NY Will Book, old Vol. 1 page 2 The Last Will & Testament of Johannes Wendel In the Name of God, Amen The three & twentieth day of November 1691 in the ye third year of the Reign of our most gracious Souveraign Lord and Lady William and Mary ye grace of God of England, Scotland, France and Ireland, King and Queen. I, Johannes Wendel of ye City of Albany, merchant althogh weake and sickly in body yett of good Perfect and Sound Memory Praised be almighty God therefore do make and ordain this my present will and Testament in manner and forme following, that is to say first I commend myselfe and all my whole Estate to ye mercy and protexion of almighty God being fully persuaded by his holy Spirit through ye death and pain of Jesus christ to obtain full pardon and Remission of all my sinns and to Inherit Everlasting life to which ye holy Trinity One Eternall Dey to all honnour and glory forever amen and touching such temporall Estate oft lands house goods chattells & debts as ye Lord hath been Pleased far above my deserts to bestow upon, I do order give and bequeave and dispoe ye same in manner & form following. Imp. my will is ye my well beloved wife Elisabeth Wendel shall have keep hold & possess my whole Estate both lands houses lotts goods and chattels and all other moveables during her natural life, out of which shee is to bring up educate and maintain my eleven children to wit, Elsieen [sic], Martie Wendel begotten by my first wife Martie Jillis, to which two daughters my wife is to pay asoon as they come age of and maried the hundred forty Bovon and ye moveables due to them for their mother's portion or inheritance according to ye instrument made thereof which I will shall take its effect to all intents & purposes & moreover have an equal share of my estate with my other children & also to bring ye educate & maintain my nine children begotten by Elisabeth my present wife called Abraham, Sussana, Catelyntie, Elisabeth, Johannes, Ephraim, Isaak, Sarah and Jacob Wendel and such other children as it shall please God to send me by her till they shall indvally come to age o rbe maried. But if my wife shall happen to remarry then my will is that shee give and exhibite a perfect inventory upon oath of all ye whole Estate Reall and personall which is to be apprized indifferent indiviousmen and equally divided one moysty [sic] thereof for ye whoole of my said eleven children whcih said half I will to be equally divided among them or so many of them as they shall be alive and ye other moysty [sic] for my said well beloved wife which portions of my sd children shee is to keep till they come to age or be maried she giving sufficient security for ye same, provided ye lands and houses be also aprized and aloted to my sonnes as hereafter is specifyed they being accountable to ye other children what ye sd lands shall be valued above their proportion in ye estate vizt. I doe give and bequeve to my Eldest sonne Abraham & to his heirs forever all my seventh part of ye land commonly called Sarachtoge my share being that farme ye lye to ye south ward of ye fish brook whcih separates ye land of Robt Livingston & mine, being bounded on ye south by [....] with my proportion of wood land belonging thereunto, always provided ye same be apprized by indifferent persones when he shall com eto age or be married he paying ye surplusage what it shall be more valued then his portio to the ye children. I doe give and bequeave to my sonne Johannes to his heirs forever all my land commonly called Heenarabia on ye east side of Hudsons River with all ye hosues barnes orchards and other appertunances, ye island called Walvis Island and all other belonging to ye sd tract of land which to be aprized when he comes to age and if the apprizement amount ot more then his equall share in my estate he is to pay it to ye children to make them equall. I doe give & bequave to my sonne Ephraim & to his heirs forever all my part share and portion of ye land called Sclinkenbergh both at ye ... and upon ye flatt or plain, which is also to be apprized as ye other land abovementioned, and if ye aprizement amount ot more then his equall proportion in ye Estate he is to pay it to ye other children to make them equall with him... my will is further ye if any of ye sd tracts of land bequeathed to my sonnes afordsd should be apprized less then there portions in ye Estate ye so much of ye estate to ... them to make it up with ye rest of children. I doe give and bequave unto my well beloved wife my dwelling house where I now live scituate & living between ye widow of Jacob Sanders Glen & Dr. Davitte Schuyler whcih is to be apprized and .... out of moysty [sic] of ye Estate when she is to have and if she should remain widow she is to keep hold enjoy & possess ye whol Estate during her natural life and to give to my said children such portions & other lott as she shall ... meet and convenient when they come to age or be married and after my wife's deceased, ye whol eestate reall & personall to be equally divided amongst my sonns & daughters excepting ye I doe give to my eldest sonne Abraham Wendel ye some of three pounds currant money of this province besides his portio nwith ye rest of my children wherewith is to best satisified of amy protonces ye he might make for being my eldest sonne and shaw then as ye other does, and whereas I have ordered my three sones Abraham, Johannes & Ephraim land for their portions as above ais expressed of any of ye sd sonnes should haps to dye before they come to then my sones Isaak & Jaocb successively to have ye same on ye sd condition. Lastly I do make constitute ordain and apoint my deer and well beloved wife sole executrix of this my last will & Testament who is to have ye administratio of all my goods and chattels as adxes by ye laws of this Government are admitted to do and I do nominate and appoint my beloved bro in law [brother in law] Mr. Jacob Stadts [Staats?] & Mr. Johannes Lansing to witness and trustees over my sd wife & children & to aid & assist my wife in ye administration of ye estate.
