Enders To Robert Service For and in consideration of one dollar to me in hand paid by Robert Service, of Conklin, in Broome County. I, John I. Enders do hereby release and discharge from the lien and operation of a certain mortgage, executed by William Enders to me the undersigned on the 12th day of March, A.D. 1836, and which said mortgage is recorded in Book of Mortgages of Broome County No. 7, page 237 (two hundred thirty seven) the following described parcel of land and being part of the premises described in said mortgages, viz, twenty acres of the northwest part of ninety two acres, more or less, as conveyed by said mortgage, the part hereby intended to be released from the operation of said mortgage is bordered north by Christopher Shear's land, east by part of the remaining part of said 92 acres as divided by a fence as it now stands, west by 100 acres of said lot, it being lot No. 26 in Clinton & Melchers Patent, formerly owned by Hiram Birdsall, and extending south far enough to include 20 acres and no more, and in addition to thereabove release of said 20 acres, I also release from the lien and operation of said mortgage, all the oak timber of what kind so ever suitable for making the staves, & all the staddle or young trees, now standing on the remaining part of said 92 acres, suitable for hoop poles, with the privilege of ingress & egress to and from the same for the cutting & removal of the same. To have and to Hold the said 20 acres, of land and said timber & trees for hoop poles & staves, to him the said Robert Service, his heirs and assigns forever, as fully, amply , as I am empowered to release the same But this instrument or release is not intended in the least, to invalidate or make void the lien & operation of said mortgage on the remaining part of said 92 acres, not hereby released But on the said remaining part, the said Mortgage is to remain in full force and virtue. Also "staves" Isaac Schoolcraft, Ezra Gallup Jr. State of New York, Schoharie County ss. On the twenty sixth day of May in the year one thousand eight hundred and forty one, John I. Enders, whom I know to be the individual mentioned in and who executed the within Instrument personally came before me and acknowledged that he executed the same Ezra Gallup Jr. Justice of the Peace. State of New York Schoharie County Clerks Office ss. I, Thos. McArthur Clerk of the court of Common Pleas, In and for the County of Schoharie, do certify, that Ezra Gallup Jr. Esq. whose name is subscribed to the certificate of the acknowledgement or proof of the annexed instrument and endorsed thereon, was on the day of the date of the said certificate, a Justice of the Peace in and for the said county, and duly authorized by law to take the same. And further, that I am well acquainted with his handwriting, and verily believe that the signature of the said Justice, subscribed to the said certificate is his proper handwriting.
