Ott In the matter of proving the last will & testament of Peter Hendrickson deceased ---------- At a Surrogates Court held in the village of Binghamton in the County of Broome on the 12th day of September A.D. 1836 before Joseph K Rugg Surrogate of the said County. On the day and at the place aforesaid James A Barnes a Claimant of Real Estate under the last Will and Testament of Peter Hendrickson late of the town of Colesville in the County of Broome and State of New York deceased appeared before the said Surrogate and exhibited the said Will and declared his intention to have same proved and recorded as a Will of personal and real property, pursuant to Chapter 1 Article 1 of Part 2 of the Revised Statutes of this State and made satisfactory proof of the death of the said Peter Hendrickson the Testator and his residence in the said County at the time of his death. Wherefore a citation was duly issued pursuant to the order of the said Surrogate to the heirs and next of Kin to the said deceased to appear and attend Probate of the said Will before the said Surrogate on the 7th day of November A.D.1836 at 10:00 o'clock in the forenoon of that day. At which time and place the hearing of the said proofs was by order of the said Surrogate adjourned to the 12th day of November in the year last aforesaid on the day and place last aforesaid the said James A. Barnes Claimant under the said Will appeared before the said Surrogate. Wherefore, I the said Surrogate aforesaid proceeded to hear the proofs offered by the said James A. Barnes & thereupon satisfactory proof was produced before the said Surrogate of lawful service and publication of notice to the heirs of said deceased and of lawful service of the citation issued in this case. Whereupon the only surviving witness to the said Will was by the said Surrogate duly sworn to prove the execution of the said Will and testified as follows: Broome County ss. Ezra Gurnsey being duly sworn says that he was acquainted with Peter Hendrickson deceased during his lifetime, that the instrument exhibited to him purporting to be the last Will & Testament of the said Peter Hendrickson deceased, was duly executed in presence of this deponent, that the deponent signed his name to said Will as a witness at the request of the said testator & in his presence, that the other subscribing witnesses to said Will, signed their names thereto in this deponents presence and in the presence of the testator and of each other at the request of the said testator, that at the time aforesaid the said testator declared the said instrument to be his last Will & Testament and was of sound mind & vision and competent to make a Will of Real Estate in the judgment of this deponent. That the said Will was executed at the date thereof as this deponent believes That the other two subscribing witnesses to the said Will are now dead; that he is acquainted with the hand writing of Abyah Barnes deceased, one of the witnesses to said Will & that the signature to said Will as a witness is in his hand writing. (signed) Ezra Gurnsey Also the testimony of Jesse Doolittle who being by the said Surrogate duly sworn testified as follows: Jesse Doolittle being duly sworn says that he knew Peter Hendrickson deceased deposited the the instrument now exhibited to him in his hands as his last Will & Testament , that he kept the same until after the death of the testator therein named, that he knew Aaron Ketchum one of the subscribing witnesses to said Will and saw him sign said Will as a witness. That the said testator at the time of execucting said Will was competent to divide Real Estate & of sound mind and memory in the judgment of this deponent . Signed Jesse Doolittle Also: Ezra Seymour being duly sworn says that he was acquainted with Peter Hendrickson deceased, that he visited him from the fall of 1809 until the summer following as a physician, that during the month of May 1810 the said deceased was of sound mind and memory and competent to make a Will of Real Estate during the said month of May in the judgment of this deponent. (signed) Ezra Seymour James Stringham being duly sworn says that he was acquainted with Peter Hendrickson deceased and lived near him, that he saw him frequently during the month of May A.D. 1810 and previous to that time and set up with him when he was ill, that the said deceased was of sound mind and memory at the times aforesaid and competent to make a will of Real Estate in the judgment of this deponent, that this deponent never saw him deranged nor heard of his being so until very lately, that if he had been so this deponent would have been very likely to have known of it from being so near and seeing the said deceased so frequently. Signed James Stringham The foregoing proofs and examinations were taken before the Surrogate aforesaid on the 12th day of November A.D. 1836 at my office in the town of Chinaugo in the County of Broome and the Deposition of Ezra Gurnsey the only subscribing witness to the said Will now surviving was by him subscribed after having been first carefully read over to him and also the testimony of Jesse Doolittle & Ezra Seymour & James Stringham other witnesses who were called in the matter aforesaid was by them respectively subscribed after havingbeen first carefully read over to them. And I the said surrogate being satisfied upon the said proof before me taken as aforesaid, that lawful service of notice of proving said Will has been served on the heirs of the said Peter Hendrickson the testator deceased, that the said Will was duly executed and that the said testator at the time executing the same was in all aspects competent to devise Real Estate and not under restraint do and therefore allow the said Will prods and examinations to be recorded. (signed) J K Rugg Surrogate WILL In the name of God, Amen, I Peter Hendrickson of the town of Windsor in the County of Broome & State of New York, Yeoman, being sick and very weak in body, but of perfect mind and memory, thanks be given to God, calling to mind the mortality of my body with knowing that it is appointed for all men once to die. I do make and ordain this my last Will & Testament, that is to say. Principally and first of all I give and reccommend my soul to the hands of Almighty God that gave it and my body I recommend to the earth to be buried in decent Christian Burial at the discretion of my executors nothing doubting at the general resurrection I shall receive the same again by the mighty Tower of God. And as touching the such worldly Estate wherewith it hath pleased God to bless me in this life; I give, divide and dispose of the same in the following manner and form. -- First, I give to my well beloved wife Juday Hendrickson the one equal undivided third part of all my Lands & Tenements during her lifetime together with my cows and sheep with all my goods and chattels and debts. Secondly - I give to my well beloved son Benjamin Hendrickson two equal undivided third parts of all my lands and tenements and the whole of my said lands and tenements at the decease of my wife Juday Hendrickson; and to his heirs to his and their own proper use benefit & behalf forever. Thirdly - I give to my well beloved son John Hendrickson one Dollar lawful money of the state New York to be levied out of my Estate. Fourthly I give to my well beloved son Henry Hendrickson one Dollar lawful money of the state New York to be levied out of my Estate. Fifthly - I give to my well beloved daughter Lydia wife of John Little Jr. one Dollar lawful money of the state New York to be levied out of my Estate. Sixthly - I give to my well beloved daughter Juday wife of Alpheus Judd one Dollar lawful money of the state New York to be levied out of my Estate. Seventhly - I give to my well beloved daughter Hannah wife of Silas Cresson one Dollar lawful money of the state New York to be levied out of my Estate. Eighthly - I give to my well beloved daughter Sally Hendrickson twenty Dollars lawful money of the state New York to be levied out of my Estate and paid to her when she shall become eighteen years old. And I do likewise constitute Jesse Doolittle of the town aforesaid Executor and Juday my wife Executrix of this my last Will & Testament, all and singular my Lands, tenements messuages by them only to be executed. And I do hereby utterly revoke, disallow and disavow all and every other former Wills, legacies, bequests & Executins by me in anywise before mentioned ordered and bequeathed, ratifying and confirming this and no other to be my last Will & testament. In testimony whereof I have hereunto set my hand and Seal this twenty second day of May in the year of our Lord one thousand eight hundred & ten.
