Rose Surrogates Court, Broome County Record of the Last Will and Testament of Hannah R. Rose, Deceased Be it remembered that heretofore, to will, on the twenty ninth day of February in the year one thousand eight hundred and sixty. Peter Johnson General Guardian of Nathan A. Johnson sole legator and devisee name in the last will and testament of Hannah R. Rose, late of Chenango in said County deceased appeared in open court before the Surrogate of the County of Broome and made application to have the said last will and testament which relates to real estate proved and on such application, the Surrogate did ascertain by satisfactory evidence who were the husband heirs and next of kin of said testatrix and their respective residences; and some of them appearing to be minors and having no general guardian within the State of New York, a special guardian was appointed in due form o f law to take care of their interest in the matter of proving the said will by an order entered for that purpose by said surrogate and the said Surrogate did thereupon give a citation in due form of law directed to the said husband , heirs and next of kin and special guardian by their respective names, stating their respective places of residences, regaining them to appear before said surrogate at this office in Binghamton on the 21st day of April 1860, to attend the probate of said will and afterwards to wit, on said 21st day of April satisfactory evidence by affidavit was produced and presented to said surrogate of the service of the said citation, in the manner prescribed by law and on that day n one appearing to oppose the probate of such will such proceedings were thereupon had that the surrogate took the proof of said will herein after set-forth; and he adjudged the said will to be a valid will of real estate and the proofs thereof to be sufficient which said last will and testament and proofs are as follows, that is to say. Will: The last will and testament of Hannah R. Rose of the town of Chenango in the County of Broome and State of New York. I Hannah R. Rose of the town of Chenango in the County of Broome and State of New York of the age of sixty three years and being of sound mind and memory. Do make publish and declare this my last will and testament in manner following that is to say: I give and devise to Nathan Augustus Johnson, son of my niece Hannah Jane Johnson his heirs forever, all that tract or parcel of land situated in the town of Pitcher County of Chenango and State of New York, It being part of Lot No. Eighty Five (85) being in township and bounded as follows. Beginning at the North East of what is called Shipman Bridge across the Otselic Creek. Thence North 24 degrees East, North 30 degrees East, Thence South of 87_ degrees East. Thence South 21 « degrees West, Thence South 76_ degrees west Thence South 62 degrees West to the place of beginning containing by estimation Thirty Eight acres of land be the same more or less. Together with all the hereditaments and appertenances, thereunto belonging or in any wise appertaining to have and to hold the premises above described to the said Nathan Augustus Johnson his heirs forever. Secondly, in of the death of the said Nathan Augustus Johnson without heir or heirs I give and devise the above described real estate to my two brothers Martin Wail-Reynolds and Nathan Crandall Reynolds equally and to their heirs forever and lastly I hereby revoke all former wills by me made. In witness whereof I have hereunto set my hand and seal this 30th day of April A.D. 1856. Seal Hannah R. Rose The above instrument was at the date thereof signed sealed published and declared by the said Hannah R. Rose as and for her last will and testament in presence of us who at her request and in her presence and in the presence of each other have subscribed our names as witness thereto. B.N. Loomis of Binghamton Broome Co. N.Y. C.N. Fancher Broome County ss: Charles N. Fancer being first duly sworn deposes and says, that he resides in Binghamton in the county of Broome that he saw Hannah R. Rose deceased, subscribe the instrument now shown to deponent and which purports to be the last will and testament of said deceased bearing date the 30th day of April 1856, that he heard the said deceased declare the same to be her last will and testament, and that deponent did subscribe his name as a witness thereto at the request and in the presence of the said deceased and that, at the time thereof the said deceased was of sound mind and memory of full age and not under restraint.
