Second: I will and declare that my executrix hereinafter named provide for and support my mother Agnes Gray during the term of her material life and pay her funeral expenses, and I do hereby charge my said property with support of my said mother during her material life and make the same a lien upon my property, such support to have a preference over all other claims upon my property. Third: After my said mother's death I direct my executrix hereinafter named to expend the sum of one thousand dollars in buying a lot for a burying ground erecting a fence around the same & [? ereding] a monument for my family. The above sum of one thousand dollars is named by me as the extend of money I desire my executrix to use for that purpose and that a less sum may be expended for that purpose in the discretion of my executrix. Fourth: I give and bequeath to my brother Abram Gray the sum of three thousand dollars to be paid to him two years from the death of my mother Agnes Gray. This legacy to draw interest after six months form the date of my mothers death. Fifty: All the rest of my property both real and personal I give, bequeath and devise to my wife, Lorsey I Gray, absolutely and forever. Sixth: I make, constitute and appoint Lorsey I Gray the sole executrix of this my last will and testament with full power to sell and convey my real and estate when in her judgment it shall be proper to do so to carry out the provisions of this will hereby revoking all former will by me made. Stewart of Ellicottville, New York Wm Manley of Ellicottville, New York State of New York Cattaraugus County Surrogates Office Recorded the preceding last Will and Testament of George Gray late of said county, deceased as a Will of real and personal property together with the proofs relating to said will, taken in the Surrogate’s court of the County of Cattaraugus, of which record as hereby signed and certified, pursuant to the provisions of the Revised Statutes this twenty first day of December AD 1874 James D McVey Surrogate In a separate filing: Whereas by the last will & testament of George Gray, late deceased dated Oct. 19, 1874 he bequeathed to me his brother Abram Gray the sum of three thousand to be paid to me two years from the death of his mother Agnes Gray to draw interest after six months from his mothers death who was also my mother. And whereas the said Agnes Gray died Nov. 27, 1879. Now therefore in consideration of the sum of one thousand dollars thereof paid to me Oct. 16, 1880 and the further sum of two thousand one hundred & twenty eight dollars and sixty five cents to me this day paid being the whole of said legacy and interest. I hereby sell, assign, and transfer to said legacy & bequest to Lorsey I Foote formerly widow of the said George Gray deceased & authorize her to collect settle & discharge the legacy at her pleasure as fully as I could do myself if this transfer had not been made.
