Vol. 22 page 105 Hartwell B. ALDRICH of Conewango probate date 6 August 1908, at Salamanca Emma A. Aldrich, executrix will dated 1 May 1908 In the name of God, Amen: I, Hartwell B. Aldrich of the town of Conewango in the County of Cattaraugus and state of New York, being of sound mind and memory, do make publish and declare this my last Will and Testament, in manner following, that is to say: - First: - I direct that all my just debts and funeral expenses be paid. Second:- I do give, devise and bequeath to my wife, Emma A. Aldrich, the use, income and control of all the real property of which I die seized during the term of any and all leases or, contracts in force in regard to said real property, at the time of my death. Third:- I do give and bequeath to my sister, Kate A. Briel, the sum of Two Thousand Dollars ($2000.00) the same to be paid to her two years from the date of the probate of my will. Fourth:- I do give and bequeath to my nephew, Stanley Aldrich, the sume of Two Thousand Dollars ($2000.00), the same to be paid to him two years from the date of the probate of my will. Fifth:- Subject to the interest in the following premises as given to my wife, by the paragraph marked Second, I do give and devise to my nephew, Stanley Aldrich, the real property described in deed dated October 20, 1902, given by Hiram A. Damon and wife to Hartwell B. Aldrich, said ded having been recorded in the Cattaraugus County Clerk's office, December 1, 1902 in Liber 187 of Deeds at Page 288, also the part of the real property described in deed April 24, 1894 given by John B. Corcoran referee, to Hartwell B. Aldrich, said deed having been recorded in the Cattaraugus County Clerk's office, May 14, 1894 in Liber 160 of Deeds at Page 345, which I still own. Sixth:- I do give and evisee to my wife, Emma Aldrich, the use, income and control during her life time, of the real property described in deed given by William Hollister to Hartwell B. Aldrich, said deed being dated January 1, 1886 and recorded in the Cattaraugus County Clerk's office, January 16, 1886 in Liber No. 129 of Deeds at Page 542; after the death of my said wife, I direct that said real property to be given to, or divided among my five nieces, Estella Beard, Emir Cook, Philena Aldrich, LIllie Aldrich, and Loretta Holbrook, share and share alike. Seventh:- I do give and bequeath to the trustees of the Rutledge Cemetery Association, the sum of Five Hundred Dollars, ($500.00) in trust, said sum of $500.00 to be held in trust by said trustees and their successors in office and the interest and income therefrom ONLY to be used by said trustees for such purposes as they choose, but they shall not have the right to use any of said principal sum for any purpose or purposes whatever except to kee the same invested or placed at interest; said sum to be paid to said trustee two years from the date of the probate of my will; if for any reason said bequest is declared to be invalid, said sum of five hundred dollars shall form a part of my residuary estate. Eighth:- I do give, devise and bequeath to my said wife, Emma A. Aldrich, all the residue and remainder of all my property of every name and nature, both real and personal, absolutely and unconditionally. Ninth:- I do hereby authorize and empower my executor or executrix hereinafter named, to sell, assign, transfer and convey any and all real and personal property belonging to my estate at either public or private sale. Tenth and Lastly, I do hereby nominate and appoint my said wife, Emma A. Aldrich, executrix of this my last Will and Testament and I do hereby revoke any and all former wills by me made. In Witness Whereof, I have hereunto subscribed my name this first day of May A.D. 1908 Hartwell B. Aldrich We, whose names are hereto subscribed, Do certify, that Hartwell B. Aldrich, the testator, subscribed his name to his instrument on the first day of May 1908 in our presence and in the presence of each of us, and at the same time, in our presence and hearing declared the same to be his last will and Testament, and requested us, and each of us, to sign our names thereto as witnesses to the execution thereof, which we hereby do in the presence of the testator and of each other on the said first day of May, that being the date of said Will and write opposite our names, our respective places of residence.
