Weatherwax on January 18,2006 Notes Lourance Weatherwax (Wederwax on document) was the son of Andrew Weatherwax b:1739 and wife Catharina Reisdorff of Rensselaer co. N.Y. he married Anna Milliussun c:1784. This couple had 13 known children. Page: 1 The last Will and testament of Lourance Wederwax proved and recorded, Oct. 9th,1844 ,as a Will relating to both real and personal estate. In the name of God Amen. I Lourance Wederwax of the town of Watervliet in the county of Albany and state of New York being in good health and of perfect sound mind and memory. Blessed be almighty God for the same, but considering the uncertainty of this Mortal life. I do make Publish and declare this my last Will and testament in Manor [sic] and in form following to wit: First I Will that all my just debts and funeral expenses be duly satisfied and paid in some convienent time after my decease, by my sons: Basteyaen and Abraham for in consideration of the devise hereinafter made to them. Item I will that all my wearing apparal be equally divided among all my sons. Namely: Andries, Jacob, Adam, Basteyaen, George, Leonard & Abraham at the expiration of six weeks after my decease. Item: I give and bequeath to my beloved wife Anne for and during her natural life or so long as she shall remain my widow, all my dwelling house, barn and farm of land wherein I now live situate, lying and being in the town of Watervliet. I also give and bequeath unto my said wife all her wearing apparal, One bed bedstead and beding thereto belonging also one good horse and my single waygon and also as much more household furnitue as she may necessarily want to make her comfortable for and during her natural life or so long as she shall remain my widow. Item: and immediately after the decease or remarriage of my said wife which shall first happen I give devise and bequaeth to my son Basteyean and to hisheirs the North half of my farm as I have caused the same to be surveyed and is represented by the dotted lines on the annexed map except for one acre and three tenths set off for my son Leonard together with the prevelege of two acres of wood on the southeast part as the same is marked with the letter A on the said map. With the express terms and conditions that my said son Basteyean shall pay the sum of Four Hundred and Fifty dollars to my said sons: Andries, Jacob, Adam, George, and my daughter Catherine wife of John Fellers, Anne wife of Zachariah Craver; Maria wife of Jacob Bulson, Margaret wife of George Freligh; and Lana unmarried to be by them equally divided and to be paid in the following manor to wit: One hundred dollars on one year after the decease or remarriage of my said wife. One hundred dollars in two years, One Hundred dollars in three years, and One Hundred and Fifty dollars making the whole sum in four years and to their heairs to hold the same to my said so Basteyean and his heirs and assigns Item: and immediately after the decease or remarriage of my saif wife which shall first happen. I give devise & bequeath to my son Abraham all my dwelling house & barn to gether with the south half of my farm as I caused the same to be sureyed and is represented by the dotted lines on the annexed map/ except two acres of hard wood on the north east part as the same is marked with the letter B on the said map for my son Leonard on the express term and condition that my saidson. Abraham shall pay the sum of Four Hundred and fifty dollars to my son Andries, Jacob, Abraham, George, and my daughters: Catherine wife of John Fellers; Anne wife of Zachariah Craver; Maria wife of Jacob Bulson; Margaret wife of George Freligh and Lana unmarried to be y them equally divided and to be paid in the following manor to wit: One Hundred Dollars in one year after the decease of remarriage of my siad wife. One hundred dollars in two years. One Hundred dollars in three years and One Hundred and fifty dollars making the whole sum in four years and the their heirs to hold hold the same to my said son Abraham and to his heirs and assigns. Item: I give devise and bequeath to my son Leonard all that dwelling house and lot of ground whereon he now lives lying in the North Westerly corner of my farm and contains one acre and three tenths of an acre of land. To hold the same to my said son Leonard and his heirs and asigns. I also give to my said son Leonard four acres of wood land marked A&B on the annexed map the wood & timber to be used exclusively for his own fencing & fuel and not to sell or commit any wast of wood on said wood lot and whenever my said son Leonard shall feel disposed to sell the said woodlot that then he shall give the refused to his brothers Basteyean, and Abraham who shall take cash two acres at twenty five dollars per acre. Item: I will that all my personal property/ except as above excepted for my wife be equally divided among all my children share and share alike at the expiration of six weeks after my decease and that the wearing apparal of my said wife shall be equally divided among my daugters at the expiration of six weeks after her decease and lastly I do hereby nominate, constitute and appoint my beloved wife Anne as executrix my son Basteyean Wederwax and John Fellers executors to this my last Will and testament hereby utterly revoking disannuling and making void all other and former Wills legacies by me made. Ratifying this and no other to be my last Will and testamment In witness whereof I have herunto set my hand and seal this third day of July in the year of our Lord one thousand eight hundred and thirty signed sealed published and declared by the above named his Lourance Wederwax to be his last Will and Testament in the presence of us who have hereunto subscribed our names as witnesses In the presence of the Testator and presence of each other Lourance x Wederwax [LS] mark N.B. the word (Andries) between the 27th and 28 lines & the word (Leonard) between the 33rd & 34th lines were interlined before signing. Additional Comments: Lourance's Will was probated on 9 Oct 1844 so his death was before that date. Death record not yet located by this researcher. Three of his sons would migrate onto Coshocton ,co. Ohio: Andrew, George, Leonard.
