ANGELL Deceased And of the proofs taken upon probate Be it remembered that heretofore, to wit: on the second day in October in the year of Our Lord One Thousand Eight Hundred and Eighty Five George W. Angell and Azariah C. Angell Executors named in the Last Will and Testament of Azariah C. Angell deceased, appeared in open Court, before the Surrogate of the County of Broome, and made application to have the said Last Will and Testament which relates to both Real and Personal Estate, proved; and on such application the said Surrogate did ascertain by satisfactory evidence who were all of the heirs at law and next of kin of the said testator and their respective residences and said Surrogate did thereupon leave a Citation in due form of Law, directed to the said heirs at law and next of kin of said decedent, by their respective names, stating their respective places of residences requiring them to appear before said Surrogate at his office in the Court House in the Cith of Binghamton, in said County, on the 23rd day of November 1885 to attend the Probate of said Will. And afterwards, to wit: on the 23rd day of November A.D. 1885 satisfactory proof in the manner prescribed by law for proof of service of a summons issued out of the Supreme Court, was produced and presented to said Surrogate, of the due service of said Citation, in the mode prescribed by law, and on that day a supplemental citation was issued to said Horatio Angell returnable the 22 nd day of January 1886 at 2 o’clock in the afternoon to which time said matter was duly adjoined and on said 22 January 1886 due proof of the proper service of said supplemental citation having been filed with said surrogate and said George W. Angell and Azariah C. Angell the executors named in said will having appeared in support thereof no one appearing to oppose the probate of such Will such proceedings were thereupon had in valid Court afterwards, that the said Surrgate took the proofs of said Will hereinafter set forth upon this 22nd day of January A.D. 1886, and he thereupon adjudged the said Will Estate, and the proofs thereof to be sufficient, which said last Will and Testament and proofs are as follows, that is to say : In the Name of God, Amen. I Azariah C. Angell of the City of Binghamton NY being of sound mind and memory, and considering the uncertainty of this frail and transitory life do therefore make, ordain, publish and declare this to be my last will and testament that is to say: FIRST: After all my lawful debts are paid and discharged, I give and bequeath and devise all of my estate both real and personal to the Executors of this Will hereinafter appointed in Trust for the use of the persons and purposes hereinafter specified. I direct the said Executors to sell all of my Estate as soon after my decease as they can without sacarifice and at the best prices they can obtain and that they pay the assets to my children equally share and share alike including themselves. In case of the death of either of them before this will takes effect Igive the share of said deceased child to his or her child or children and if they leave no children or child the said share or shares shall be equally divided among the survivors as above except as herein provided. In case my son Horatio should die before this will takes effect, the herein in bequeathed to him I give to my oldest daughter. In case my daughter, Etta Jane, marries her cousin against my wishes I give her only one third of her equal share and the two thirds of an equal share I direct to be equally divided among the surviving children. Likewise I make constitute and appoint my two sons, George Angell and Azariah .C. Angell Jr. (with full power to see and convey my real estate) to be executor of this my last Will and Testament hereby revoking all former wills by me made. In witness whereof, I have hereunto subscribed my name and affixed my seal the 27th day of November in the year of our Lord one thousand eight hundred and eighty two. A.C.
