Second: I give, devise and bequeath to my beloved wife, Ellen German, the use, rents, issues and profits of all my estate, real and personal of which I may die seized and possessed for and during the term of her natural life, with power to sell the said personal or any part thereof and invest the proceeds thereof in good securities or in kind. This devise and bequest to be in lieu of dower and thirds. Third: From and after her death, I give, devise and bequeath all the residue and remainder of my estate both real and personal, to my children, John C. German, Helen M. Hills and Margaret E. King and their heirs forever, share and share alike. Fourth: I hereby nominate, constitute and appoint my friend Stanley C. Swift, to be executor of this my Last Will and Testament, hereby revoking all former wills by me made. In witness whereof, I have hereunto set my hand and affixed my seal this 10thday of April, 1902. Reuben German Signed, sealed, published and declared by the testator as and for his Last Will and Testament in the presence of the undersigned, who at his request in his presence and in the presence of each other have hereunto subscribed their names as witnesses. Swift, residing at Cuba, NY David Thompson, residing at Cuba, NY RECORD OF THE WILL OF STATE OF NEW YORK, Allegany County Surrogate's Office Be it remembered, that on the day of the date hereof, the Last Will and Testament of Reuben German, late of the town of Cuba, in the County of Allegany and State of New York, deceased, being the within and foregoing written instrument, was duly proved before Elba Reynolds, Surrogate of said County, according to law as and for the Last Will and Testament of the real and personal estate of the said deceased, which said Last Will and Testament, and the proofs and examinations taken thereon are recorded in this office. In Testimony Whereof, the Surrogate of the said County hath hereunto set his hand and affixed his seal of office, this 17 day of July, AD 1902 Elba Reynolds Surrogate of Allegany County SURROGATE'S COURT-COUNTY OF ALLEGANY In the matter of Proving the Last Will and Testament of: Reuben German, Deceased, Stanley C. Swift and David Thompson being first duly sworn in open Court, each for himself, doth depose and say, that he is a subscribing witness to the Last Will and Testament of Reuben German late of the town of Cuba, in the County of Allegany and State of New York, deceased. And these deponents do further say that the said Reuben German deceased, did, in the presence of each of these deponents subscribe his name at the end of the instrument in writing, which is now here shown to these deponents, and which purports to be the last Will and Testament of the said deceased, and which bears date on the 10th day of April one thousand nine hundred and two. That said deceased died on or about the 20th day of May, 1902, at Cuba, in said County and State. That said deceased did, at the time of subscribing his name to the said instrument as aforesaid, declare the same to be his last Will and Testament; and these deponents did respectively subscribe their own names at the end of said instrument, as attesting witnesses to the execution thereof, each at the request of the said deceased, and in his presence, and in the presence of each other; That the said deceased, at the time of so subscribing his name to said instrument as aforesaid, and publishing said instrument as aforesaid was of full age; that he appeared to be, and deponents believe he was of sound mind, memory and understanding, and not under any restraint, and, as deponents verily believe, in all respects, competent to devise real estate; that each of these deponents saw the other sign his name to the said instrument in the presence of the said deceased.
