I, Daniel. G. Bingham late Colonel of the 64th Regiment N.Y. Vols, in
Service of the U.S., aged 37 years and being of sound mind and memory do
make and publish this my Last Will and Testament.

1st, I give and bequeath and devise to my Sister Calista [sic] Bingham
all my property Real and Personal except the sum of One Hundred Dollars
which I direct Shall be paid to my half Sister Josephine Thiving.

2nd, I hereby appoint Samuel William Johnson of Ellicottville, N.Y. the
sole Executor of this my Last Will and Testament.

Signed this 21st day of July 1864 in the Town of LeRoy, Genesee Co., N.Y. by
the testator in the presence of the undersigned witnesses and the undersigned
witnesses at the request of Said testator Signed the same as witnesses in
presence of the Said testator and in the presence of each other, the Said
testator declaring the above instrument to be his Last Will and Testament.
