Respectfully shown that Aaron Bowen late of the town of Fleming in the county of Cayuga and state of New York, departed this life on or about the eighth day of March in the year of our Lord eighteen hundred and thirty nine. That the said deceased was at the time of his death an inhabitant of the said county of Cayuga, that he left a last will and testament which is dated the first day of July in the year of our Lord one thousand eight hundred and twenty eight. That in and by the said will and a codicil thereto, the said deceased appointed your petitioner executor and Abigail Bowen executrix thereof. That the said deceased left the following his heirs at law and next of kin, to wit Amy Bowen, Elizabeth Simonds wife of Leonard Simonds, John Smith Bowen, Aaron Bowen, Polly Wilkinson wife of Lyman Wilkinson, Amy (Ann?) Maria Bowen, Eliza Bowen, and Sarah Ann Bowen all of the said town of Fleming, Erastus Bowen and Daniel Bowen of Perry, Genessee County, Henry R Carver of Savannah, Wayne County, Lucy Gould wife of Samuel Gould of Springwater, Livingston County, Phebe Morce of Scituate Rhode Island, Sarah W Brown, Lucy Ann Manchester, Eveline Burt and Harriet Smith, William Burt, James C Burt, Henry C Burt, and Eliza Burt all of Cheshire Massachusetts. And Abigail Bowen of the said town of Fleming his widow. That the said Polly Wilkinson, Henry R Carver, Amy Maria Bowen, Eliza Bowen and Sarah Ann Bowen for whom your petitioner is the duly appointed guardian. That said will relates to both real and personal estate. That your petitioner is desirous of proving said last will and testament as a will of real estate that the same may be recorded as such in pursuance of the statute in such cases made and provided. Your petitioner therefore prays the Surrogate aforesaid that the necessary steps may be taken before him for that purpose and that the same may be admitted to probate and setten testamentary if need thereon and that Nathaniel Close of the said town of Fleming may be appointed special guardian to the said Henry R Carver, Elizabeth Simonds, John Smith Bowen, William Burt, James C Burt, Henry C Burt and Eliza Burt minors for the sole purpose of appearing for them and taking care of their interests in the further proceedings in this matter. Dated March 28th 1839 Joseph Martin The last will and testament of Aaron Bowen of Fleming, county of Cayuga, and state of New York. I, Aaron Bowen, considering the uncertainty of this mortal life, and being of sound mind and memory, blessed be Almighty God for the same, do make and publish this my last will and testament in manner and form following. That is to say, first, I give and bequeath unto my beloved wife Abigail Bowen all the benefits, profits, and income resulting from my real estate lying in the town of Fleming, county of Cayuga, being a part of lot A seventy four and sixty five together with all the personal property to use and do with both the avails of the real estate and the personal estate, and to be at her control and disposal so long as my said wife shall remain my widow and no longer, provided my said wife shall pay or cause to be paid to my oldest son Seth Bowen the sum of twenty dollars to be paid out of the personal property in three years after my death and likewise to pay or cause to be paid to my oldest daughter Phebe Morce twenty dollars to be paid out of my personal property in two years from my death, and likewise pay or cause to be paid to my second daughter Lucy Burt the sum of twenty dollars to be paid out of my personal property in one year from my death, to my third daughter Amy Bowen I give and bequeath all the beds and bedding she has made since her mother's death, likewise I give and bequeath to my daughter Anna Bowen, one hundred and fifty dollars to be paid in the manner following out of the personal property fifty dollars to be paid in four years after my death, and fifty dollars yearly thereafter. Likewise the privilege of living on the said farm as she has heretofore done, as long as she remains unmarried. To my daughter Elizabeth Bowen I give and bequeath one hundred and fifty dollars to be paid in the manner following , fifty dollars to be paid in seven years after my death and fifty dollars yearly thereafter until the said sum is paid and lastly to my son John Smith Bowen I give and bequeath all my real and personal estate after the above named legacies are paid and after the death or marriage of my said wife, except the household furniture which I give equally to be divided between Elizabeth Bowen and John Smith Bowen, as to the rest of all my personal and real estate, goods, and chattels of whatever name or nature I give and bequeath to my son John Smith Bowen after the death or marriage of my said wife whom I appoint executrix of this my last will and testament. Likewise I do hereby appoint my oldest son Seth Bowen executor of this my last will and testament hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal the first day of July in the year of our Lord eighteen hundred and thirty eight.
