From: New Jersey State Archives 5 West State Street, CN307 Trenton, New Jersey, 08625-0307 Deed Book H-2, pages 415-417 Gawen Drummond to Theophilus Longstreet , 30 Jan 1744/45 This Indenture made this thirtieth day of January in the year of our Lord One thousand seven hundred and forty four Between Gawin Drummond of the Town of Shrewsbury in the County of Monmouth and the Eastern Division of the Province of New Jersey, yeoman, Eldest Son and Heir at Law to his loving Father Gawin Drummond, late of the said Shrewsbury, Deceased, of the one Part and Theophilus Longstreet of the said Shrewsbury, Yeoman, of the other part . Witnesseth that he the said Gawin Drummond for and in Consideration of the Sum of Seven hundred and ninety four pounds current money at eight shillings the ounce, to him in hand paid by the said Theophilus Longstreet at and before the Sealing and Delivery hereof, the receipt whereof the said Gawin Drummond doth hereby Confess and acknowledge and himself therewith to be fully satisfied, contented, and paid Hath granted, bargained, and Sold,And by these Presents doth fully, freely, clearly, & absolutely Grant, Bargain and Sell, alien, Enfeoff, Release, assure, Convey and Confirm unto him the said Theophilus Longstreet, his Heirs and assigns forever All that Tract of Land Scituate lying and being in the said Town at a place called Loch- arbor. Beginning at a Red Oak Sapling marked on four sides,being the South East corner of Thomas Woolley's Land eleven Chains from Potter's Cellar on the South Side of Poplar Swamp brook thence South and by East to Hog Swamp brook( being the Northerly branch of White's or Drummond's Pond ) thence up the same brook to Mopie Swamp thence Mopie Swamp to said Thomas Woolley's line thence down his line to where it began. Bounded Northerly by said Thomas Woolley, Easterly by John Drummond, Southerly by said Hog Swamp brook and Westerly by said Mopie Swamp and said Thomas Woolley ( Except one quarter of an Acre of Land joyning to said Drummond's Saw Mill Dam on said Hog Swamp Brook for the repairing his said Dam with the Ground the Pond Covers when it is full ) Also another Tract of Land being a Neck called the Iron Well Neck Scituate between the branches of the aforesaid White's Pond. Beginning at the head of a Small Gully on the Westerly Side of the said Northerly Branch of said White's Pond, called Hog Swamp Brook as aforesaid, a double Dogwood Tree marked on four sides, standing within a Rod from said beginning, South West from it, thence South forty seven degrees and thirty minutes West fourteen Chain and forty eight links thence South forty degrees East twenty nine Chain to a Chestnut Sapling marked on four sides, a white Oak Tree within a Rod of it being also so marked, both said Trees standing on the Westerly side of the head of a Cove or Creek called the Iron Well Creek running into said White's Pond near a well or Spring at the head of said Cove called the Iron Well, thence on this same Course to the East side of said Cove thence following the said Iron Well Cove or Creek to the place where it runs into said White's Pond thence up the said Northerly branch of said White's Pond to the Mouth of the first mentioned Gully thence up the same to where it began. Bounded Westerly by said Gawin Drummond, Southerly by him and said Iron Well Creek, Easterly and Northerly by said Northerly branch and the first mentioned Gully. Both which said Tracts Descended and fell to the said Gawin Drummond ,his said Father Dying intestate. Together also with all and all manner of Improvements, feeding Pasture, Trees, Woods, Runs, Brooks, Springs, fishings, fowlings, huntings, Profits, advantages, Liberties, heriditaments, & appurtenances whatsoever to the said Tracts or either of them belonging or anywise appertaining with all the Right, Estate, Title, Interest, property, possession, Claim, and Demand whatsoever of him the said Gawin Drummond both in Law and Equity and either of them of in or to the same and every part of them To Have and to Hold the above Granted Tracts of Land and every part of them ( Except the above Exception ) with all and Singular the Priviledges and appurtenances of right or custom to them or either of their belonging or appertaining unto him the said Theophilus Longstreet his Heirs and Assigns and to his and their only uses and uses benefit, Profit, advantage, and behoof forever. And he the said Gawin Drummond for himself, his Heirs, Executors, and administrators and every of them doth Covenant, Promise, Grant, and agree to and with him the said Theophilus Longstreet, his Heirs and assigns firmly by these Presents that he the said Gawin Drummond at the time of the Sealing and Delivery hereof hath in himself good, sure, rightfull Power and absolute lawful Authority to Grant, Sell, and Confirm the above Granted Tracts of Land and every part of them with their and every of their appurtenances unto him the said Theophilus Longstreet, his Heirs and assigns forever and that the said Tracts and every part of them with all and every of their appurtenances are now and shall forever hereafter remain free and clear unto him the said Theophilus Longstreet, his Heirs and assigns from all manner of former Gifts, Grants, Sales, Leases, Exchanges, Mortgages, Judgments, attachments, Exductions, or any other Trouble, Charge, or Incumbrance whatsoever in the Title or Possession thereof committed or done by him the said Gawin Drummond or by his knowledge, means, negligence, or procurement so as to alter, change, charge, limit, defeat, determine, or make void his above bargain and Sale ( the Proprietors Quit Rents if any be that shall hereafter become due only excepted ). And that the above Granted Premises and every part of them with the appurtenances ( Except where before Excepted ) unto him the said Theophilus Longstreet, his Heirs and assigns in their quiet and peaceable Possession and Seizn and to his and their only proper use and uses benefit and behoof against the just Right, lawful Claim, Challenge, or Demand of all Persons Shall and will Warrant and forever hereafter defend by virtue of these Presents. In Witness whereof the Party first above named to these Presents hath hereunto set his Hand and Seal the day and year first above written. And in the Eighteenth year of His Majesty King George the Second's Reign or 1744/5 Signed, Sealled, and Delivered signed Gawin Drummond (Seal) in the presence of Jacob Dennis Gisbert Longstreet Samuel Bennit Jr Elisha Salta Anthony Dennis Richard (his mark: "D") Longstreet December 23, 1745 Be it Remembered that on the day and year above written Jacob Dennis one of the subscribing witnesses to the within Instrument personally came and appeared before Robert Hunter Morris, Chief Justice of New Jersey, and being duly Sworn on the holy Evangelists of Almighty God on his Oath did Declare that he was present and Saw Gawen Drummond party to the within Instrument Sign Seal and as his voluntary Act and Deed Deliver the Same for the uses therein mentioned and I having Inspected the said Deed do allow it to be Recorded. * (signed) Robt. Barlow Sr. NOTE: 31 Mar 1996, The White's Pond mentioned in the above deed is now called Deal Lake. Poplar Swamp Brook is now called Poplar Brook. Hog Swamp Brook is now called Harvey Brook. Deal Lake lies between Asbury Park and Deal, New Jersey.The first tract of land mentioned in the deed above is where Deal Park and Golf Course are now located. This tract was sold to Amos White by Theophilus Longstreet within a year after he bought it from Gawen Drummond. The second tract of land in the deed above was located where Interlaken or West Allenhurst, New Jersey now stand. I can't tell for certain which one because there are two necks of land and I don't know which was Iron Well Neck. The 1744 date of this deed is 1745 by our current calendar. Howard C. Kelley
