credits within this State by means whereof the proving and registering the said will and the granting administration of all and singular the said goods chattels and credits and also the auditing allowing and final discharging the account thereof doth belong unto us the administration of all and singular the goods chattels and credits of the said deceased and any way concerning his will is granted unto Hannah Clench an Executrix in the said will named she being first duly sworn well and faithfully to administer the same and to make and exhibit a true and perfect Inventory of all and singular the goods chattels and credits and also to render a just and true account there of when thereunto required In Testimony whereof we have caused the seal of our Court of Probate to be hereunto affixed Witness Thomas Tredwell Esquire Judge of our said court at Rumbout in the county of Dutchess the third day of January one thousand seven hundred and eighty two Joseph Hazard Clk In the Name of God Amen the tenth day of September in the year of our Lord one thousand seven hundred and eighty one I Robert Clinch of the town of Schonectady in the County of Albany and State of New York being of perfect mind and memory blessed be God therefore but considering the frailty and fragility Fragility of this life the certainty of death and the uncertain time and hour therefore do ordain and publish this my last will and testament that is to say principally and first of all I give and recommend my immortal soul after its departure out of this frail body into the mercifull hands of God that gave it me hoping and trusting for pardon of my sins and transgressions in and thro' the meritorious death and passion of the blessed son of God Jesus Christ our Saviour and Redeemer and as for my body I recommend to the earth to be buried in a christian like manner at the discretion of my executors hereinafter named and for such worldly estate wherewith it hath pleased God to bless me with in this life after my just debts and funeral charges are paid I give devise and dispose of the same in following manner and form Imprimis I give and devise unto my eldest son Ralph his heirs and assigns one Spanish milled dollar wherewith he must be satisfyed and make no further pretance or demand to any part of my estate real or personal by right of Promageniture Item I give devise and bequeath unto my second son Benjamin and his heirs and assigns also the sum of one dollar wherewith he is to be satisifyed and make no further pretensions to any part of my estate real or personal Item I give unto my dear and loving wife all the rest residue and remainder of my estate real and personal to dispose of the same with the council and advice of my executors herein after named to the best advantage for herself and my four other children namely Rebecca Thomas Elizabeth and Euretta Item I also request and desire that if either of my sons Ralph or Benjamin should be in want that my dear wife shall assist them with as much money or anything else as she may think proper and necessary it is also my request and desire that if either of my four children Rebecca Thomas Elizabeth or Euretta should get married that my loving wife shall give either of them in that case an out sett of such things & to as great an amount in value as she may find herself able to give out of my estate without distressing or defrauding herself and the rest of the children Item I also desire and request that if my dear and loving wife Hannah should remarry that the whole of my estate both real and personal be divided amongst my wife and four younger children namely Rebeca Thomas Elizabeth and Euretta in the manner following two shares to my wife and to each of my four children one with the advice council and assistance of my executors herein after named Item I also desire and request that if any of my four younger children should die before marriage that the share each one shall fall upon the three surviving ones to be equally divided amongst them It is also my desire that as long as my brother in law Mr John Vernon shall chuse that his little daughter Polly now living with me shall continue that she stays aling with my dear and loving wife Finally and lastly I do hereby nominate and appoint Mr John Brown and Mr James Ellice both of Schoncetady together with my dear and loving wife Hannah executors to this my last will and testament hereby revoking all former will or wills by me heretofore made In Witness whereof I have hereunto set my hand and seal the day and year first above written Robert Clinch (S.S.) Signed sealed published and declared by the testator as his last will and testament in the presence of us Harmanus Bradt Henry Glen Wm Van Ingen Albany County P: Be it Remembered that on the twenty first day of december one thousand seven hundred and eighty one personally came and appeared before Jn De Peyster Surrogate of the said county Henry Glen Esq of the said County and being duly sworn on his oath declared that he did see Robert Clinch sign & seal the within written instrument purporting to be the will of the said Robert Clinch bearing date the tenth day of September in the year one thousand seven hundred and eighty one and heard him publish & declare the same as and for his last will & testament that at the time thereof of he the said Robert Clinch was of sound disposing mind and memory to the best of the knowledge and belief of them the deponent and And that his name subscribed to the said will is of his respective proper handwriting which he subscribed as witness to the said will in the testators presence & that he ye deponent saw Harmanas Bradt & Wm Van Ingen the other witnesses to the said will subscribe their names as witnesses thereto in the testators presence Jn De Peyster - Surrogate
