 2005, 7:39 pm Source: West Jersey Will Book 2, Pages 219-20 Written: November 24, 1722 Recorded: March 25, 1723 Will Record of Jonathan Stout West Jersey Will Book 2, Page 219-20, 1723 In the Name of God Amen Twenty-fourth Day of November in the Year of our Lord One Thousand Seven hundred and twenty two I Jonathan Stout of Hopewell in the County of Hunterdon in the Western Division of the Province of New Jersey Yeoman being Weak of Body but of Perfect Sense Memory & Understanding Thanks be to [God] Almighty for ye same Calling to Mind the Mortality of my Body and Knowing that it is appointed for all men once to Die Do make and ordain this my Last Will and Testament Principally and first of all I recommend my Soul into ye hands[that] gave it and my Body I recommend to the Earth to be Buried after a Decent & Christian Manner --- And as touching such worldly estate Wherewith God hath been pleased to bless me With in this Life I Give Devise and Dispose of in the following manner > > > > Imprimis - - - I will that my just debts and funeral Charges be paid and Discharged - - - Item - - - I will and Bequeath unto my Son Joseph Stout my daughter Sarah my daughter Hannah my son Benjamin and my son Zebulon each of them one shilling - - - Item - - - I allow my son Benjamin Stout the Tract of land which he now dwells on Containing Two hundred & fifty acres more or less with all the Rights Privileges & Appurtenances to him his heirs Execu’ts Administrators & Assigns forever - - - Item - - -I allow unto my son Jonathan Stout Two Tracts of Land the one Containing Three hundred Acres with allowance The other containing one hundred acres Both Lying and Being in ye Western Division of the province above s’td with all their Rights Priveleges & Appurtenances to him his heirs Execu’ts Adminis’ts and Assigns forever - - - Item - - - I give and bequeath unto my Three Sons Jonathan Stout David Stout and Samuel Stout the remaining part of one & all Equall & undivided sixteenth part of one Whole Property Lying in the Western Division in the Province Afores’d to them their Heirs Executors Administrators and Assigns for ever Equally divided among them and if it Should so happen that either of them Die without Issue then his Share or part shall be Divided Equally between the other Two and if it should happen That two of them Died Without Issue then Their Shares or Parts shall [?] Survivor - - - - Item - - - I give and Bequeath unto my Two sons David Stout and Samuell Stout the Plantation I Now Dwell on with all ye Privileges & appurtenances thereunto Belonging to Them Their Heirs Execu’ts adminis’ts and assigns for ever equally to be Divided Between them and my negro man named Silas - - - Item - - - I give and Bequeath unto my Daughter Ann Stout my Negro Girl called Dollmud (?) (several illegible words) Warming Pan one Chest of Draws one feather Bed and Bedding which she likes Best and the little girl Named Phoebe - - - Item - - - I Give and Bequeath unto my Son Jonathan Stout my Negro Girl Kade (?) and one Bed and Bedding - - - Item - - - I Give and Bequeath unto my son David Stout Two horses and one mare and one Bed and Bedding - - - Item - - - I give and Bequeath unto my son Samuel Stout one horse and one mare and colt and one feather Bed & Bedding (several illegible words) of the Remaining Part of all my Personal Estate - - - Item - - - I give and bequeath unto my son Jonathan Stout one fourth part of the Remaining part of all my Personal Estate - - - Item - - - I give and bequeath unto my son David Stout one equal fourth part of all the Remaining part of all my Personal Estate - - - Item - - - I give and bequeath unto my daughter Ann Stout one equall fourth part of all the remaining part of my Personal Estate - - - Item - - - I make and Ordain my True Trusty friend Andrew Smith my Executor to this my Last Will & Testament, and I hereby Revoake Anull and make void all Other Wills & Testaments by me made and allow this and no other to be my Last Will & Testament In witness whereof I have hereunto set my hand & Seal The day and year first above written Jonathan Stout (Seal) Signed Sealed & Delivered In the presence of Be it Remembered that on the Twenty fifth day of March in the year of our Lord One Thousand seven hundred twenty three the said Will and Testament of Jonathan Stout late of the County of Hunterdon Yeoman Dec’d was proven (?) form of law before me Samuel (illegible surname) Deputy Surrogate of the western Division of the Province of New Jersey duly commissioned and authorized for that purpose and administration and probate was granted unto Andrew Smith Executor in the said (illegible word) wills (illegible word) named and appointed he(?) going (illegible word) sworn on the Holy Evangelist of Almighty God well and truly to perform the same by paying first the debts and then the Legacies contained in the said will so far forth as the Goods Chattels and Credits of the said deceased will thereunto extend or the (illegible word) charge and also to exhibit a true and perfect inventory and to render a swift (illegible word) thereunto required. Given under the Prerogative and Seal of the Province of New Jersey at Burlington the Second day of April in the Nineth year of His Majesty’s Reign & Anno Dom One Thousand Seven hundred Twenty Three - - - Signed Jas Smith Secry [Note: there is a small question mark, made at a later date, along side the recorder’s entry of the signature which seems as though it should have been, Andrew Smith.] Entered by me Sam’ll Bussill(?)
