The submittor has given permission to the USGenWeb Archives to store the file permanently for free access. ************************************************************************ Last Will and Testament of William Wafler I, William Wafler of the town of West Almond, County of Allegany and State of New York, do make, ordain, publish, and declare this to be my last Will and Testament, in manner and form following, that is to say: First ? I give, devise, and bequeath to my beloved wife, Barbara L. Wafler, the homestead now owned and occupied by me in said town, & containing 73 acres & now constituting our family residence. Also, I give and devise to my said wife the Myers lot ? so called, consisting of three acres of land in said town the same having been conveyed to me in June 1898 by George Morton & wife. I likewise give and bequeath to my said wife all my household furniture, beds & bedding & all other domestic affects of every description; all the dairy of cows, livestock, including horses and colts, all working tools, & implements used on the farm or used by me, thereon. Third ? I give, devise and bequeath to my said wife the use, rents, issues & profits of all other real estate of which I may die seized. Also the use of income of all moneys, notes, bonds & mortgages & any other personal property not hereinbefore specified, for & during the period of her natural life. And in case the foregoing bequests & devises & provisions should be inadequate for the comfortable support & maintance of my said wife at any time during her life, these & in that case, I will & direct that she shall become entitled to as much of the personal property referred to in this paragraph as may be necessary for such support & if that or all of such personal property should be insufficient for such support, there I direct that the real estate referred to in this paragraph be sold by my executrix & executor hereinafter moved & the proceeds thereof applied for such support and maintenance. Fourth ? After the death of my said wife I direct that all real estate referred to in paragraph three remaining unsold under the conditions therein, shall then be sold or disposed of by my executor surviving, and the proceeds thereof together with all personal property their belonging to my estate shall be divided and distributed as follows: To my nephew Ray Wafler 1/9 thereof. To my sisters-in-law Clara Wafler & Amelia Dinsmore one sixth thereof to be equally divided between them in appreciation for their kindness in assisting us in times of sickness. To my sisters Emma Evans & Libbie Hammond & my brothers John Wafler and David Wafler all the rest residue & remainder to be equally divided amongh them, share and share alike. And I hereby give and grant unto my executrix & executor or either of them full power and authority to lease, sell & convey all or any of my real estate under the provisions of this will, & to give & execute instrumetns of conveyance or lease or mortgage thereof. Likewise, I make, constitute and appoint my said wife, Barbara L. Wafler & John Wafler to be my executors of this, my Last Will and Testament, hereby revoking all former wills by me made. In Witness Whereof, I have hereunto subscribed my name and affixed my seal, the 11th day of April in the year of our Lord, one thousand eight hundred and ninety-nine.
