Know ye that at Ledyard in the County of Cayuga on the eighteenth day of March in the year of our Lord, one thousand eight hundred, & twenty four, before Benjamin L. Cuyler Esq. Surrogate of our said county, the last will and testament of Elias Ames late of the town of Scipio in said county deceased (a copy whereof is hereunto annexed) was duly proved and is now approved & allowed of by us. And the said deceased having whilst he lived and at the time of his death, goods, chattels, or credits with this state, by means whereof the proving and registering of said will, and the granting a demonstration of all and singular the said goods, chattels, and credits also the allowing anditing and the final discharging the accounts thereof doth belong unto us; Therefore the administration of all and singular, the goods, chattels, and credits of the said deceased, and in any way concerning his will is granted unto Tryphena Ames, Bishop Ames, & Chester Ames Executors in the said will named, they first being duly sworn did and faithfully to administer the same, and to make and exhibit a true and perfect inventory of all and singular the said goods, chattels, and credits and also to enter a just and true account thereof when these unto required. In testimony whereof we have caused the seal of office of our said surrogate to be hereunto affixed. Witness Benjamin L Cuyler Esq. Surrogate of the said county at Ledyard aforesaid the eighteenth day of March in the year of our Lord one thousand eight hundred and twenty four. Benjamin L Cuyler Surrogate Know all men by these presents that I Elias Ames of the town of Scipio in the county of Cayuga state of New York being of sound mind and memory thanks be to God for the same and being advanced in years and feeling the infirmities of my mortal body, to be such that in a little time I may expect to be called from this mortal stage and having a desire to set my house in order and to settle my business of a temporal nature, for the benefits of my surviving family do by these presents make my last will and testament. First, I resign myself to God, soul and body to be at his pleasure and while my body may sleep in the dust, may my soul rest with Christ until the resurrection then to be raised a spiritual body in reunion with my soul to be forever employed in praising God the author of my existence. Second, it is my will and I do ordain & decree that all my debts and funeral charges be paid by my executors out of my personal property. Third, I give and bequeath to my beloved wife Tryphena, one third of my estate both real and personal for her use during her natural life together with all household furniture after paying thouse legacys herein aforementioned out of my personal property and all my just debts Fourth, I give and bequeath unto my oldest son Anson Ames five dollars out of my personal property. Fifth, I give and bequeath unto my son Bishop Ames five dollars out of my personal property in addition to what these two sons have already been given them out of my estate. Sixth, I give and bequeath to my son Henry C. Ames twenty five acres of land, off the northwest corner of my farm, taken off in a square form to have and to hold the same with all appurtenances and privileges thereunto belonging to him, his heirs, and assigns forever. Seventh, I give and bequeath unto my son Chester Ames one half of the remainder of my farm with this reserve only that his mother is to have the use of one third of my property during her natural life, to have and to hold the same with all the appurtenances and privileges thereunto belonging to him, his heirs, and assigns for their own use and benefit on an equal division with his brother Orin. Eighth, I give and bequeath to my son Orin Ames one half of my farm, equal in quantity and quality with his brother Chester, with the same reserve, that his mother is to retain the use of one third of my property, during her natural life to have and to hold the same with all the appurtenances and privileges thereunto belonging to him, his heirs, and assigns forever. Ninth, I give and bequeath to my daughter Polley two hundred dollars out of my personal property to be paid to her, her heirs, or assigns. Tenth, I give and bequeath unto my daughter Lalla one hundred dollars out of my personal property to be paid to her, her heirs, or assigns in this being my last will I hereby revoke and annul all former wills of whatsoever name or nature and in order that this be executed according to the above requests, I have appointed and do by these presents appoint Tryphena Ames my beloved wife and Bishop Ames and Chester Ames my two sons executors giving them full power to do and perform all things according to law. In witness whereof I have hereunto set my hand and seal this twenty fourth day of June in the year of our Lord one thousand eight hundred and twenty two, declaring this to be my last will and testament in presence of Richard Piece Elias Ames Sally Palmer Zadack Bateman Surrogates Office County of Cayuga - Be it remembered on this Eighteenth day of March in the year of our Lord one thousand eight hundred and twenty four, Zadack Bateman personally appeared before me Benjamin L. Cuyler Esq. Surrogate of said county and being swore did depose and on his oath declare, that he saw Elias Ames late of the town of Scipio in said county deceased sign, seal, and deliver an instrument in writing, purporting to be his last will and testament bearing date the twenty fourth day of June Eighteen hundred and twenty two whereof the preceding is a true copy and heard him publish and declare the same, as and for this last will and testament and that at the time he was of sound disposing mind and memory, according to the best knowledge & belief of this deponent, and that the name of the deponent described to the said wife is of his own and proper handwriting which he subscribed thereto in the presence of the testator and that he saw Richard Piece and Sally Palmer subscribe their names to the said will as witnesses thereto in the presence of each other and the testator.
