All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nj/njfiles.htm ************************************************ Will of John Bainbridge 83J In the Name of God Amen the Twelfth Day of February in the Year of Our Lord One Thousand Seven Hundred and Thirty two I John Bainbridge of Maidenhead in the County of Hunterdon and Province of New Jersey Gent: being very sick and weak in Body but of perfect mind and memory Thanks be given to God Therefore Calling unto mind the Mortality of my Body and Knowing that it is appointed for all men once to die Do make and ordain this my Last will and Testament That is to Say Principally and first of all I commend my Soul unto the Hands of God that gave it and for my body its is my Will and desire that it may be Buried in the Earth by the side of my Daughter Sarah's tomb in a Christian like and Decent manner at the Discretion of my Executors Nothing Doubting but at the General Resurrection to Receive the Same again by the Mighty power of God and Hoping to Receive free Remission of all my Sins Through the Blood and Merits of our Blessed Lord and Redeemer Jesus Christ and to Enjoy a Mansion in the Kingdom that the Righteous shall inherit. An it is also my Will and desire that my Executors hereafter named Do Cause a Tomb to be Erected over my Grave on it to be put the Day and Year of my Death and my age which was Seventy four Years the Second Day of November last and also a tomb to be erected over my Wives grave Who Died March the twenty fifth in the year 1732 in the Sixty Seventh year of her age and as touching such worldly Estate Wherewith it hat pleased God to Bless me in this Life I give Devise and Dispose of the same in the following manner and form Imprimis Item It is my will and I do order that in the first place all my Just Debts and Funeral Charges be paid and Satisfyed Item I give and Bequeath unto my Well beloved son Edmund Bainbridge the sum of one pound like mony as a --- said to be paid Item It is my Will and I do order that my Executors Shall Teach or Cause to be Taught to read and Write & arithmetic my Daughter Elizabeths eldest son Commonly known by the name of John Yard and that my Executors shall bind him to the Trade that he shall most Incline to Learn and I do also give and bequeath unto him the Said John Yard the sum of forty pounds Current money of Pennsylvania to be paid to him by my Executors at Two payments the first Twenty pounds to be paid to him When he shall arrive to the age of twenty two years and the other Twenty pounds to be paid to him When he shall arrive to the age of Twenty four Years Item I give and Bequeath unto my well Beloved Daughter Mary the Sum of Ten pounds like money as above said to be paid to her by my Executors two years after my Decease which said Ten pounds shall be at her own disposal without the consent of her husband Item I give and Bequeath unto my Well Beloved Daughter Rebeckah the Sum of Ten pounds Like money as abovesaid to be paid to her by me Executors in Three Years after my decease and to be Disposed of by her as She pleases Item I give and Bequeath unto my Well Beloved Daughter Elizabeth Twelve pounds Like money as abovesaid to be paid to her by my Executors at five payments Viz the first payment of three pounds to be paid to her in four years after my Decease and three pounds yearly after till all said Twelve pounds shall be paid unto her Item I give and Bequeath unto my Beloved Grandson Edmund Bainbridge Ten pounds Like money as abovesaid to be paid to him by my Executors When he shall arrive to the age of Twenty one years Item I give and Bequeath unto my Loving Kinsman Theophilus Phillips the sum of five pounds Like money as abovesaid: Whom I also Nominate Constitute and ordain to be one of the Executors of this my Last Will and Testament and I do also order that all Reasonable Charges and Expences shall be allowed out of my Estate that the Said Theophilus Phillips Shall be at in Executing or in Seeing this my Lastly Will and Testament Executed and fullfilled Item I give and Bequeath unto my Well Beloved Son John Bainbridge all the Remaining part of my Personal Estate Wheresoever or Whosoever hands the same or any part thereof may be found and also I give Devise and bequeath unto my said Son John Bainbridge and to his heirs and assigns forever the Remainder of a Sixteenth part of a Proprietary Right in West Jersey and Lastly I Constitute and ordain my Loving Kinsman Theophilus Phillips and Well Beloved Son John Bainbridge to be Executors of this my Last Will and Testament and I do hereby Disallow Revoke and Disannul all and every other former Testaments Wills Legacies and Executors by me in any wise before this time Named Willed or Bequeathed Ratifying and Confirming this and other to be my Last Will and Testament In Witness Whereof the Said John Bainbridge hath hereunto set his hand and Seal the Day and Year above written John Bainbridge Signed Sealed Published Pronounced and Declared by the Said John Bainbridge as his Las his Last Will and Testament in the presence of us the subscribers Stephen Jones William Phillips Joseph Phillips Stephen Jones and Joseph Phillips two of the Witnesses whose names are subscribed to the within written will being duly sworn on the Holy Evangelist of Almighty God did depose that they were present & saw John Bainbridge the Testator within named sign and seal & heard him publish pronounce & Declare the within written Instrument to be his last Will and Testament and that at the Time of the Doing thereof the Testator was of good sound Mind Memory & understanding to the best of these Deponents knowledge and Belief, and that immediately afterward they did subscribe their names as witnesses to the said Will in the presence of the Testator and that at the same time also William Phillips the other subscribing witness was present & did subscribe his Name as a Witness to the sealing & publishing of the within Will be the--- Testator in his presence & in the same Room where the said Testator then executed the same, and --- Stephen Jones and Joseph Phillips so thereto subscribed is & are the proper Hand Writing --- ---- of these Deponents --- and --- the --- William Phillips also subscribed as a Witness with these Deponents to the Execution of the within Will is also of the proper Hand Writing of the said William Phillips. And the said Stephen Jones one of these Deponents doth further depose the Words Viz [Item I give and bequeath unto my well beloved son Edmund Bainbridge the Sum of One pound like money as abovesaid to be paid] inserted between the thirteenth & fourteenth Lines were so inserted by this inserted by this Deponent before the Signing & publishing of the within Will be the by the express order & Direction of the within Testator. Stephen Jones Joseph Phillips Sworn at Burlington the first Day of March 1732 before me Saml. Bustill Reg. Theophilus Phillips and John Bainbridge the Executors within named being solemnly sworn on the holy Evangelist s of almighty God did depose that the within Writing contains the true last Will :& testament of John Bainbridge the Testator therein named as far as the know & believe & that they will well & truly perform the same by paying first the Debts of the Deceased & then the Legacys contained in the within Will so far as the Goods chattells & Credits of the said Deced can thereunto extend or the Law require & that they will make & exhibit a true & perfect Inventory of all & singular the Goods Chattells & Credits of the said Deced that shall come to their knowledge possession or to the possession or knowledge of any other person for their use into the prerogative Court in the Secretary's Office at Burlington & also render a just Account when thereunto required (signatures not photocopied) An Inventory of the Moveable Estate of John Bainbridge Senr. One thousand seven hudnred and thirty tow before me Samuel Bustill Registor for the Western Divison of the province of New JErsey Solemnly sowrn upon the holy Evangelist sof Almighty God did make oath that the Goods Chattels & Creditts in the above Inventory set Down and specified were by them appraised according to their Just and true respective rates and values after the best of their Judgment and understanding and the Judgment and understanding of Each of them respectively and that they appraised all things that were brought to their view for appraisement.
