THE PETITION of Michael Berrigen (corrected to Berrigen from Bergen) of the City of Auburn in the County of Cayuga, respectfully sheweth: That your petitioner is one of the sons of Mary Bergen late of the City of Auburn in the said County of Cayuga, now deceased; that the said deceased died on or about the 29th day of June in the year of our Lord one thousand eight hundred and eighty-nine that at the time of her death she was a resident of said County of Cayuga; My aforesaid that your petitioner has made diligent search for a will among the business papers of said deceased, since her death, and has inquired of the members of her family, and others most conversant with her business affairs, concerning such will; that said deceased left no will, as far as your petitioner has been able to discover; That the said deceased left no husband her surviving; that she left the following next of kin to wit: -Jeremiah Bergen a son who resides at Auburn, NY -Michael Berrigen (corrected from Bergen to Berrigan, a son, your petitioner who resides at Auburn, NY -Margaret Spencer a Daughter who resides at Auburn NY -Bridget Kennedy a Daughter who resides at Auburn NY -Hanoria McCabe a Daughter who resides at Auburn NY -Julia Noonan a Daughter who resides at Newark NY -James Bergen a son who resides a Rathdowney Ireland -Timothy Bergen a son who resides at Graggarron Ireland -Catherine Bowe a Daughter who resides at Galmoy Ireland -John Bergan a son who resides at Graggarron Ireland -Elizabeth Whalen a Daughter who resides at Lavaly Ireland -MaryAnn Bergen a daughter who resides in Australia, whose place of residence is unknown and cannot be ascertained by your petitioner with due diligence. -Sarah Bergen a daughter who resides in Australia, whose place of residence is unknown and cannot be ascertained by your petitioner with due diligence. All of whom are of full age and sound mind, so far as they are known to you petitioner, or can be ascertained by him with due diligence. That the whole amount of the personal property and rights of action left by the said deceased will not exceed in value the sum of Thirty Dollars, as your petitioner is informed and believes. That no previous application has been made for the appointment of an Administrator of the good, chattels and credits of the said deceased, and no Surrogate's Court of the State has obtained jurisdiction of or over the estate of said deceased, as your petitioner is informed and believes. Your petitioner therefore prays for a decree awarding letters of Administration upon the estate of the said deceased to your petitioner Michael Bergen (Berrigen) or to some other Competent person and that the persons required to be cited, as prescribed in Section 2662 of the Code of Civil Procedure, may be cited to show cause what such a decree should not be made.
