This file was contributed for use in the USGenWeb Archives by: Donna Evans Dbepre@aol.com ==================================================================== Last Will and Testament of Thomas Smith Dated Dec. 12, 1897 6088K Proved March 11, 1898 Recorded in Book I of Wills, Fol 289 & c Surrogate's Office, Mercer County IN the Name of God, Amen, I Thomas Smith of the City of Trenton in the County of Mercer and State of New Jersey. being of soudn and disposing mind and memory, do make & publish this my last will and testament, And as to my worldly estate, and all the property, real, personal, or mixed of which I die seized and possessed, or to which I shall be entitled at the ttime of my decease, I devise bequeath and dispose tehreof in the manner following to wit: First. My will is, that all my just debts and funeral expenses, shall be by my Executrix hereinafter named, be paid out of my Estate, as soon after my decease as shall by her be found convenient. Second. I give deveise and bequeath to my beloved wife Bridget Smith my lot of land situate in Humboldt Street in teh City of Trenton Count and State aforesaid and also the six acres of land situate in Hamilton Township County and State of New JErsey and their appurtancences, and all the profits, income and advantages that may result therefrom, from and after my decease, to have and to hold the same to the said Bridget Smith, her heirs and assigns, to her and their benefit forever. Third. I give and bequeath to my beloved wife Bridget Smith, the three houses known as nos. 53, 55 and 57 Poplar Street in the City of Trenton County and State aforesaid, and their appurtenances, and all the profits, income and advantages that may result therefrom, from and after my decease, to have and hold the same for the term of her natural life, and after her death to be disposed of in the manner hereinafter provided. Fourth. I give, devise and bequeath to my daughter Annie Connoly aftert the death of my wife my house known as No. 53 Poplar Street int he City of Trenton, County and State aforesaid with its appurtenancnes, and all the profits, income and advantage that may resilt therefrom, to hae and hold the same for the term or her natural live, and after her death the same to revert to her children. Fifth. I give, devise and bequeath to my son Robert Smith, after the death of my wife my house known as No. 55 Poplar Street in the City of Trenton County and State aforesaid, and its appurtenances, and all the profits, income, and advantages that may result thereefrom, from and after the decease of my wife aforesaid. Sixth. I give, devise and bequeath to m;y daugher Julia Smith and William Higgins, son of my wife from a prior marriage my house know as No. 57 Poplar Street in the City of Trenton County and State aforesaid, and its appurtenances, and all the profits, income, and advantage that may result thereforem, from and after the decease of my wife as aforesaid, to hae and to hold the same to the siad Julia Smith and William Higgins their heirs and assigns, to their use and benefit forever. Seventh. I do nominate and apoint my beloved wife Bridget Smith, sole Executrix of this my last will and testament. In witness whereof, I the said Thomas Smith, have hereunder set my hand this Twelfth day of December Eighteen hundred and ninety seven Thomas Smith (his mark) Signed, Acknowledged and declared by the said Thomas Smith, as and for his last will and testament, in the presence of us (both being present at the same time) who, at his request, in his presence, and in the presence of each other, have hereunto subscribed our names as witnesses. Solan one of the witnesses to the annexed writing, purporting to be the last Will and Testament of Thomas Smith deceased, the Testator therein named, being duly sworn doth depose and say, that he saw the said Testator sign and seal the same, and heard him publish and declare it to be his last Will and Testament; that at the time of the doing thereof, the said Testator was of sound and disposing mind, memory and understanding, as far as this deponent knows, and as he verily believes, and that Bridget F. Burns the other subscribing witness thereto, was present at the same time with this deponent and that they together subscribed their names thereto as witnesses, in the presence of the Testator, and of each other. Bridget Smith the Executrix in the annexed writing named, being duly sworn doth depose and say, that the annexed writing contains the true last Will and Testament of Thomas Smith deceased, the Testator therein named, as far as she knows, and as she verily believes; that she will, as the Executrix thereof, well and truly perform the same, by paying first the debts of the said deceased, and then the legacies therein specified, as far as the Goods, Chattels and Credits of the said deceased can thereunto extend; that she will make and exhibit into the Surrogate's Office of the County of Mercer, a true and perfect inventory of all and singular the Goods, Chattels and Credits of the said deceased that have or shall come to her possession or knowledge, or the possession of any other person or persons for his use; and that he will well and truly account when thereunto lawfully required; and that said Testator died more than ten days ago, to wit, on the 3rd day of January A.D. 1898 Bridget Smith (her mark) Sworn and subscribed this 11th day of March, 1898, before me Chas.
