Perkins , the Executrix and Executor named in the last will and testament of Paul Perkins late of Binghamton, Broome Co. N. Y. , deceased, appeared in open Court before the Surrogate of the County of Broome and with application to have the said last will and testament which relates to both real and formal estate, proved and on such application the Surrogate did ascertain by satisfactory evidence who were the heirs and next of kin of the said testator and their respective residence; and said Surrogate did thereupon issue a citation in due form of law directed to the said heirs and next of kin by their respective names, stating their respective place of residence, requiring them to appear before said Surrogate at his office in Binghamton, N.Y. on the 23rd day of February satisfactory evidence by affidavit was produced and presented to said Surrogate of the service of the said citation in the mode prescribed by law; and one of the heirs and next of kin of the said testator appearing to be a minor and having no general guardian residing in the State of New York, a special guardian was appointed in due form of law to take care of her interests in the matter of proving said will; and no one appearing to oppose the probate of said will, such proceedings were thereupon had afterwards that upon this 23rd day of February, 1867 the Surrogate took the proof of said will hereinafter set forth; and he adjudged the said will to be a valid will of real and personal estate, and the proofs thereof to be sufficient; which said last will and testament and proofs are as follows, that is to say: WILL I, Paul Perkins of the village of Binghamton in the State of New York, Carpenter and Builder, being of sound mind, memory and understanding, do make and publish this my last will and testament in manner following, that is to say: First: I give and bequeath unto my wife, Persis Perkins the homestead situated on Rutherford Street in the Village of Binghamton, it being the house with lot now occupied by me, together with the household furniture of every name and nature. Second: I give and bequeath to my wife, Persis Perkins, and my children, Henry C. Perkins, Charles A. Perkins and Helen E. Perkins, the vacant lot adjoining the Homestead on the North, and all my personal property of every name and value of which I may die seized, and not otherwise appropriated after paying all debts due and owing at my decease in equal share to each. Third: Lastly, I do hereby nominate and appoint my wife, Persis Perkins, and my son, Henry C. Perkins, Executors of this my last will and testament, and I do hereby revoke all other wills by me heretofore made. In witness, I, the said Paul Perkins, have to this my last will and testament contaminative in this paper, at my hand at the bottom of this paper, the said will executed from motives of prudence this thirty first day of May A.D. 1866. Paul Perkins Signed, published and dictated by the said Paul Perkins as and for his last will and testament in the presence of us, who have at his request hereunto subscribed our names as witnesses thereto in the presence of the said testator and of each other this thirty first day of May A.D. 1866. Booth, being first duty sworn, deposes and says that he resides in Binghamton in the County of Broome, that he saw Paul Perkins, deceased, subscribe the instrument now shown to deponent with which purports to be the last will and testament of said deceased , bearing date the 31st day of May, 1866, that he heard the said deased declare the same to be his last will and testament, and that deponent did subscribe his name as witness thereto, at the request and in the presence of the said deceased, and that at the time thereof, the said deceased, and that a the time thereof, the said deceased was of sound mind and memory, of full age and not under restraint. Subscribed and sworn this 23rd Day of February 1867 before me Wm. B. Booth H.S.. Griswald, County Judge Broom County, ss Recorded the preceding last will and testament of Paul Perkins, deceased, as a will of real and personal estate together with the proofs taken in the Court of the Surrogate of the County of Broom, relating to the said last will and testament, which record is hereby signed and certified by me pursuant to the provisions of the Revised Statutes this 23rd day of February 1867.
