I direct the payment of all my just debts and funeral expenses, as soon as conveniently can be done after my decease. Secondly. I give and bequeath to my wife all my household furniture, cooking utensils, & crockery. Thirdly. I give, devise and bequeath unto my beloved wife, Emily, all my remaining estate, both real and personal, in whatever it may consist, or wherever situate, to have, hold, receive, use and enjoy the rents, issues, and profits thereof during the term of her natural life, if she so long remains my widow; and from and after her decease, or her again marrying, I give, devise and bequeath my said estate unto such child or children as I shall leave or have living at the time of my decease, and to their heirs and assigns forever, and the representatives of any deceased child to have the share of his, her or their parent. Fourthly I hereby nominate, constitute and appoint my friend, Harry D Wilson and my cousin, John J Lowden, the executors of this my last will and testament, and I hereby give to them and the survivor of them full power and authority to grant, bargain, sell and convey any or all my real estate, at public or private sale, at such time and upon such terms and in such manner as to them shall seem meet. Lastly. I give, devise and bequeath unto my mother, Fannie L. Kidd, all the right, title and interest and share which I have in and to the burial lot of my father John Kidd, deceased, situate in Evergreen Cemetery, near Elizabeth, New Jersey, and I hereby enjoin my executors to see that, in the event of my mother's death, her body shall be interred in said plot. I also order my executors to cause my mother's epitaph ^to be put on the monument in said plot, and to cause her body to be buried next to that of my sister Jennie, if the space is not taken up, and if it is, then I order them to disinter the body of my said sister, and bury her body & that of my mother in the same grave my said sister's body now occupies. I hereby authorize my executors to pay out of my estate such sum as may be necessary to carry into effect this section. I hereby appoint my said wife, the guardian of the persons and estates of my child or children which I may leave. In witness whereof, I have hereunto set my hand and seal this twelfth day of October, in the year of Our Lord One thousand eight hundred and eighty seven. Lewis M. Tillie Leyerer one of the witnesses to the annexed writing, pruporting to be being duly sworn, says that since the making of the annexed Will she married one Rudolph Leyerer that she saw the said Testator sign and seal the said annexed writing, and heard him publish, pronounce, and declare the same as and for his last Will and Testament. That at the same time of the doing thereof, the said testator was upwards of the age of twenty-one years, and of sound disposing mind, memory, and understanding, so far as this deponent knows, and as she verily believes; that Charles E. Wetton who is now deceased, the other subscribing witness thereto was present at the same time with this deponent, and that he and this deponent subscribed their names thereunto as witnesses in the presence of the Testator and of each other, at the request of the said Testator. Sworn before me this 14th day of November A.D. 1907 at Elizabeth> Tillie Leyerer Geo. T. Parrot, Surrogate Union County SS. Ottilie Macdonald being duly sworn says, that the annexed writing contains the true last will and Testament of Lewis M Kidd the Testator therein named, deceased, as far as she knows and as she verily believes, that she will as the administratratrix with said will annexed, well and truly perform the same, first by paying the debts of said deceased, and then the legacies therein specified as far as the Goods, Chattels and Credits of said deceased will thereunto extend, and the law charges; that she will make and exhibit unto the Surrogate's Office of the County of Union a true and perfect inventory of all and singular the said Goods, Chattels and Credits, as far as the same have or shall come to her possession or knowledge, or to the possession of any other person or persons to her use, to her knowledge and that she will well and truly administer all and singular the goods, Chattels, rights and credits of the deceased that shall come to her possession or knowledge or to the possession of any other person to her use. And that she will well and truly account when thereunto lawfully required, and that she said Testator died on the 17th day of June A.D. 1907. Sworn before me this eighth day of November A.D. 1907, at Elizabeth > Ottilie Macdonald. Geo. T. Parrot, Surrogate. Union County Surrogate's Office In the Matter of the Last Will and Testament of Lewis M. Kidd, deceased. Order for Probate Application having been made to me by Ottilie MacDonald for probate of the last will of Lewis M Kidd deceased, and letters of administration with the will annexed, and no caveat having been filed against admitting said will, and the deposition of Tillie Leyerer (formerly Lorentz) one of the subscribing witnesses to the same having been duly taken, and it appearing to me upon such proof that the will produced was duly executed according to law, and that more than ten days have elapsed since the death of the testator, it is, on this fourteenth day of November, nineteen hundred and seven, ordered and adjudged that the said will be and the same is hereby established as the last will and testament of said deceased, and that the same shall be and is admitted to probate, and that letters of Administration with said will annexed be issued to Ottilie MacDonald on her first filing bond in this office in the sum of ten thousand dollars. T Parrot, Surrogate State of New Jersey Union County Surrogate's Office To all to whom these presents shall come, greeting: Whereas Lewis M Kidd, residing at Jaral, Mexico, late of the County of Union, in the State of New Jersey, departed this life, having made and executed a last will and testament, which has been duly proved, according to law, before the Surrogate of the County of Union; and, whereas, the executors named therein have departed this life-- Therefore, I, George T. Parrot, Surrogate of the County of Union, do hereby appoint Ottilie Macdonald Administratrix of all and singular the goods, chattels and credits of said deceased, who is duly authorized to administer the same agreeably to said will. Additional Comments: Lewis M Kidd, born about 1861, was the son of John Kidd (1813-1875) and his second wife Fannie.
