NY Will Book Vol. B1 page 116a Written: November 7 1816 Recorded: October 12 1820 Will of Hosea Curtice The people of the State of New York by the grace of God; free and independent; To all to whom these presents shall come or may concern, sends greeting. Know ye that at Scipio in the County of Cayuga, on the twelfth day of October, in the year of our Lord, one thousand eight hundred and twenty before Seneca Wood Esquire, Surrogate of our said County, the last will and testament of Hosea Curtice, late of the town of Locke in said county, deceased (a copy where of is here unto annexed) was duly proved, and is now approved and allowed of by us. And the said deceased having whilst he lived and at the time of his death, goods, chattels or credits within this state, by means whereof the proving and registering the said will, and the granting a demonstration of all and singular the said goods, chattels and credits, also the auditing, allowing, and final discharging the accounts thereof doth belong unto us; Therefore the administration of all and singular, the goods chattels and credits of the said deceased and in any way concerning his will, is granted unto Hosea Curtice, son of this estator, (Silas Bowkin Esquire executor in the said will named, having ________ the execution of the said will _____renunciation having been duly filed entered in the office of our surrogate aforesaid county, and the said Hosea Curtice, son of said testator being first duly sworn well and faithfully to administer the same and to make and exhibit a true and perfect monitory of all and singular the said goods, chattels and credits and also to render a just and true account thereof when thereunto required. In testimony whereof we have caused the seal of office of our said Surrogate hereunto affixed. Witness Seneca Wood Esquire, Surrogate of our said County, at Scipio aforesaid the fifth day of February, in the year of our Lord, one thousand eight hundred and twenty one and for Independence the forty fifth. I Hosea Curtice of the town of Locke in the County of Cayuga, and state of New York, being in sound health, both in body and mind, do make and order this my last will and testament in the following manner (that is to say)First I give and bequeath to my son Hosea Curtice Junior one equal half of all my estate, Both real and personal, on his paying the several legacies herein after named for him to pay and 2nd I give and bequeath to my son Amos Curtice the other equal half of all my estate both real and personal, on his paying the several legacies hereafter named for him to pay, and 3rd I give and bequeath to each of my daughters, who shall be alive at the time of my decease, one dollar to be paid to them by my sons Hosea and Amos jointly when they shall call for it after my decease, and 4th, I give and bequeath to my granddaughter Polly Hill, one good feather bed, with a striped tick, with one pair of sheets, and two blankets, one bolster and two pillows to be given her by my sons, Hosea and Amos jointly when she shall call for it after my decease. And do further will and decree that out of the estate which I have now bequeathed to my two sons Hosea and Amos, my wife Susannah shall have a decent and comfortable living during her natural life and shall have help for her by my two sons Hosea and Amos jointly, one good cow and four good weathers and shall also have the privilege of disposing of her wearing apparel and household furniture as to her shall seem meet and proper, reserving the best which has been given to my granddaughter Polly Hill And I do name, constitute and appoint Silas Bowkin Esq. Signed, sealed, published and declared by the testator to be his last will and testament in our presents The interlination between the 15 and 16 lines was done before signing Eliakin Sharp David Winters Juliana Sharp Surrogate Officer Cayuga County SS: Be it remembered, that on the twelfth day of October, in the year of our Lord one thousand eight hundred and twenty, before me Seneca Wood Esquire, Surrogate of said County personally appeared Eliakin Sharp, who being duly sworn did depose and on his oath declare that he saw Hosea Curtice late of the town of Locke, in said County, sign, seal and deliver an instrument in writing purporting to be his last will and testament, bearing date the seventh day of November in the year of our Lord one thousand eight hundred sixteen, (whereof the preceding is a true copy,) and heard him publish and declare the same as and for his last will and testament, and that at the time thereof he was of sound disposing mind and memory, according to the best knowledge and belief of the deponent, and that the name of the deponent subscribed thereto in the presence of the testator, and that he saw David Winters and Juliana Sharp subscribe their names to the said will, as witnesses also to its execution, in presence of each other and of the testator.
