He had delivered a load of wood at Smith’s yard near the depot and went to the office to settle with Smith. The side-track run directly in front of Smith’s office. After a settlement Schmartz started away, and was crossing the track just as the switch engine was pushing a freight car over it. Parties endeavored to warn the unfortunate man of his danger, but he either did not hear them or was so deeply absorbed in thought that he did not heed the warning. He did not notice the car until it struck him. He was knocked down and the wheel of one truck passed over his leg, crushing it in a horrible manner from the thigh to the ankle. The limb was amputated, but he died a few minutes after the operation was performed. He leaves a wife and four children in Silver City, where he resided.
